AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE UNITED NATIONS ENVIRONMENT PROGRAMME RELATING TO THE UNEP-INTERNATIONAL ENVIRONMENTAL TECHNOLOGY CENTRE IN JAPAN
日本国政府(以下「政府」という。)及び国際連合総会決議第二千九百九十七号(第二十七回会期)により設立された国際連合環境計画(以下「UNEP」という。)は、UNEP管理理事会の決定十六ー三十四に基づき開発途上国及び経済体制が移行過程にある国に対し環境上適正な技術の移転を促進することを希望して、次のとおり協定した。
The Government of Japan (hereinafter referred to as "the Government") and the United Nations Environment Programme (hereinafter referred to as "UNEP"), established by General Assembly resolution 2997 (XXVII), desiring to promote the transfer of environmentally sound technologies to developing countries and countries with economies in transition, pursuant to the terms of decision 16/34 adopted by the Governing Council of UNEP. have agreed as follows:
第一条 センターの設立
Article I Establishment of the Centre
UNEPは、政府と協力して、「国際連合環境計画(UNP)国際環境技術センター」(以下「センター」という。)と称するセンターを設立する。センターは、日本国の大阪市及び滋賀県にそれぞれ一の事務所を置く。センターは、UNEPの不可分の一部であり及びその監督の下にあるものとする。UNEP及び政府は、センターの国際的な地位を保障するため、センターの促進する技術及びセンターの利用し得る専門技術が様々な国からもたらされることを確保するよう協力する。センターの国際的な地位は、その機構、職員及び計画に反映される。
UNEP, in cooperation with the Government, shall establish a centre to be known as the "UNEP-International Environmental Technology Centre" (hereinafter referred to as "the Centre"), which shall have one office in Osaka City and one office in Shiga prefecture, Japan. The Centre will be an integral part of UNEP and thereby under its supervision. The Government and UNEP shall co-operate to ensure that the technologies promoted by the Centre and expertise available to it will be from various countries. with a view to guaranteeing the international status of the Centre. That international status shall be reflected in organizational structure. personnel and programmes of the Centre.
第二条 政府の寄与
Article II Contribution by the Government
政府は、センターの設立の後できる限り速やかに、UNEPに対し百五十万合衆国ドルを拠出するものとし、その拠出金は、日本国における国際連合環境計画(UNEP)国際環境技術センターのために設置される技術協力信託基金に預託される。政府は、その後の年におけるセンターの活動に使用するため、日本国の毎年の予算の範囲内で、かつ、関連がありかつ適用することができる国内法令に基づき、更に寄与を行う意図を有する。
The Government will contribute to UNEP US$1.500.000 which shall be deposited in the technical co-operation trust fund to be established for the UNEP-International Environmental Technology Centre in Japan as soon as possible after the establishment of the Centre. The Government has the intention to make further contributions to UNEP to be utilized for the Centre's activities in the following years. within annual budgets appropriated in Japan and in accordance with its relevant and applicable laws and regulations
第三条 センターの目的及び活動
Article III Objectives and Activities of the Centre
センターは、大都市並びに淡水湖及び貯水池の集水域の環境上持続可能な管理に特別の焦点を当て、研修及びコンサルティング業務を提供し、調査を実施し並びに関連する情報を蓄積し及び普及することを通じ、開発途上国及び経済体制が移行過程にある国に対し環境上適正な技術を移転することに従事する。センターの活動は、UNEPの関連する組織の活動(特に、産業環境計画活動センターのより汚染の少ない生産及び他の関連する活動並びに地球環境監視制度の主催の下に行われる活動)又は国際連合内の他の機関の活動と十分に調整し、及びこれらの活動を補完する。
The Centre shall be dedicated to the transfer of environmentally sound technologies to developing countries and countries with economies in transition by means of providing training and consulting services, carrying out research, and accumulating and disseminating related information with special focus on environmentally sustainable management of big cities and of basins of fresh-water lakes or reservoirs. The activities of the Centre shall be fully co-ordinated with and complement activities of relevant units of UNEP, in particular. the cleaner production and other relevant activities of the lndustry and Environment Programme Activity Centre and activities taking place under the auspices of the Global Environmental Monitoring System. or other organizations within the United Nations system.
