科学用気球の共同打上げに係る協力に関する日本国政府とアメリカ合衆国政府との間の交換公文

　書簡をもって啓上いたします。本長官は、科学用気球の共同打上げに係るアメリカ合衆国航空宇宙局(以下「NASA」という。)と日本国文部省(以下「文部省」という。)との間の協力(以下「協力」という。)を行うための条件に関しアメリカ合衆国政府の代表者と日本国政府の代表者との間で行われた最近の討議に言及する光栄を有します。

　Excellency,I have the honour to refer to the recent discussions between the representatives of the Government of the United States of America and of the Government of Japan concerning the terms and conditions whereby cooperation in joint scientific balloon launchings (hereinafter referred to as "the Cooperation") will be undertaken between the National Aeronautics and Space Administration of the United States of America (hereinafter referred to as "NASA") and the Monbusho of Japan (hereinafter referred to as "Monbusho").

　本長官は、更に、宇宙空間の平和的な探査及び利用の分野において両政府の間に引き続いて存在する相互に有益な関係を考慮し、アメリカ合衆国政府に代わって次の取極を提案する光栄を有します。

　In consideration of the continuing mutually beneficial relationship between the two Governments in the field of peaceful exploration and use of outer space, I have further the honour to propose on behalf of the Government of the United States of America the following arrangements;

1　協力は、一方においてNASAと他方において文部省により指定された実施機関である宇宙科学研究所(以下「宇宙研」という。)との間で実施される。

1. The Cooperation will be executed by NASA, on the one hand, and by the Institute of Space and Astronautical Science (hereinafter referred to as "ISAS") as the executing agency designated by Monbusho, on the other hand.

2　協力の詳細な条件を定めるため、NASA及び宇宙研は実施取決めを行うこととし、当該実施取決めは、宇宙科学用気球及びその搭載物の開発、打上げ及び運用について定める。当該実施取決めがこの取極により規律されること、及び当該実施取決めが同取決めの規定に従ってNASA及び宇宙研に対して拘束力を有し得ることが確認される。

2. With a view to setting forth detailed terms and conditions for the Cooperation, NASA and ISAS will make implementing arrangements, which will provide for the development, launch, and operation of space science balloons and their payloads. It is confirmed that these implementing arrangements will be subject to the present arrangements and may be binding on NASA and ISAS in accordance with the terms of such implementing arrangements.

3　NASA及び宇宙研は、利用可能な予算に従って協力のための各々の活動を行う。実施取決めに従ってNASA及び宇宙研によって行われる活動の実施は、各国の適用可能な法令に従うことを条件とする。協力は、千九百八十八年六月二十日に署名された科学技術における研究開発のための協力に関する日本国政府とアメリカ合衆国政府との間の協定第一条に定める両政府間の全般的科学技術関係のための政策的枠組みの下で行われる。

3. NASA and ISAS will undertake their respective activities for the Cooperation subject to the availability of appropriated funds. The implementation of activities undertaken by NASA and ISAS pursuant to implementing arrangements will be subject to the applicable laws and regulations of each country. The Cooperation will take place under the policy framework for the overall science and technology relationship between the two Governments set forth in Article I of the Agreement between the Government of the United States of America and the Government of Japan on Cooperation in Research and Development in Science and Technology signed on June 20,1988.

4　NASA及び宇宙研は、協力から又はそれに関連して生ずるいかなる問題についても協議を行う。問題が当該協議を通じて解決できない場合には、外交上の経路を通じて両政府間の協議が行われる。

4. NASA and ISAS will consult with each other in respect of any matter that may arise from or in connection with the Cooperation. If the matter cannot be resolved through such consultations, consultations between the two Governments will be held through diplomatic channels.

5　この取極は、一方の政府が他方の政府に対してこの取極を終了させる意思を六箇月前に書面で通告することにより終了させない限り、三年間効力を有する。この取極は、両政府間の相互の合意により延長又は改正することができる。

5. The present arrangements will remain in force for three years, unless terminated by either Government upon six months' written notice of its intention to terminate them. These arrangements may be extended or amended by mutual agreement of the two Governments.

　本長官は、この書簡及び前記の取極を日本国政府に代わって確認される閣下の返簡が両政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。

　I have further the honour to propose that this Note and Your Excellency's Note in reply confirming on behalf of the Government of Japan the foregoing arrangements shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of Your Excellency's reply.

　本長官は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。

　本使は、更に、前記の取極を日本国政府に代わって確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずるものとすることに同意する光栄を有します。

　I have further the honour to confirm on behalf of the Government of Japan the foregoing arrangements and to agree that Your Excellency's Note and this Note shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of this reply.

　本使は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。
