航空業務に関する日本国とイタリアとの間の協定の付表の修正に関する交換公文

書簡をもって啓上いたします。本使は、千九百六十二年一月三十一日に東京で署名された航空業務に関する日本国とイタリアとの間の協定(以下「協定」という。)及び千九百九十四年一月十九日から二十一日までの間ローマにおいて日本国の航空当局とイタリアの航空当局との間で行われた協議に言及する光栄を有します。
Excellency, I have the honour to refer to the Agreement between Japan and Italy for Air Services signed at Tokyo on January 31, 1962 (hereinafter referred to as the "Agreement"), and to the consultations between the aeronautical authorities of Japan and Italy held in Rome from January 19 to January 21, 1994.
本使は、前記の協議において到達した合意に従い、この書簡に同封する修正された付表が協定の付表に代わるべきことを日本国政府に代わって提案する光栄を有します。
Pursuant to an agreement reached at the said consultations, I have the honour to propose, on behalf of the Government of Japan, that the Schedule to the Agreement be replaced by the revised Schedule set out in the enclosure of this Note.
本使は、前記の提案がイタリア政府にとって受諾し得るものであるときは、この書簡(同封物を含む。)及び受諾を表明される閣下の返簡が閣下の返簡の日付の日に効力を生ずる両国政府間のこの問題に関する合意を構成するものとみなすことを提案する光栄を有します。
If the above proposal is acceptable to the Government of Italy, I have the honour to suggest that this Note with its enclosure and Your Excellency's reply indicating such acceptance shall be regarded as constituting an agreement between the two Governments on this matter, which shall enter into force on the date of Your Excellency's reply.
本使は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。

1 日本国の指定航空企業が両方向に運営する路線
1. Routes to be operated in both directions by the designated airline of Japan:
(a) 日本国内の地点－北京又は上海(注1)－香港又はマニラ－ホーチミン･シティ－プノンペン及び(又は)シェムレアップ－バンコック－ヤンゴン又はダッカ－カルカタ又はニュー･デリー－ボンベイ－カラチ－アブダビ又はドバイ－テヘラン、クウェイト、ダーラン又はバーレン－バグダッド－ジェッダ(注1)－カイロ又はダマスカス－ベイルート－イスタンブル－アテネ－ローマ及び(又は)ミラノ－スイス内の一地点－ドイツ連邦共和国内の一地点－パリ－ロンドン－

(c) Points in Japan - one point to be agreed upon later - Moscow - two points in Europe (Note 5) - Rome and/or Milan -:
(i) 北米内の三地点(注2)
(i) three points in North America (Note 2).
(ii) アフリカ内の二地点(注3)－中南米内の二地点(注4)
(ii) two points in Africa (Note 3) - two points in Central and South America (Note 4).
注1 ジェッダからローマ及び(又は)ミラノまでの区間並びにローマ及び(又は)ミラノからジェッダまでの区間並びに北京又は上海からローマ及び(又は)ミラノまでの区間並びにローマ及び(又は)ミラノから北京又は上海までの区間の運輸権は、行使することができない。
Note 1. Traffic rights for the sectors Jeddah-Rome and/or Milan and vice versa and Beijing or Shanghai - Rome and/or Milan and vice versa may not be exercised.
注2 カナダについては、一地点を超えて使用することができない。
Note 2. More than one point in Canada cannot be used.
注3 アフリカ内の二地点は、カルトゥームとドゥアラを結ぶ線以北とする。
Note 3. Two points in Africa shall be in the north of the line connecting Khartoum and Douala.
注4 ヴェネズエラ及びメキシコ内の地点を含まない。
Note 4. Any point in Venezuela and Mexico shall not be included.
注5 日本国の指定航空企業は、「ヨーロッパ内の二地点」とローマ及び(又は)ミラノとの間においては、自己が運送する途中降機の旅客についてのみ第五の自由の運輸権を行使することができる。
Note 5. The designated airline of Japan may exercise fifth freedom traffic rights only for its own stopover passengers between "two points in Europe" and Rome and/or Milan.
2 イタリアの指定航空企業が両方向に運営する路線
2. Routes to be operated in both directions by the designated airline of Italy:
(a) イタリア内の地点－アテネ－カイロ、ベイルート、テル･アヴィヴ又はダマスカス－ジェッダ(注1)－バグダッド－ダーラン－テヘラン－アブダビ又はドバイ－カラチ－ボンベイ、ニュー･デリー又はカルカタ－コロンボ又はヤンゴン－バンコック－プノンペン及び(又は)シェムレアップ－ヴィエトナム内の一地点－マニラ－香港－北京又は上海(注1)－東京及び(又は)大阪(注2)－ソウル
(a) Points in Italy - Athens - Cairo or Beirut or Tel Aviv or Damascus - Jeddah (Note 1) - Baghdad - Dhahran - Teheran - Abu Dhabi or Dubai - Karachi - Bombay or New Delhi or Calcutta - Colombo or Yangon - Bangkok - Phnom Penh and/or Siem Reap - one point in Vietnam - Manila - Hong Kong - Beijing or Shanghai (Note 1) - Tokyo and/or Osaka (Note 2) - Seoul.
(b) イタリア内の地点－ヨーロッパ内の三地点－アンカレッジ－東京及び(又は)大阪(注2)

