SUBSIDIARY AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF AUSTRALIA CONCERNING JAPANESE TUNA LONG-LINE FISHING(NO1)
日本国政府及びオーストラリア政府は、
THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF AUSTRALIA,
千九百七十九年十月十七日にキャンベラで署名された漁業に関する日本国政府とオーストラリア政府との間の協定一以下「新協定」という.一第二条2の規定に基づき、
Pursuant to the provisions of paragraph 2 of Article 11 of the Agreement on Fisheries between the Government of Japan and the Government of Australia, signed at Canberra on the seventeenth day of October, 1979 (hereinafter referred to as "the Head Agreement"), and
オーストラリアの漁業水域(以下「漁業水域」という。)における日本国の漁船(以下「漁船」という。)によるまぐろはえなわ漁業の操業の実施のため及びオーストラリア政府による許可証の発給のための細目手続を定めることを希望して、
Wishing to establish the detailed procedures for the conduct of tuna long-line fishing operations by fishing vessels of Japan (hereinafter referred to as "the vessels" ) within the Australian fishing zone (hereinafter referred to as "the Zone") and for the issuance of licences by the Government of Australia,
次のとおり協定した。
Have agreed as follows:
第一条 オーストラリア政府は、親協定の規定に従い.許可されるすべての漁船につき、かつ、この補足協定の有効期間につき、四百二十二万五千オーストラリア・ドルの料金がオーストラリア政府に支払われることを条件として、漁船(ただし、その隻数は、二百五十隻を超えないものとする。)に許可証を発給する。当該料金は、次の額から成る。
ARTICLE I The Government of Australia shall, in accordance with the provisions of the Head Agreement, issue licences for the vessels, the number of which shall not exceed 250, subject to payment to the Government of Australia of a fee of four million two hundred and twenty five thousand Australian dollars for all the vessels to be licensed and for the period of validity of this Subsidiary Agreement. This fee consists of the following amounts:
(a) この補足協定の不可分の一部を成すこの補足協定の附属書Iに定める東岸水域につき二百七十万オーストラリア・ドル
(a) two million seven hundred thousand Australian dollars for the East Coast Area specified in Appendix I to this Subsidiary Agreement, which forms an integral part hereof,
(b) この補足協定の附属書1に定める西岸水域につき二十七万五千オーストラリア・ドル
(b) two hundred and seventy five thousand Australian dollars for the West Coast Area specified in Appendix I to this Subsidiary Agreement; and
(c) この補足協定の附属書1に定めるタスマニア沖水域につき百二十五万オーストラリア・ドル
(c) one million two hundred and fifty thousand Australian dollars for the Area off Tasmania specified in Appendix I to this Subsidiary Agreement.
第二条 オーストラリア政府は、前条にいう漁船に発給される許可証により、当該漁船に対し、すべての種類のまぐろ及びめかじき並びに混獲されるその他のすべてのひれを有する魚類(かじき及び海洋性さめ類を含む。)を漁業水域において次の漁法により採捕することを許可する。
ARTICLE II The Government of Australia shall, by the licences issued for the vessels referred to in Article I of this Subsidiary Agreement, permit those vessels to take within the Zone all species of tuna and broadbill swordfish, together with all other species of finfish including billfish and oceanic sharks which are incidentally caught:
(a) うきはえなわ漁法(ただし、この補足協定の不可分の一部を成すこの補足協定の附属書IIに定める区域を除く。)
(a) by the use of floating long-lines, except in the areas specified in the Appendix II to this Subsidiary Agreement, which forms an integral part hereof; and
(b) 手づり漁法(ただし、北は南緯十二度の緯度線、南は南緯二十二度二十一分三十秒の緯度線及び西はこの補足協定の附属書IIのBに定める線で囲まれるさんご海の区域に限る。)
(b) by the use of hand-lines, in the area of the Coral Sea bounded to the north by the parallel of Latitude 12* South. to the south by the parallel of Latitude 22*21'30" South and to the west by the line described in paragraph B of the Appendix II to this Subsidiary Agreement.
第三条 日本国政府及びオーストラリア政府は、漁船が前条の規定に従って漁業水域の一区域において魚類の採捕を行うことが許可されていないときに当該区域に当該漁船のはえなわの一部が流れ込むことを防止し得ないことがあり得ることを認める.はえなわの一部が当該区域に流れ込むことを合理的に避けられなかったことがオーストラリア政府によって確認された場合には、このような事例は、この補足協定の違反とはみなされない。
ARTICLE III The Government of Japan and the Government of Australia recognise that it might not be possible for a vessel to prevent parts of its long-line from drifting into an area of the Zone at the time when that vessel is not permitted to take fish in that area in accordance with the provisions of Article II of this Subsidiary Agreement. Cases verified by the Government of Australia as cases in which the drifting of a part of a long-line into such an area cannot reasonably be avoided shall not be regarded as infringements of this Subsidiary Agreement.
