(Japanese Note)


　

　Colombo, March 18, 1994


　書簡をもって啓上いたします。　本官は、干九百八十四年二月二十二日にコロンボで署名された航空業務に関する日本国政府とスリ･ランカ民主社会主義共和国政府との間の協定(以下「協定」という。)第十六条の規定に従って千九百九十三年六月二十九日から三十日までの間東京において行われた日本国及びスリ･ランカ民主社会主義共和国の航空当局の間の協議に関し、前記の協議の結果、日本国及びスリ･ランカ民主社会主義共和国の航空当局が協定の付表を別添のとおり修正することにつき合意したことを述べる光栄を有します。

　Sir,
With reference to the consultations held in Tokyo from 29th to 30th June 1993 between the aeronautical authorities of Japan and the Democratic Socialist Republic of Sri Lanka, in accordance with Article 16 of the Agreement between the Government of Japan and the Government of the Democratic Socialist Republic of Sri Lanka for Air Services, signed at Colombo on 22nd February 1984 (hereinafter referred to as the "Agreement"), I have the honour to state that, as a result of the said consultations, the aeronautical authorities of Japan and the Democratic Socialist Republic of Sri Lanka agreed to amend the Schedule to the Agreement as set out in the Attachment.


　よって、本官は、別添の新たな付表が千九百九十二年六月三十日に修正された現行の付表に代わることを日本国政府に代わって提案する光栄を有します。

　Accordingly, I have the honour to propose, on behalf of the Government of Japan, that the new Schedule as set out in the Attachment shall replace the existing Schedule amended on 30th June 1992.


　本官は、前記の提案がスリ･ランカ民主社会主義共和国政府にとって受諾し得るものであるときは、この書簡及びその旨の貴官の返簡をこの問題に関する日本国政府とスリ･ランカ民主社会主義共和国政府との間の合意を構成するものとみなし、その合意が貴官の返簡の日付の日に効力を生ずることを提案いたします。

　If the above proposal is acceptable to the Government of the Democratic Socialist Republic of Sri Lanka, it is suggested that this Note and your reply to that effect shall be regarded as constituting an agreement between the Governments of Japan and the Democratic Socialist Republic of Sri Lanka on this matter, which shall enter into force on the date of your reply.

Schedule


1　日本国の一又は二以上の指定航空企業が両方向に運営する路線

1. Routes to be operated in both directions by the designated airline or airlines of Japan:


　日本国内の地点―後に特定される中間の三地点(注1、注4)―コロンボ―後に特定される以遠の三地点(注2、注3、注4)

　Points in Japan - three intermediate points to be specified later (Note 1, Note 4) - Colombo - three points beyond to be specified later (Note 2, Note 3, Note 4)


注1　日本国は、中間の三地点を自国の選択により特定することができる。

Note 1: Japan can specify at its option any three intermediate points.


注2　日本国は、コロンボ以遠の三地点を自国の選択により特定することができる。　ただし、オマーン、カタル、バハレーン、クウェイト、サウデイ･アラビア、シヤルジャ及びレバノン内の地点、フランクフルト･アム･マイン並びにロンドンを除く。

Note 2: Japan can specify at its option any three points beyond Colombo other than points in Oman, Qatar, Bahrain, Kuwait, Saudi Arabia, Sharjah, Lebanon and Frankfurt am Main and London.


注3　日本国の一又は二以上の指定航空企業は、コロンボ以遠の三地点に加え、日本国の選択により後に特定されるコロンボ以遠の二地点にも運航することができる。ただし、コロンボとこれらの追加された二地点との間の区間については、運輸権を行使しない。

Note 3: The designated airline or airlines of Japan can operate to any two points beyond Colombo to be specified later at the option of Japan in addition to the three points beyond Colombo, provided that no traffic right shall be exercised between Colombo and these two additional points.


注4　一度特定された地点は、別段の合意がない限り変更しない。

Note 4: The points once specified shall not be changed unless otherwise mutually agreed upon.


2　スリ･ランカ民主社会主義共和国の一又は二以上の指定航空企業が両方向に運営する路線

2. Routes to be operated in both directions by the designated airline or airlines of the Democratic Socialist Republic of Sri Lanka:


(a)　スリ･ランカ民主社会主義共和国内の地点―香港、シンガポール、クアラ･ランプール(注1)―東京(注2)

(a) Points in the Democratic Socialist Republic of Sri Lanka - Hong Kong, Singapore, Kuala Lumpur (Note 1) - Tokyo (Note 2)


(b)　スリ･ランカ民主社会主義共和国内の地点―福岡及び(又は)東京

(b) Points in the Democratic Socialist Republic of Sri Lanka - Fukuoka and/or Tokyo


(c)　スリ･ランカ民主社会主義共和国内の地点―福岡及び(又は)大阪(注3)

(c) points in the Democratic Socialist Republic of Sri Lanka - Fukuoka and/or Osaka (Note 3)


注1　路線(a)については、スリ･ランカ民主社会主義共和国の一又は二以上の指定航空企業は、一の運航期間につき、中間の三地点のうち二地点のみを使用することができる。

Note 1: In respect of route (a), the designated airline or airlines of the Democratic Socialist Republic of Sri Lanka can use only two of the three intermediate points during any one given operational period.


注2　路線(a)については、関西国際空港が供用を開始するまでの間、スリ･ランカ民主社会主義共和国の一又は二以上の指定航空企業は、暫定的措置として、東京又は福岡への業務を行うことができる。

Note 2: In respect of route (a), pending the opening of the Kansai International Airport, the designated airline or airlines of the Democratic Socialist Republic of Sri Lanka may serve Tokyo or Fukuoka on provisional basis.


注3　路線(c)については、スリ･ランカ民主社会主義共和国の一又は二以上の指定航空企業は、関西国際空港が国際航空業務について供用を開始した後に、福岡及び(又は)大阪への業務を行うことができる。

Note 3: In respect of route (c), the designated airline or airlines of the Democratic Socialist Republic of Sri Lanka may serve Fukuoka and/or Osaka only after the Kansai International Airport is opened to international air services.


3　いずれの締約国の一又は二以上の指定航空企業が提供する協定業務も、当該締約国の領域内の一地点をその起点としなければならないが、特定路線上の他の地点は、いずれかの又はすべての飛行に当たり当該指定航空企業の選択によって省略することができる。

3. The agreed services provided by the designated airline or airlines of either Contracting Party shall begin at a point in the territory of that Contracting Party, but other points on the route may at the option of the designated airline or airlines be omitted on any or all flights.

　書簡をもって啓上いたします。本官は、本日付けの貴官の次の書簡を受領したことを確認する光栄を有します。

　Sir,
I have the honour to acknowledge receipt of your Note of today's date which reads as follows:

　本官は、スリ･ランカ民主社会主義共和国政府が日本国政府の前記の提案を受諾する旨を貴官に通報するとともに、貴官の書簡及びこの返簡がこの問題に関する両国政府間の合意を構成するものとみなし、その合意が本日効力を生ずることを確認する光栄を有します。

　I have the honour to inform you that the Government of the Democratic Socialist Republic of Sri Lanka accepts the above proposal of the Government of Japan and to confirm that your Note and this reply shall be regarded as constituting an agreement between the two Governments on this matter, which shall enter into force on the date of this reply.


　本官は、以上を申し進めるに際し、ここに貴官に向かって敬意を表します。
