　Washington, February 4, 1994

　書簡をもって啓上いたします。本長官は、スペース･フライヤー･ユニット(SFU)計画に係るアメリカ合衆国航空宇宙局(以下「NASA」という。)と日本国文部省(以下「文部省」という。)との間の協力(以下「協力」という。)を行うための条件に関しアメリカ合衆国政府の代表者と日本国政府の代表者との間で行われた最近の討議に言及する光栄を有します。

　Excellency,
I have the honor to refer to the recent discussions between the representatives of the Government of the United States of America and of the Government of Japan concerning the terms and conditions whereby collaboration in the Space Flyer Unit (SFU) program (hereinafter referred to as "the collaboration") will be undertaken between the National Aeronautics and Space Administration of the United States of America (hereinafter referred to as "NASA") and the Monbusho of Japan (hereinafter referred to as "Monbusho").

　本長官は、更に、宇宙空間の平和的な探査及び利用の分野において両政府の間に引き続いて存在する相互に有益な関係を考慮し、また、千九百八十八年六月二十日に署名され、延長された科学技術における研究開発のための協力に関する日本国政府とアメリカ合衆国政府との間の協定を考慮してアメリカ合衆国政府に代わって以下を提案する光栄を有します。

　In consideration of the continuing mutually beneficial relationship between the two Governments in the field of peaceful exploration and use of outer space, and taking into account the Agreement between the Government of the United States of America and the Government of Japan on Cooperation in Research and Development in Science and Technology signed on June 20, 1988, as extended, I have further the honor to propose on behalf of the Government of the United States of America the following:

1　協力は、各政府の実施機関により行われる。実施機関は、アメリカ合衆国政府においてはNASA、日本国政府においては文部省宇宙科学研究所(以下「宇宙研」という。)とする。

1. The collaboration will be conducted through an executing agency of each Government, which on the part of the Government of the United States of America will be NASA and on the part of the Government of Japan will be the Institute of Space and Astronautical Science (hereinafter referred to as "ISAS") of Monbusho.

2　協力の詳細な条件を定めるため、NASA及び宇宙研は、スペース･フライヤー･ユニット衛星の地球周回軌道からの回収その他の実費弁済の活動及び協力活動について規定する実施取決めを締結する。当該実施取決めは、この合意により規律される。当該実施取決めに基づく活動は、各国の関係法令に従って実施される。

2. With a view to setting forth detailed terms and conditions for the collaboration, NASA and ISAS will conclude implementing arrangements, which will be subject to this agreement, providing for the retrieval from Earth orbit of the Space Flyer Unit spacecraft and other reimbursable and cooperative activities. Implementation of activities undertaken pursuant to such implementing arrangements will be in accordance with the applicable laws and regulations of each country.

3　協力のための活動は、各国の利用可能な予算の範囲内で行われる。実施取決めは、その規定に従って完全に実施される。

3. Activities for the collaboration will be undertaken subject to the availability of appropriated funds. The implementing arrangements will be fully implemented in accordance with their terms.

4　実施取決めには、当該実施取決めの解釈又は適用に関する紛争を解決するための協議手続及び連絡経路を定めることができる。

4. Consultative procedures and communication channels may be set forth in the implementing arrangements for resolving any dispute concerning the interpretation or application of those implementing arrangements.

5　この合意は、一方の政府が他方の政府に対して六箇月前に外交上の経路を通じて書面で通告することにより終了させない限り、五年間効力を有する。この合意は、両政府間の相互の合意により延長又は改正することができる。

5. This agreement will remain in force for a period of five years, unless terminated by either Government on six months' written notice through diplomatic channels. It may be extended or amended by mutual written agreement of the two Governments.

　本長官は、前記のことが日本国政府にとって受諾し得るものであるときは、この書簡及び閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力が生ずるものとすることを提案する光栄を有します。

　I have further the honor to propose that, if the foregoing is acceptable to the Government of Japan, this Note and Your Excellency's Note in reply shall constitute an agreement between the two Governments, which will enter into force on the date of Your Excellency's reply.

　本長官は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。

I have the honor to acknowledge the receipt of Your Excellency's Note of today's date which reads as follows:

　本使は、更に、前記のことが日本国政府にとって受諾し得るものであることを日本国政府に代わって確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成し、その合意がこの返簡の日付の日に効力を生ずるものとすることに同意する光栄を有します。

　I have further the honor to confirm on behalf of the Government of Japan that the foregoing is acceptable to the Government of Japan and to agree that Your Excellency's Note and this Note in reply shall constitute an agreement between the two Governments, which will enter into force on the date of this reply.

　本使は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。