第四条 1 オーストラリア政府は、オーストラリアの関係法令に従うことを条件として、この補足協定に基づいて許可された漁船がブリスベン、シドニー、ホバート、フリーマントル、オールバニー、ケアンズ、ボート・リンカーン及びポート・ヘッドランドの各港に入港することを許可することを約束する。
ARTICLE IV 1. The Government of Australia, subject to the relevant laws and regulations of Australia, undertakes to permit the vessels licensed under this Subsidiary Agreement to enter the ports of Brisbane, Sydney, Hobart, Fremantle, Albany, Cairns , Port Lincoln and Port Hedland.
2 オーストラリア政府は、これらの港への漁船の入港に関する手続を十分な時間的余裕をもって日本国政府に通報する。
2. The Government of Australia shall give due notice to the Government of Japan of the procedures relating to the entry of the vessels into those ports.
第五条 1 オーストラリア政府は、オーストラリアの関係法令に従い、この補足協定に基づいて許可された漁船の船長に対し許可証を発給する。
ARTICLE V 1. The Government of Australia shall, in accordance with the relevant laws and regulations of Australia, issue a licence to the master of any vessel licensed under this Subsidiary Agreement.
2 この補足協定に基づいて許可された漁船の船長に対する許可証の申請がオーストラリアの権限のある当局により受理された場合には、オーストラリア政府は、許可証が当該者に渡されるための正当な手続が完了するまで、その者が許可証を携帯し又は提示することを要請しない。
2. If an application for a licence for a master of any 2. vessel licensed under this Subsidiary Agreement has been accepted by the competent Australian authorities, the Government of Australia shall not require that person to have in his possession, or to produce, the licence until due procedures have been completed for passing the licence to that person.
第六条 1 オーストラリア政府は、両政府間の協議の後に次の事項に関する方法及び条件を決定する。
ARTICLE VI 1. The Government of Australia shall determine, after consultation between the two Governments, the methods of and the terms and conditions with respect to:
(a) 漁船及び船長に関する許可証の申請及び発給
(a) applying for and issuing licences in respect of the vessels and masters,
(b) 漁船に関する漁獲量及び漁獲努力量についての資料の準備及び報告
(b) preparing and reporting of catch and effort data in respect of the vessels: and
(c) 漁船とオーストラリアの権限のある当局との間の通信
(c) communicating between the vessels and the competent Australian authorities.
2 オーストラリア政府は、1に基づく決定を日本国政府に対して妥当な期間内に通報する。
2. The Government of Australia shall notify the Government of Japan of determinations under paragraph I of this Article within a reasonable time.
第七条 日本国政府は、日本国の関係法令に従い、漁業水域における漁船の操業に関し入手可能な最近の経済及び市場の情報をオーストラリア政府に提供する。
ARTICLE VII The Government of Japan shall, in accordance with the relevant laws and regulations of Japan, provide the Government of Australia with available current economic and marketing information relevant to the operations of the vessels within the Zone.
第八条 1 日本国政府及びオーストラリア政府は、親協定の第九条の規定に従い、次の事項を目的としてこの補足協定が終了する三箇月前までにキャンベラにおいて協議する.
ARTICLE VIII 1. The Government of Japan and the Government of Australia shall, in accordance with the provisions of Article IX of the Head Agreement. consult in Canberra not later than three months before the expiry of this Subsidiary Agreement for the purposes of:
(a) この補足協定に基づく漁船の操業(いずれか一方の政府によって確認されたいかなる問題も含む。)を再検討すること。
(a) reviewing the operations of the vessels under this Subsidiary Agreement including any problems identified by either Government; and
(b) 次の一年間のために補足協定が締結されるに当たっての条件について討議すること。
(b) discussing the terms and conditions under which a subsidiary agreement might be concluded for the following period of one year.
2 いずれか一方の政府の要請があったときは、この補足協定の実施に関するいかなる問題についてもこの補足協定の有効期間中いつでも協議を行う。
2. Upon request by either Government, consultations shall be undertaken at any time during the period of validity of this Subsidiary Agreement on any aspect of the implementation of this Subsidiary Agreement.
第九条 この補足協定は、署名により効力を生じ、千九百九十五年十月三十一日まで効力を有する。
ARTICLE IX This Subsidiary Agreement shall enter into force on signature and shall remain in force until 31 October, 1995.
以上の証拠として、下名は、各自の政府から正当に委任を受けてこの補足協定に旧名した。
IN WITNESS WHEREOF, the undersigned being duly authorised by their respective Governments, have signed this Subsidiary Agreement.

