赤外線宇宙天文台衛星計画に係る協力に関する日本国政府と欧州宇宙機関との間の交換公文

Paris, September 21, 1994
書簡をもって啓上いたします。本官は、赤外線宇宙天文台衛星計画に係る欧州宇宙機関(以下「ESA」という。)と日本国文部省(以下「文部省」という。)との間の協力(以下「協力」という。)を行うための条件に関しESAの代表者と日本国政府の代表者との間で行われた最近の討議に言及する光栄を有します。
Excellency, I have the honour to refer to recent discussions between the representatives of the European Space Agency and of the Government of Japan concerning the terms and conditions whereby cooperation on the Infrared Space observatory Satellite Program (hereinafter referred to as "Cooperation") will be undertaken between the European space Agency (hereinafter referred to as "ESA") and the Monbusho of Japan (hereinafter referred to as "Monbusho").
本官は、更に、宇宙空間の平和的な探査及び利用の分野においてESAと日本国政府(以下「両締約者」と総称する。)との間に引き続いて存在する相互に有益な関係を考慮し、ESAに代わって次の取極を提案する光栄を有します。
In consideration of the continuing mutually beneficial relationship between ESA and the Government of Japan (hereinafter jointly referred to as "the Parties") in the field of peaceful exploration and use of outer space, I have further the honour to propose on behalf of ESA the following arrangements:
1 協力は、一方においてESAと他方において文部省により指定された実施機関である宇宙科学研究所(以下「宇宙研」という。)との間で実施される。
1. Cooperation will be executed by ESA, on the one hand, and by the Institute of Space and Astronautical Science (hereinafter referred to as "ISAS") as the executing agency designated by Monbusho, on the other hand.
2 協力の詳細な条件を定めるため、ESA及び宇宙研は実施取決めを締結することとし、当該実施取決めは、赤外線宇宙天文台を用いた観測活動及びこれにより収集されたデータの処理について定める。
2. With a view to setting forth detailed terms and conditions for Cooperation, ESA and ISAS will conclude implementing arrangements, which will provide for the conduct of observations with the Infrared Space Observatory and processing of data thereby gathered.
3 協力は、利用可能な予算並びにESAについて及び日本国において適用可能な法令に従うことを条件とする。
3. Cooperation will be subject to the availability of appropriated funds and to the laws and regulations applicable to ESA and in Japan.
4 ESA及び宇宙研は、協力から又はそれに関連して生ずるいかなる問題についても協議する。問題が当該協議を通じて解決できない場合には、両締約者の間の協議が行われる。問題が前記の協議を通じて解決できない場合には、両締約者は、合意された紛争解決手続、例えば、調停、仲介又は仲裁に当該問題を付することができる。
4. ESA and ISAS will consult with each other in respect of any matter that may arise from or in connection with Cooperation. If the matter cannot be resolved through such consultation, consultations will be held between the Parties. If the matter cannot be resolved through consultations mentioned above, the parties may submit that issue to an agreed form of dispute resolution such as conciliation, mediation or arbitration.
5 この取極は、一方の締約者が他方の締約者に対してこの取極を終了させる意思を六箇月前に書面で通告することにより終了させない限り、五年間効力を有する。この取極は、両締約者の間の相互の合意により延長又は改正することができる。
5. The present arrangements will remain in force for five years, unless terminated by either Party upon six months' written notice of its intention to terminate them. These arrangements may be extended or amended by mutual agreement of the Parties.
本官は、この書簡及び前記の取極を日本国政府に代わって確認される閣下の書簡がESAと日本国政府との間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency's Note in reply confirming on behalf of the Government of Japan the foregoing arrangements shall be regarded as constituting an agreement between ESA and the Government of Japan, which will enter into force on the date of Your Excellency's reply.
本官は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。

本使は、更に、日本国政府に代わって前記の取極を確認するとともに、貴官の書簡及びこの返簡が日本国政府とESAとの間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずることに同意する光栄を有します。
I have further the honour to confirm on behalf of the Government of Japan the foregoing arrangements and to agree that your Note and this Note in reply shall be regarded as constituting an agreement between the Government of Japan and the European Space Agency, which will enter into force on the date of this reply.
本使は、以上を申し進めるに際し、ここに貴官に向かって敬意を表します。
