航空業務に関する日本国とインドネシア共和国との間の協定の付表の修正に関する交換公文

(Japanese Note)

　 Jakarta, February 22, 1994

　書簡をもって啓上いたします。本使は、千九百六十二年一月二十三日に東京で署名され千九百六十五年、千九百七十年、千九百八十七年及び千九百九十年に修正された航空業務に関する日本国とインドネシア共和国との間の協定(以下「協定」という。)に関し、千九百九十二年九月三十日から十月一日までの間東京において及び千九百九十三年八月三十一日から九月一日までの間ジャカルタにおいて行われた協議に言及する光栄を有します。

　Excellency,
I have the honour to refer to the consultations held in Tokyo from September 30 to October 1, 1992 and in Jakarta from August 31 to September 1, 1993 concerning the Agreement between Japan and the Republic of Indonesia for Air Services signed at Tokyo on January 23, 1962, as amended in 1965, 1970, 1987 and 1990 (hereinafter referred to as the "Agreement").

　本使は、前記の協議において到達した合意に従い、協定の付表が次のとおり修正されるべきことを日本国政府に代わって提案する光栄を有します。

　Pursuant to the agreement reached at the said consultations, I now have the honour to propose, on behalf of the Government of Japan, that the Schedule to the Agreement be amended as follows:

SCHEDULE

1　日本国の指定航空企業が両方向に運営する路線

1. Routes to be operated in both directions by the designated airline of Japan.

(a)　日本国内の地点―台北―香港―マニラ―ホーチミン･シティ及び(又は)バンコック―クアラ･ランプール―シンガポール―ジャカルタ及び(又は)デンパサール(注1、注2及び注3)―ダーウィン又はパース―シドニー又はメルボルン―ニュー･ジーランド―ニュー･カレドニア、フィジー、サモア、ソサイエティ諸島及び(又は)南太平洋におけるその他の諸島―ホノルル―アフリカ及び(又は)中東内の二地点

(a) Points in Japan - Taibei - Hong Kong - Manila - Ho Chi Minh City and/or Bangkok - Kuala Lumpur - Singapore - Jakarta and/or Denpasar (Notes 1, 2 and 3) - Darwin or Perth - Sydney or Melbourne - New Zealand - New Caledonia, Fiji, Samoa, Society Islands and/or other islands in the South Pacific - Honolulu - two points in Africa and/or the Middle East.

(b)　日本国内の地点―インドネシア内のジャカルタ及びデンパサール以外の二地点(注4)

(b) Points in Japan - two points in Indonesia other than Jakarta and Denpasar (Note 4).

注1　日本国の指定航空企業は、デンパサール及びジャカルタをコターミナルとして、ジャカルタの直前及び(又は)直後にデンパサールを経由する協定業務を行うことができる。

Note 1: The designated airline of Japan may operate the agreed services through Denpasar immediately before and/or after Jakarta, by using Denpasar and Jakarta as co-terminals.

注2　日本国の指定航空企業は、デンパサール以遠において第五の自由の運輸権を行使することができない。

Note 2: The designated airline of Japan may not exercise fifth freedom traffic rights beyond Denpasar.

注3　日本国の指定航空企業は、千九百九十四年四月一日から、ジヤカルタとデンパサールとの間においては、自己が運送する途中降機の旅客について運輸権を行使することができる。

Note 3: The designated airline of Japan shall be allowed to exercise traffic rights for its own stopover passengers between Jakarta and Denpasar from April 1, 1994.

注4　路線(b)では、日本国の指定航空企業は、関西国際空港が供用を開始するまでの間、インドネシア内のジャカルタ及びデンパサール以外の一地点のみへの業務を行うことができる。

Note 4: On Route (b) the designated airline of Japan may serve only one point in Indonesia other than Jakarta and Denpasar until the Kansai International Airport becomes operational.