附属書I 補足協定第一条の適用上、次に定義される「東岸水域」、「西岸水域」及び「タスマニア沖水域」は、補足協定の附属書IIのA、B、D及びEに定める水域を含まないものとする。
APPENDIX I For the purposes of Article I of this Subsidiary Agreement, the terms "East Coast Area" "West Coast Area" and "Area off Tasmania" defined below shall not include the areas specified in paragraphs A, B, D and E of Appendix II to this Subsidiary Agreement.
A 東岸水域
A. East Coast Area
東経百四十一度の子午線の東側で、かつ、南緯三十四度の緯度線の北側の漁業水域(ロード･ハウ島沖の漁業水域であって南緯三十四度の緯度線の南側の水域及びノーフォーク島周辺の漁業水域を含む。)
That portion of the Zone lying to the east of the meridian of Longitude 141' East and to the north of the parallel of Latitude 34 South, including that portion of the Zone off Lord Howe Island lying to the south of the parallel of Latitude 34 South, and that portion of the Zone around Norfolk Island.
B 西岸水域
B. West Coast Area
東経百二十九度の子午線の西側で、かつ、南緯三十四度の緯度線の北側の漁業水域(クリスマス島周辺及びココス･キーリング島周辺の漁業水域を含む。)
That portion of the Zone lying to the west of the meridian of Longitude 129 East and to the north of the parallel of Latitude 34 South, including those portions of the Zone around Christmas Island and around Cocos Keeling Islands.
C タスマニア沖水域
C. Area off Tasmania
次の線の南側の漁業水域
That portion of the Zone south of the line:
(1) 南緯三十九度の緯度線とオーストラリアの東岸沖の漁業水域の外縁との交点から始まり、
(I) commencing at the point of intersection of the parallel of Latitude 39' South with the outer limit of the Zone off the east coast of Australia;
(2) 次いで正面へ(1)にいう緯度線に沿ってその線と東経百五十一度の子午線との交点に至り、
(2) thence running west along that parallel to its intersection by the meridian of Longitude 151' East;
(3) 次いで正南へ(2)にいう子午線に沿ってその線と南緯四十度の緯度線との交点に至り、
(3) thence south along that meridian to its intersection by the parallel of Latitude 40' South;
(4) 次いで正面へ(3)にいう緯度線に沿ってその線と東経百四十度の子午線との交点に至り、
(4) thence west along that parallel to its intersection with the meridian of Longitude 140' East; and
(5) 次いで正南へ(4)にいう子午線に沿ってその線と漁業水域の外縁との交点に至る線
(5) thence south along that meridian to its intersection by the outer limit of the Zone.
附属書II A 周年において、漁業水域のうちこの附属書のB、C、D及びEに掲げる区域以外であって領海の幅が測定される基線から海側に十二海里内の区域
APPENDIX II A. At all times, the areas of the Zone, other than the areas described in paragraph B, paragraph C, paragraph D and paragraph E of this Appendix, within 12 nautical miles seaward of the baselines from which the breadth of the territorial sea is measured.

