航空業務に関する日本国とオーストリア共和国との間の協定の付表の修正に関する交換公文

(Japanese Note)
書簡をもって啓上いたします。本使は、千九百八十九年三月七日にウィーンで署名された航空業務に関する日本国とオーストリア共和国との間の協定(以下「協定」という。)に関し千九百九十二年十月二十八日及び二十九日にウィーンにおいて日本国及びオーストリア共和国の航空当局の間で行われた協議に言及し、別添の修正された付表が協定の現行の付表に代わるべきことを提案する光栄を有します。
Vienna, June 16, 1993 Excellency, I have the honour to refer to the consultations held in Vienna on 28 and 29 October 1992 between the aeronautical authorities of Japan and the Republic of Austria concerning the Agreement between Japan and the Republic of Austria for Air Services, signed at Vienna on 7 March 1989 (hereinafter referred to as the "Agreement"), and to propose that the revised Schedule as set out in the Attachment shall replace the existing Schedule to the Agreement.
本使は、更に、前記の提案がオーストリア連邦政府にとって受諾し得るものであるときは、この書簡及びその旨の閣下の返簡を両国政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。
If the above proposal is acceptable to the Austrian Federal Government, I have further the honour to propose that this Note and Your Excellency's Note in reply shall be regarded as constituting an agreement between the two Government, which shall enter into force on the date of Your Excellency's reply.
本使は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。

1 日本国の一又は二以上の指定航空企業が両方向に運営する路線
1. Routes to be operated in both directions by the designated airline or airlines of Japan:
(a) 日本国内の地点－アラスカ内の一地点－ヨーロッパ内の一地点－ウィーン－ヨーロッパ内の以遠の一地点
(a) Points in Japan -- one point in Alaska -- one point in Europe -- Vienna -- one point beyond in Europe
(b) 日本国内の地点－ギリシャ、トルコ共和国、中東及びアジア(中華人民共和国内の地点を除く。)内の四地点－ウィーン－ヨーロッパ内の以遠の一地点
(b) Points in Japan -- four points in Greece, the Republic of Turkey, the Middle East and Asia (excluding points in the People's Republic of China) -- Vienna -- one point beyond in Europe
(c) 日本国内の地点－モスクワ－ヨーロッパ内の二地点－ウィーン－ヨーロッパ内の以遠の三地点
(c) Points in Japan -- Moscow -- two points in Europe -- Vienna -- three points beyond in Europe
注1 路線(c)の「ヨーロッパ内の二地点」に関しては、日本国の一又は二以上の指定航空企業は、自己が運送する途中降機の旅客についてのみ、ヨーロッパ内の二地点及びウィーンの間において運輸権を行使することができる。
1 As for the "two points in Europe" on Route (c), the designated airline or airlines of Japan may exercise traffic rights between the two points in Europe and Vienna only for its or their own stopover passengers.
注2 路線(c)においては、日本国の一又は二以上の指定航空企業は、関西国際空港が国際航空業務について供用を開始した後に、ヨーロッパ内の二地点及びヨーロッパ内の以遠の三地点のうちの一地点への業務を行うことができる。
2 On Route (c), the designated airline or airlines of Japan may serve the two points in Europe and one out of the three points beyond in Europe only after the Kansai International Airport is opened to international air services.
2 オーストリア共和国の一又は二以上の指定航空企業が両方向に運営する路線
2. Routes to be operated in both directions by the designated airline or airlines of the Republic of Austria:
(a) オーストリア内の地点－ヨーロッパ内の一地点－アラスカ内の一地点－東京
(a) Points in Austria -- one point in Europe -- one point in Alaska -- Tokyo
(b) オーストリア内の地点－ギリシャ、トルコ共和国、中東及びアジア(中華人民共和国内の地点を除く。)内の四地点－東京
(b) Points in Austria -- four points in Greece, the Republic of Turkey, the Middle East and Asia (excluding points in the People's Republic of China) -- Tokyo
(c) オーストリア内の地点－モスクワ－東京－大阪
(c) Points in Austria -- Moscow -- Tokyo -- Osaka
注1 路線(c)においては、東京に寄港する便で大阪に寄港してはならない。
1 On Route (c), Osaka shall not be served on the same flight with Tokyo.
注2 路線(c)においては、オーストリア共和国の指定航空企業は、関西国際空港が国際航空業務について供用を開始した後に、大阪への業務を行うことができる。
2 On Route (c), the designated airline or airlines of the Republic of Austria may serve Osaka only after the Kansai International Airport is opened to international air services.
3 いずれの締約国の一又は二以上の指定航空企業が提供する協定業務も、当該締約国の領域内の一地点をその起点としなければならないが、特定路線上の他の地点は、いずれかの又はすべての飛行に当たり当該指定航空企業の選択によって省略することができる。
3. The agreed services provided by the designated airline or airlines of either Contracting Party shall begin at a point in the territory of that Contracting Party, but other points on the specified routes may at the option of the designated airline be omitted on any or all flights.

書簡をもって啓上いたします。本大臣は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。

本大臣は、更に、オーストリア連邦政府が日本国政府の前記の提案を受諾する旨を閣下に通報するとともに、閣下の書簡及びこの返簡が両国政府間の合意を構成し、その合意がこの返簡の日付の日に効力を生ずることを確認する光栄を有します。
I have further the honour to inform Your Excellency that the Austrian Federal Government accepts the above proposal of the Government of Japan and to confirm that Your Excellency's Note and this reply shall constitute an agreement between the two Governments, which shall enter into force on the date of this reply.