2　インドネシア共和国の指定航空企業が両方向に運営する路線

2. Routes to be operated in both directions by the designated airline of the Republic of Indonesia.

(a)　インドネシア内の地点―シンガポール―クアラ･ランプール―バンコック―ホーチミン･シティ―マニラ―香港―台北―東京及び(又は)大阪(注1及び注2)―ソウル又はロス･アンジェルス

(a) Points in Indonesia - Singapore - Kuala Lumpur - Bangkok - Ho Chi Minh City - Manila - Hong Kong - Taibei - Tokyo and/or Osaka (Notes I and 2) - Seoul or Los Angeles.

(b)　インドネシア内の地点―福岡

(b) Points in Indonesia - Fukuoka.

(c)　インドネシア内の地点―名古屋(注3)

(c) Points in Indonesia - Nagoya (Note 3).

注1　インドネシア共和国の指定航空企業は、関西国際空港が開港したときは、大阪及び東京をコターミナルとして、東京の直前及び(又は)直後に大阪を経由する協定業務を行うことができる。それまでの間、インドネシア共和国の指定航空企業は、暫定的措置として、大阪に代えて福岡又は名古屋を経由する協定業務を行うことができる。

Note 1: The designated airline of the Republic of Indonesia may operate the agreed services through Osaka, when the Kansai International Airport becomes operational, immediately before and/or after Tokyo, by using Osaka and Tokyo as co-terminals. Until such time, the designated airline of the Republic of Indonesia may operate the agreed services through Fukuoka or Nagoya in place of Osaka on a temporary basis.

注2　インドネシア共和国の指定航空企業は、大阪(関西国際空港が開港するまでの間は福岡又は名古屋)以遠において第五の自由の運輸権を行使することができない。

Note 2: The designated airline of the Republic of Indonesia may not exercise fifth freedom traffic rights beyond Osaka (Fukuoka or Nagoya until the Kansai International Airport becomes operational).

注3　インドネシア共和国の指定航空企業は、関西国際空港が供用を開始した後に、路線(c)において協定業務を行うことができる。

Note 3: The designated airline of the Republic of Indonesia may operate the agreed services on Route (c) after the Kansai International Airport becomes operational.

3　いずれか一方の締約国の指定航空企業が行う協定業務は、当該一方の締約国の領域内の一地点を起点としなければならないが、特定路線上の他の地点は、いずれかの又はすべての飛行に当たりその指定航空企業の選択によって省略することができる。

3. The agreed services provided by the designated airline of either Contracting Party shall begin at a point in the territory of that Contracting Party, but other points on the specified route may at the option of the designated airline be omitted on any or all flights.

　本使は、前記の提案がインドネシア共和国政府にとって受諾し得るものであるときは、この書簡及びその旨の貴官の返簡をこの問題に関する両国政府間の合意を構成するものとみなし、その合意が貴官の返簡の日付の日に効力を生ずることを提案する光栄を有します。

　If the foregoing proposal is acceptable to the Government of the Republic of Indonesia, I have further the honour to propose that this Note and Your Excellency's reply to that effect shall be regarded as constituting an agreement between the two Governments on this matter, which shall enter into force on the date of Your Excellency's reply.

　本使は、以上を申し進めるに際し、ここに重ねて貴官に向かって敬意を表します。

　書簡をもって啓上いたします。本官は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。

　Excellency,
I have the honour to acknowledge receipt of Your Excellency's Note of today's date, which reads as follows:

　本官は、更に、前記の提案が我が国政府にとって受諾し得るものであり、したがって、閣下の書簡及びこの返簡が両国政府間の合意を構成し、その合意がこの返簡の日付の日に効力を生ずることを閣下に通報する光栄を有します。

　I have further the honour to inform Your Excellency that the foregoing proposal is acceptable to my Government and that accordingly, Your Excellency's Note and this Note in reply shall constitute an agreement between the two Governments which enters into force on the date of this reply.

　本官は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。