(c) Points in Italy - two points in Europe - Moscow - one point to be agreed upon later - one point in Asia (Note 3) - Tokyo and/or Osaka (Note 2).
注1 ジェッダから東京及び(又は)大阪までの区間並びに東京及び(又は)大阪からジェッダまでの区間並びに北京又は上海から東京及び(又は)大阪までの区間並びに東京及び(又は)大阪から北京又は上海までの区間の運輸権は、行使することができない。
Note 1. Traffic rights for the sectors Jeddah - Tokyo and/or Osaka and vice versa and Beijing or Shanghai - Tokyo and/or Osaka and vice versa may not be exercised.
注2 イタリアの指定航空企業は、関西国際空港が国際航空業務について供用を開始した後に、大阪への業務を行うことができる。千九百九十五年十月三十一日までの間、イタリアの指定航空企業は、暫定的措置として、路線(a)において名古屋への貨物業務を行うことができる。東京に寄航する便で名古屋に寄航してはならない。
Note 2. The designated airline of Italy may serve Osaka only after the Kansai International Airport is opened to international air services. Until 31 October 1995, the designated airline of Italy may operate on a temporary basis all cargo services to Nagoya on route (a). Nagoya shall not be served on the same flight with Tokyo.
注3 イタリアの指定航空企業は、「アジア内の一地点」と東京及び(又は)大阪との間においては、自己が運送する途中降機の旅客についてのみ第五の自由の運輸権を行使することができる。
Note 3. The designated airline of Italy may exercise fifth freedom traffic rights only for its own stopover passengers between "one point in Asia" and Tokyo and/or Osaka.
3 いずれか一方の締約国の指定航空企業が行う協定業務は、当該一方の締約国の領域内の一地点を起点としなければならないが、特定路線上の他の地点は、いずれかの又はすべての飛行に当たりその指定航空企業の選択によって省略することができる。
3. The agreed services provided by the designated airline of either Contracting Party shall begin at a point in the territory of that Contracting Party, but other points on the specified routes may at the option of the designated airline be omitted on any or all flights.

書簡をもって啓上いたします。本官は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。
Excellency, I have the honour to acknowledge the receipt of Your Excellency's Note of today's date, which reads as follows:

本官は、イタリア政府が日本国政府の前記の提案を受諾する旨を閣下に通報するとともに、閣下の書簡及びこの返簡が本日効力を生ずる両国政府間のこの問題に関する合意を構成するものとみなすことを確認する光栄を有します。
I have the honour to inform Your Excellency that the Government of Italy accepts the above proposal and to confirm that Your Excellency's Note and this reply are regarded as constituting an agreement between the two Governments on this matter, which enters into force on this date.
本官は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。