(17) 次いで概ね北西、北辰ひ北東へ(16)にいう五十海里線に沿ってその線と東経百二十九度の子午線との交点に至り、

D 周年において、その線上のいずれの点をとってもノーフォーク島領土の低潮線の最も近い点から海側に三十五海里となる線内の区域
D. At all times, the area within the line every point of which is 35 nautical miles seaward from the nearest point of the low-water lines of the Territory of Norfolk Island.
E 周年において、千九百七十五年の連邦国立公園野生動植物保護法第七条第二項に基づく布告により宣言されたすべての区域(以下の区域を含む。)の境界の内側にある区域
E. At all times, within the boundaries of all areas declared by Proclamation pursuant to sub-section (2) of section 7 of the National Parks and Wildlife Conservation ct 1975 (Cathy) to be a national nature reserve, including he following:
(1) マーメイド･リーフ海洋国立自然保護区次の線で囲まれる区域
(1) MERMAID REEF MARINE NATIONAL NATURE RESERVE Being the area bounded by the line:
(a) 南緯十六度五十八分、東経百十九度三十二分の点から始まり、
(a) commencing at a point of Latitude 16'58', South, Longitude ll9'32' East;
(b) 次いで正策へ南緯十六度五十八分の緯度線に沿ってその線と東経百十九度四十一.分の子午線との交点に至り、
(b) running thence east along the parallel of Latitude 16'58' South to its intersection by the meridian of Longitude ll9'43', East;
(c) 次いで正南へ東経百十九度四十三分の子午線に沿ってその線と南緯十七度十三分の緯度線との交点に至り、
(c) thence south along the meridian of Longitude 119'43' East to its intersection by the parallel of Latitude 17'13' South;

(a) 南緯二十九度二十一分、東経百五十八度五十九分の点から始まり、
(a) commencing at the point of Latitude 29'21' South, Longitude 158'59' East;
(b) 次いで正東へ南緯二十九度二十一分の緯度線に沿ってその線と東経百五十九度十四分の子午線との交点に至り、
(b) running thence east along the parallel of Latitude 29'21' South to its intersection by the meridian of Longitude 159'14', East;
(c) 次いで南西へ測地線に沿って南緯三十度三分、東経百五十九度十分の点に至り、
(c) thence south-westerly along the geodesic to the point of Latitude 30'03' South, Longitude 159'10' East;
(d) 次いで正西へ南緯三十度三分の緯度線に沿ってその線と東経百五十八度五十五分の子午線との交点に至り、

(3) ASHMORE REEF NATIONAL NATURE RESERVE Being the area bounded by the line:

(a) commencing at the point of Latitude 12'10' South, Longitude 123'OO' East;
(b) 次いで江東へ南緯十二度十分の緯度線に沿ってその線と東経百二十三度十四分の子午線との交点に至り、
(b) running thence east along the parallel of 12'10' South to its intersection by the meridian of Longitude 123'14' East:
(c) 次いで南東へ測地線に沿って南緯十二度十三分、東経百二十三度十六分の点に至り、
(c) thence south-easterly along the geodesic to the point of Latitude 12'13' South, Longitude 123'16, East:
(d) 次いで江南へ東経百二十三度十六分の子午線に沿ってその線と南緯十二度十六分の緯度線との交点に至り、

(4) コリンガ･ヘラルド国立自然保護区次の線で囲まれる区域
(4) CORINGA-HERALD NATIONAL NATURE RESERVE Being the area bounded by the line:
(a) 南緯十七度十一分、東経百五十度五分の点から始まり、
(a) commencing at the point of Latitude 17'11' South, Longitude 150'05' East;
(b) 次いで正西へ南緯十七度十一分の緯度線に沿ってその線と東経百四十九度の子午線との交点に至り、
