航空業務に関する日本国とトルコ共和国との間の協定の付表の修正に関する交換公文

(Turkish Note)


　

　Tokyo, July 5, 1994


　書簡をもって啓上いたします。本使は、千九百八十九年三月八日に東京で署名された航空業務に関するトルコ共和国と日本国との間の協定(以下「協定」という。)の第十四条及び第十六条の規定に従って千九百九十三年三月三日及び四日にアンカラにおいて行われたトルコ共和国及び日本国の航空当局の間の協議に関し、前記の協議の結果、トルコ共和国及び日本国の航空当局が協定の付表を別添のとおり修正することにつき合意したことを述べる光栄を有します。

　Excellency,
With reference to the consultations held in Ankara on 3rd and 4th March 1993 between the aeronautical authorities of the Republic of Turkey and of Japan, in accordance with Articles 14 and 16 of the Agreement between the Republic of Turkey and Japan for Air Services, signed in Tokyo on 8th March 1989 (hereinafter referred to as the "Agreement"), I have the honour to state that, as a result of the said consultations, the aeronautical authorities of the Republic of Turkey and of Japan agreed to amend the Schedule to the Agreement as set out in the Attachment.


　よって、本使は、更に、別添の新たな付表が協定の現行の付表に代わることをトルコ共和国政府に代わって提案する光栄を有します。

　Accordingly, I have further the honour to propose, on behalf of the Government of the Republic of Turkey, that the new Schedule as set out in the Attachment shall replace the existing Schedule to the Agreement.


　本使は、前記の提案が日本国政府にとって受諾し得るものであるときは、この書簡及びその旨の閣下の返簡をこの問題に関するトルコ共和国政府と日本国政府との間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずることを提案いたします。

　If the above proposal is acceptable to the Government of Japan, it is suggested that this Note and Your Excellency's reply to that effect shall be regarded as constituting an agreement between the Governments of the Republic of Turkey and of Japan on this matter, which shall enter into force on the date of Your Excellency's reply.


　本使は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。

SCHEDULE


1　日本国の一又は二以上の指定航空企業が両方向に運営する路線

1. Routes to be operated in both directions by the designated airline or airlines of Japan:


(a)　日本国内の地点─後に合意されるアジア内の一地点─中東内の一地点又はカラチ─イスタンブル─後に合意される以遠の二地点

(a) Points in Japan - one point in Asia to be agreed upon later - one point in the Middle East or Karachi - Istanbul - two points beyond to be agreed upon later


(b)　日本国内の地点─モスクワ─後に特定される一地点─イスタンブル─後に特定される以遠の二地点(アメリカ合衆国内の地点を除く。)

(b) Points in Japan - Moscow - one point to be specified later - Istanbul - two points beyond, excluding points in the United States of America, to be specified later


2　トルコ共和国の一又は二以上の指定航空企業が両方向に運営する路線

2. Routes to be operated in both directions by the designated airline or airlines of the Republic of Turkey:


(a)　トルコ内の地点─中東内の一地点又はカラチ─後に合意されるアジア内の一地点─東京─後に合意される以遠の二地点

(a) Points in Turkey - one point in the Middle East or Karachi - one point in Asia to be agreed upon later - Tokyo - two points beyond to be agreed upon later


(b)　トルコ内の地点─モスクワ─東京及び(又は)大阪(注)

(b) Points in Turkey - Moscow - Tokyo and/or Osaka (Note)


注　路線(b)では、トルコ共和国の一又は二以上の指定航空企業は、関西国際空港が国際航空業務について供用を開始した後に、大阪への業務を行うことができる。東京に寄港する便で大阪に寄港してはならない。

Note: On Route (b), the designated airline or airlines of the Republic of Turkey may serve Osaka only after the Kansai International Airport is opened to international air services. Osaka shall not be served on the same flight with Tokyo.


3　いずれの締約国の一又は二以上の指定航空企業が提供する協定業務も、当該締約国の領域内の一地点をその起点としなければならないが、特定路線上の他の地点は、いずれかの又はすべての飛行に当たり当該指定航空企業の選択によって省略することができる。

3. The agreed services provided by the designated airline or airlines of either Contracting Party shall begin at a point in the territory of that Contracting Party, but other points on the specified routes may at the option of the designated airline be omitted on any or all flights.

　書簡をもって啓上いたします。本大臣は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。

　Excellency,
I have the honour to acknowledge the receipt of Your Excellency's Note of today's date which reads as follows:

　本大臣は、更に、日本国政府がトルコ共和国政府の前記の提案を受諾する旨を日本国政府に代わって閣下に通報するとともに、閣下の書簡及びこの返簡をこの問題に関する両国政府間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずることを確認する光栄を有します。

　I have further the honour to inform Your Excellency, on behalf of the Government of Japan, that the Government of Japan accepts the above proposal of the Government of the Republic of Turkey and to confirm that Your Excellency's Note and this reply shall be regarded as constituting an agreement between the two Governments on this matter, which shall enter into force on the date of this reply.
