　書簡をもって啓上いたします。本大臣は、千九百五十六年十二月十四日にリオ・デ・ジャネイロで署名され、千九百七十四年七月三十日に修正されたブラジルと日本国との間の航空運送協定(以下「協定」という。)の第八条の規定に従って千九百九十一年九月三日から九月四日までの間東京において行われたブラジルと日本国の航空当局の間の協議に言及する光栄を有します。

　Excellency,
I have the honour to refer to the consultations between the aeronautical authorities of Brazil and Japan held in Tokyo from September 3 to September 4, 1991, in accordance with Article VIII of the Air Transport Agreement between Brazil and Japan signed at Rio de Janeiro on December 14, 1956 and as modified on July 30, 1974 (hereinafter referred to as the "Agreement").

　本大臣は、前記の協議において到達した合意に従い、次の修正された付表が協定の附属書の付表に代わるべきことをブラジル連邦共和国政府に代わり提案する光栄を有します。

　Pursuant to an agreement reached at the said consultations, I have the honour to propose, on behalf of the Government of the Federative Republic of Brazil, that the Schedules of the Annex to the Agreement be replaced by the following revised Schedules:

付表第一

"SCHEDULE I

　日本国の一又は二以上の指定航空企業が運営する路線

　Routes to be operated by the designated airline or airlines of Japan:

I　両方向に、日本国内の地点－北太平洋における地点－カナダの西海岸における地点及び(又は)アメリカ合衆国の西海岸における地点－メキシコ・シティ又はハヴァナ－パナマ－ボゴタ及び(又は)カラカス－マナウス－ゴイアニア－リオ・デ・ジャネイロ及び(又は)サン・パウロ及び(又は)ブラジル内の一地点

　I-Points in Japan - Points in the North Pacific - Points in the west coast of Canada and/or in the west coast of the United States of America - Mexico City or Havana - Panama - Bogota and/or Caracas - Manaus - Goiania - Rio de Janeiro and/or Sao Paulo and/or a point in Brazil, in both directions.

II　両方向に、日本国内の地点－中部太平洋における地点－アメリカ合衆国の西海岸における地点－メキシコ・シティ又はハヴァナ－パナマ－ボゴタ及び(又は)カラカス－マナウス－ゴイアニア－リオ・デ・ジャネイロ及び(又は)サン・パウロ

　II-Points in Japan - Points in the Central Pacific - Points in the west coast of the United States of America - Mexico City or Havana - Panama - Bogota and/or Caracas - Manaus - Goiania - Rio de Janeiro and/or Sao Paulo, in both directions.

III　両方向に、日本国内の地点－一中継地点－パペーテ－イースター島－リマ及び(又は)サンチャゴ－サン・パウロ及び(又は)リオ・デ・ジャネイロ

　III-Points in Japan - one intermediate point - Papeete - Easter Island - Lima and/or Santiago - Sao Paulo and/or Rio de Janeiro, in both directions.

　日本国の一又は二以上の指定航空企業が前記の路線において行う協定業務は、日本国の領域内の一地点を起点とするものでなければならない。ただし、当該路線上の他の地点は、いずれか又はすべての飛行に当たって、当該指定航空企業の選択により省略することができる。

　The agreed services provided by the designated airline or airlines of Japan on these routes shall begin at a point in the territory of Japan, but other points on any of the routes may at the option of the designated airline be omitted on any or all flights.

付表第二

SCHEDULE II

　ブラジルの一又は二以上の指定航空企業が運営する路線

　Routes to be operated by the designated airline or airlines of Brazil:

I　両方向に、ブラジル内の地点－カラカス及び(又は)ボゴタ－パナマ－ハヴァナ又はメキシコ・シティ－アメリカ合衆国の西海岸における地点及び(又は)カナダの西海岸における地点－北太平洋における地点－東京及び(又は)大阪及び(又は)名古屋

　I-Points in Brazil - Caracas and/or Bogota - Panama - Havana or Mexico City - Points in the west coast of the United States of America and/or in the west coast of Canada - Points in the North Pacific - Tokyo and/or Osaka and/or Nagoya, in both directions.

II　両方向に、ブラジル内の地点－カラカス及び(又は)ボゴタ－パナマ－ハヴァナ又はメキシコ・シティ－アメリカ合衆国の西海岸における地点－中部太平洋における地点－大阪及び(又は)東京

II -Points in Brazil - Caracas and/or Bogota - Panama - Havana or Mexico City - Points in the west coast of the United States of America - Points in the Central Pacific - Osaka and/or Tokyo, in both directions.

III　両方向に、ブラジル内の地点－リマ及び(又は)サンチャゴ－イースター島－パペーテ－一中継地点－東京及び(又は)福岡

III -Points in Brazil - Lima and/or Santiago - Easter Island - Papeete - one intermediate point - Tokyo and/or Fukuoka, in both directions.

　ブラジルの一又は二以上の指定航空企業が前記の路線において行う協定業務は、ブラジルの領域内の一地点を起点とするものでなければならない。ただし、当該路線上の他の地点は、いずれか又はすべての飛行に当たって、当該指定航空企業の選択により省略することができる。

　The agreed services provided by the designated airlines or airlines of Brazil on these routes shall begin at a point in the territory of Brazil, but at a point in the territory of Brazil, but other points on any of the routes may at the option of the designated airline be omitted on any or all flights.

注1　ブラジルの一又は二以上の指定航空企業は、関西国際空港が国際航空業務について供用を開始した後に、大阪への業務を行うことができる。

REMARKS:
1. The designated airline or airlines of Brazil may serve Osaka only after the Kansai International Airport is opened to international air services.

注2　路線Iでは、ブラジルの一又は二以上の指定航空企業は、東京又は大阪に寄航する便で名古屋に寄航することはできない。

2. On Route I, the designated airline or airlines of Brazil may not operate to Tokyo or Osaka and Nagoya on the same flight."

　本大臣は、前記の提案が日本国政府にとって受諾し得るものであるときは、この書簡及びその旨の閣下の返簡が協定の附属書の付表を修正する両国政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。

　If the above proposal is acceptable to the Japanese Government, I have further the honour to suggest that this Note and Your Excellency's reply in that sense shall be regarded as constituting an agreement between the two Government in this matter, modifying the Schedules of the Annex to the Agreement, which shall enter into force on the date of Your Excellency's reply.

　書簡をもって啓上いたします。本使は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。

　Excellency,
I have the honour to acknowledge the receipt of Your Excellency's Note of today's date, which reads as follows:

　本使は、日本国政府が前記の提案を受諾する旨を閣下に通報するとともに閣下の書簡及びこの返簡が千九百七十四年七月三十日に修正された日本国とブラジルとの間の航空運送協定の附属書の付表を修正する両国政府間の合意を構成するものとみなし、その合意が本日効力を生ずることを確認する光栄を有します。

　I have the honour to inform Your Excellency that the Japanese Government accepts the above proposal and to confirm that Your Excellency's Note and this reply shall be regarded as constituting an agreement between the two Government in this matter, modifying the Schedules of the Annex to the Air Transport Agreement between Japan and Brazil as modified on July 30, 1974, which shall enter into force on this date.

　本使は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。
