Trade Agreement between the Government of Japan and the Government of the Czech and Slovak Federal Republic
日本国政府及びチェッコ・スロヴァキア連邦共和国政府は、
The Government of Japan and the Government of the Czech and Slovak Federal Republic,
両国間の貿易関係を平等及び相互の利益の基礎の上に強化しかつ発展させること、並びにそれによって両国間に存在する友好関係を更に促進することを希望して、
Desiring to strengthen and develop trade relations between the two countries on the basis of equality and mutual benefit, and thereby to promote further the friendly relations existing between the two countries,
次のとおり協定した。
Have agreed as follows:
第一条 両政府は、それぞれの国の関係法令に従って、両国間の貿易が円滑に行われるよう努力する。
Article 1 The two Governments shall endeavour to facilitate trade between the two countries in accordance with the relevant laws and regulations of the respective countries.
第二条 いずれの一方の国の政府も、それぞれの国が関税及び貿易に関する一般協定の締約国として有し又は有することのある権利及び義務に従い、他方の国の産品に対し、関税、関税手続、輸入許可証の発給並びに輸入及び輸出に影響を与えるその他の事項について、最恵国待遇を与える。
Article 2 The Governments of either country shall accord the products of the other country most-favoured-nation treatment in accordance with the rights and obligations which each country has or may have as a contracting party to the General Agreement on Tariffs and Trade with respect to customs duties, customs formalities, issuance of import licences and other matters affecting importation and exportation.
第三条 両国間の貿易は、それぞれの国の関係法令の範囲内で、両国の法人又は自然人の間で締結される契約に従って行われる。
Article 3 Trade between the two countries shall be conducted in accordance with contracts concluded between juridical or natural persons of the two countries within the scope of the relevant laws and regulations of the respective countries.
第四条 両国間のすべての支払は、それぞれの国の関係法令の範囲内で、交換可能な通貨によって行われる。
Article 4 All payments between the two countries shall be effected in convertible currencies within the scope of the relevant laws and regulations of the respective countries.
第五条 それぞれの国の関係法令に従い、次の物品は、輸出及び輸入について関税の支払を免除される。
Article 5 Subject to the relevant laws and regulations of the respective countries, following goods will be exempted from the payment of customs duties for exports and imports:
(a) 広告及び貿易促進を目的とする見本及び資料で商業的価値を持たないもの
a) Samples and materials destined for advertisement and trade promotion that do not have a commercial value.
(b) 貿易見本市及び貿易展示会に出品される力タログ、パンフレットその他同種の資料
b) Catalogues, pamphlets and other materials of this kind destined for trade fairs and trade exhibitions.
(c) 貿易見本市及び貿易展示会に出品される物品で、送り返されるもの
c) Goods destined for trade fairs and trade exhibitions, provided that they should be sent back.
第六条 いずれの一方の国の政府も、自国の関係法令の範囲内で、その領域内における他方の国の物品の貿易見本市及び貿易展示命の開催に必要な便宜を与える。
Article 6 The Government of either country shall grant, within the scope of the relevant laws and regulations of such country, necessary facilities for holding trade fairs and trade exhibitions for goods of the other country in the territory of the former country.
第七条 両政府は、この協定の実施について検討すること及び両国間の貿易の発展に有益な情報を交換することを目的として、いずれか一方の政府の要請があったときはいつでも、相互に協議する。
Article 7 The two Governments shall consult with each other at any time upon the request of either Government for the purpose of reviewing the implementation of this Agreement and exchanging information useful for the development of trade between the two countries
第八条 この協定の終了は、この協定の有効期間中に両国の法人又は自然人の間で締結される契約の履行に影響を与えるものではない。両政府は、この協定の終了の後においても、これらの契約がそれぞれの国の関係法令に従つて、かつ、この協定に定める原則を指針として履行されるべきであることに意見の一致をみている。
Article 8 The termination of this Agreement shall not affect the fulfillment of any contracts concluded between juridical or natural persons of the two countries during the period of validity of this Agreement. The two Governments agree that the fulfillment of such contracts should be guided after the termination of this Agreement by the principles embodied in this Agreement subject to the relevant laws and regulations of the respective countries.
第九条 1 この協定は、千九百九十二年十月十七日に効力を生ずる。
Article 9 1. This Agreement shall enter into force on October 17, 1992.
2 この協定は、一年間効力を有し、いずれか一方の国の政府が、この協定を終了させる意思を少なくとも三箇月前に他方の国の政府に対し書面により予告しない限り、次の一年間について毎年自動的に更新される。
2. This Agreement shall be valid for a period of one year and shall be automatically renewed every year for the next one year period, unless the Government of either country has previously given to the Government of the other country at least three months' written notice of its intention to terminate this Agreement.
