航空業務に関する日本国政府とマレイシア政府との間の協定の付表の修正に関する交換公文

書簡をもって啓上いたします。本官は、千九百六十五年二月十一日にクアラ・ランプールで署名され、千九百六十七年、千九百七十二年、千九百八十年、千九百八十五年、千九百八十八年、千九百八十九年及び千九百九十年に修正された航空業務に関するマレイシア政府と日本国政府との間の協定(以下「協定」という。)に関し千九百九十二年六月二十四日から二十五日までの間クアラ・ランプールにおいて行われた協議に言及する光栄を有します。
Excellency, I have the honour to refer to the consultations held in Kuala Lumpur from June 24 to 25, 1992, concerning the Agreement between the Government of Malaysia and the Government of Japan for Air Services signed at Kuala Lumpur on February 11, 1965, as amended in 1967, 1972, 1980, 1985, 1988, 1989 and 1990 (hereinafter referred to as the "Agreement").
本官は、更に、前記の協議において到達した合意に従い、協定の付表が次のとおり修正されるべきことをマレイシア政府に代わって提案する光栄を有します。
Pursuant to the agreement reached at the said consultations, I now have further the honour to propose, on behalf of the Government of Malaysia, that the Schedule to the Agreement be amended as follows:

I 日本国の一又は二以上の指定航空企業が両方向に運営する路線
I.Routes to be operated in both directions by the designated airline or airlines of Japan:
A 日本国内の地点－台北－香港－マニラ－ホーチミン・シティ－バンコック－シンガポール－クアラ・ランプール－バンコック(注1)－シンガポール－ジャカルタ－東南アジア内の二地点(注1)
A.Points in Japan-Taibei-Hong Kong-Manila-Ho Chi Minh City-Bangkok-Singapore-Kuala Lumpur-Bangkok (Note 1)-Singapore-Jakarta-Two points in South East Asia. (Note 1)
B 日本国内の地点(注2)－クアラ・ランプール及び以遠の一地点
B.Points in Japan (Note 2)-Kuala Lumpur and one point beyond.
C 日本国内の地点－ペナン
C.Points in Japan-Penang.
D 日本国内の地点－クアラ・ランプール及びペナン以外のマレイシア内の一地点
D.Points in Japan-one point in Malaysia other than Kuala Lumpur and Penang.
注1 日本国の一又は二以上の指定航空企業は、関西国際空港が国際航空業務について供用を開始した後に、路線Ａにおいてクアラ・ランプールとバンコックとの間及びクアラ・ランプールと東南アジア内の二地点との間において第五の自由の運輸権を行使することができる。
Note 1: The designated airline or airlines of Japan may exercise fifty freedom traffic rights between Kuala Lumpur and Bangkok and between Kuala Lumpur and two points beyond in South East Asia on route A only after the Kansai International Airport is opened to international air services.
注2 関西国際空港が国際航空業務について供用を開始するまでの間、日本国の一又は二以上の指定航空企業は、路線Ｂにおいて東京のみを使用することができる。
Note 2: Pending the opening of the Kansai International Airport to international air services, the designated airline or airlines of Japan may use only Tokyo on route B.
II マレイシアの一又は二以上の指定航空企業が両方向に運営する路線
II.Routes to be operated in both directions by the designated airline or airlines of Malaysia:
A マレイシア内の地点－バンコック－ホーチミン・シティ(注1)－香港－マニラ－台北－ソウル－東京－ソウル
A.Points in Malaysia-Bangkok-Ho Chin Minh City (Note 1)-Hong Kong-Manila-Taibei-Seoul-Tokyo-Seoul.
B マレイシア内の地点(注2)－東京－ホノルル(注1及び注3)－サン・フランシスコ又はロス・アンジェルス(注4)
B.Points in Malaysia (Note 2)-Tokyo-Honolulu (Note 1 and 3)-San Francisco or Los Angeles (Note 4).
C マレイシア内の地点－福岡
C.Points in Malaysia-Fukuoka.
D マレイシア内の地点－名古屋
D.Points in Malaysia-Nagoya.
E マレイシア内の地点－大阪(注5)
E.Points in Malaysia-Osaka. (Note 5)
注1 マレイシアの一又は二以上の指定航空企業は、ホノルルへの運航を行う間、ホーチミン・シティヘは技術上の着陸のための地点としてのみ運航を行うことができる。
Note 1: For so long as the designated airline of airlines of Malaysia is or are operating into Honolulu, it or they may only operate into Ho Chi Minh City as a point for technical landing.
注2 関西国際空港が国際航空業務について供用を開始するまでの間、マレイシアの一又は二以上の指定航空企業は、路線Ｂにおいてクアラ・ランプールのみを使用することができる。
Note 2: Pending the opening of the Kansai International Airport to international air services, the designated airline or airlines of Malaysia may use only Kuala Lumpur on route B.
注3 マレイシアの一又は二以上の指定航空企業は、東京とホノルルとの間において第五の自由の運輸権を行使しない。
Note 3: The designated airline or airlines of Malaysia shall not exercise fifth freedom traffic rights between Tokyo and Honolulu.
注4 マレイシアの一又は二以上の指定航空企業は、いずれかの地点を選択することができるものとし、日本国の航空当局に対し九十日前に通告を行うことにより、業務を行っていない他の地点へその選択を変更することができる。
Note 4: The designated airline or airlines of Malaysia may select either point and, upon a 90 day notice to the aeronautical authorities of Japan, may change such selection to the point not being served.
注5 マレイシアの一又は二以上の指定航空企業は、関西国際空港が国際航空業務について供用を開始した後に、大阪への業務を行うことができる。
Note 5: The designated airline or airlines of Malaysia may serve Osaka only after the Kansai International Airport is opened to international air services.
III いずれか一方の締約国の一又は二以上の指定航空企業が行う協定業務は、その締約国の領域内の一地点を起点とするものでなければならない。ただし、特定路線上の他の地点は、いずれかの又はすべての飛行に当たって、その一又は二以上の指定航空企業の選択により省略することができる。
III.The agreed services provided by the designated airline or airlines of either Contracting Party shall begin at a point in the territory of that Contracting Party, but other points on the specified routes may, at the option of the designated airline or airlines concerned, be omitted on any or all flights.
本官は、更に、前記の提案が日本国政府にとって受諾し得るものであるときは、この書簡及びその旨の閣下の返簡を両国政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずることを提案いたします。
If the above proposal is acceptable to the Government of Japan, I have further the honour to propose that this Note together with Your Excellency's reply to that effect shall be regarded as constituting an agreement between the two Governments which shall enter into force on the date of Your Excellency's reply.
本官は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。

書簡をもって啓上いたします。本使は、本日付けの閣下の次の書簡に言及する光栄を有します。
Excellency, I have the honour to refer to Your Excellency's Note of today's date, which reads as follows:

本使は、日本国政府がマレイシア政府の前記の提案を受諾する旨を閣下に通報するとともに閣下の書簡及びこの返簡がこの問題に関する両国政府間の合意を構成するものとみなし、その合意が本日効力を生ずることを日本国政府に代わって確認する光栄を有します。
I have the honour to inform Your Excellency that the Government of Japan accepts the above proposal of the Government of Malaysia and to confirm, on behalf of the Government of Japan, that Your Excellency's Note and this reply shall be regarded as constituting an agreement between the two Governments on this matter, which enters into force on this date.
本使は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。
