航空業務に関する日本国とドイツ連邦共和国との間の協定の路線表の修正に関する交換公文

(German Note)


　

　Tokyo, August 25, 1994


　書簡をもって啓上いたします。本官は、千九百六十一年一月十八日にボンで署名された航空業務に関するドイツ連邦共和国と日本国との間の協定(以下「協定」という。)第十二条の規定に従って千九百九十四年一月十一日から十三日までの間東京で行われた両締約国の航空当局の間の協議に言及する光栄を有します。

　Excellency,
I have the honour to refer to the consultations which were held in Tokyo from January 11 to 13, 1994, between the aeronautical authorities of both Contracting Parties in accordance with Article 12 of the Agreement between the Federal Republic of Germany and Japan for Air Services, signed at Bonn on January 18, 1961 (hereinafter referred to as the "Agreement").


　本官は、前記の協議において到達した合意に基づき、協定の現行の路線表が、次の新たな路線表に代わるベきことをドイツ連邦共和国政府に代わって提案する光栄を有します。

注(1)　ドイツ連邦共和国の一又は二以上の指定航空企業は、路線表I3の日本国内の一地点の直前及び(又は)直後の地点として路線表I3の日本国内の他の一地点を経由して運航することができる。

注(2)　日本国の一又は二以上の指定航空企業は、路線表II3のドイツ連邦共和国内の一地点の直前及び(又は)直後の地点として路線表II3のドイツ連邦共和国内の他の一地点を経由して運航することができる。


							

						

						

							

								
Note 2: The designated airline or airlines of Japan may operate through one point in the Federal Republic of Germany on Route II 3 as a point immediately before and/or immediately after another point in the Federal Republic of Germany on Route II 3.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
注(3)　ドイツ連邦共和国の一又は二以上の指定航空企業及び日本国の一又は二以上の指定航空企業は、関西国際空港が国際航空業務について開港された後、それぞれ路線表I3及びII3の大阪への業務を行うことができる。


							

						

						

							

								
Note 3: The designated airline or airlines of the Federal Republic of Germany and of Japan may serve Osaka on Routes I 3 and II 3 respectively only after the Kansai International Airport is opened to international air services.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
注(4)　ドイツ連邦共和国の一又は二以上の指定航空企業は、路線表I4の後に特定される中国以外のアジア内の一地点と名古屋との間又は後に合意される中国内の一地点と名古屋との間においていかなる第五の運輸権(途中降機の運輸権を含む。)も行使してはならない。


							

						

						

							

								
Note 4: The designated air or airlines of the Federal Republic of Germany may not exercise any fifth freedom traffic rights (including stopover traffic rights) on Routes I 4between one point in Asia other than China to be specified later and Nagoya or between one point in China to be agreed upon later and Nagoya.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
注(5)　日本国の一又は二以上の指定航空企業は、路線表II4の後に特定される中国以外のアジア内の一地点とフランクフルト･アム･マインとの間又は後に合意される中国内の一地点とフランクフルト･アム･マインとの間においていかなる第五の運輸権(途中降機の運輸権を含む。)も行使してはならない。


							

						

						

							

								
Note 5: The designated airline or airlines of Japan may not exercise any fifth freedom traffic rights (including stopover traffic rights) on Route II 4 between one point in Asia other than China to be specified later and Frankfurt am Main or between one point in China to be agreed upon later and Frankfurt am Main.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
　本官は、前記の提案が日本国政府にとって受諾し得るものであるときは、この書簡及びこれに対する閣下の返簡を協定第二条(2)の規定に基づくドイツ連邦共和国政府と日本国政府との間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずることを提案いたします。


							

						

						

							

								
　If the foregoing is acceptable to the Government of Japan, it is suggested that this Note and Your Excellency's reply thereto shall be regarded as constituting an agreement between the Governments of the Federal Republic of Germany and of Japan pursuant to the provisions of Article 2(2) of the Agreement, which will enter into force on the date of your Excellency's reply,

　本大臣は、日本国政府が貴官の書簡に含まれた提案を受諾することを日本国政府に代わって貴官に通報するとともに、貴官の書簡及びこの返簡を協定第二条(2)の規定に基づく両国政府間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずることを確認する光栄を有します。