第四条 センターの組織
Article IV Organization of the Centre
UNEP事務局長(以下「事務局長」という。)は、国際連合職員規則に従い、センターの所長及び職員を任命する。所長は、事務局長の監督の下でセンターの活動について全面的な責任を負う。センターの活動に関し助言するため、国際諮間委員会を設置するものとし、同委員会は、少なくとも年一回会合する。国際諮間委員会は、種々の経歴を有する委員から成る。
The Executive Director of UNEP (hereinafter referred to as "the Executive Director") shall appoint, in accordance with the Staff Regulations and Rules of the United Nations. The Director and the staff of the Centre. The Director shall have overall responsibility for the activities of the Centre under the supervision of the Executive Director. For the purpose of advising on the activities of the Centre, an international advisory board shall be established. which will meet at least once a year. The international advisory board will be composed of members with various backgrounds.
第五条 財政措置及び関連する措置
Article V Financial and related Arrangements
1 センターは、その時に資金が利用可能であることを条件としてUNEP管理理事会が承認する環境基金の計画予算、事務局長が設置する技術協力信託基金に対して政府並びに他の政府機関及び非政府機関が行う自発的寄与並びに他の適当な財源によつてその費用を賄う。
1. The Centre will be financed by the programme budget of the Environment Fund as approved by the Governing Council of UNEP subject to the availability of resources at the time, voluntary contributions made by the Government and other Governmental and non-Governmental bodies to a technical co-operation trust fund established by the Executive Director, and other appropriate sources.
2 この技術協力信託基金は、国際連合財政規則及び国際連合環境計画基金財政規則に従って管理する。
2. This technical co-operation trust fund will be administered in accordance with the Financial Regulations and Rules of the United Nations, and the Financial Rules of the Fund of the United Nations Environment Programme.
3 政府は、センターの目的の達成に必要な事務所施設を調達することについて援助を与える。
3. The Government shall provide assistance in procuring such office accommodation as may be necessary for the fulfillment of the objectives of the Centre.
第六条 便益、特権及び免除
Article VI Facilities. Privileges and lmmunities
1 政府は、UNEP(センターを含む。)並びに任務を遂行中のその職員及び専門家に対し、政府が締約者である国際連合の特権及び免除に関する条約を適用する。
1. The Government shall apply to UNEP, including the Centre, and its officials and experts on mission the provisions of the Convention on the Privileges and lmmunities of the United Nations to which the Government is a Party.
2 政府は、国際連合の各専門機関並びに任務を遂行中のその職員及び専門家に対し、政府が締約者である専門機関の特権及び免除に関する条約(当該専門機関に適用される同条約の附属書を含む。)を適用する。
2. The Government shall apply to each Specialized Agency of the United Nations and its officials and experts on mission the provisions of the Convention on the Privileges and lmmunities of the Specialized Agencies, to which the Government is a Party, including any Annex to the Convention applicable to such Specialized Agency.
第七条 効力の発生及び終了
Article VII Entry into Force and Termination
1 この協定は、署名の日に効力を生ずる。
1. This Agreement shall enter into force on the date of its signature.
2 この協定は、いずれか一方の締約者がセンターの目的が達成されたと認めるとき又はセンターの活動が適切若しくは効果的に遂行できなくなつたと認めるときまで効力を有するものとし、そのように認められるときは、相互の同意により又はいずれか一方の締約者が十二箇月前に他方の締約者に対して文書による予告を与えることによつて終了させることができる。
2. This Agreement shall remain in force until either Party considers that the objectives of the Centre have been accomplished or that its activities can no longer appropriately or effectively be carried out, at which time this Agreement may be terminated by mutual consent or by either Party serving twelve months' written advance notice to the other Party.
以上の証拠として、下名は、それぞれ日本国政府の代表及び国際連合環境計画の代表として正当に任命され、締約者のため、千九百九十二年十月三十日に大阪でこの協定に署名した。
IN WITNESS WHEREOF the undersigned. duly appointed representatives of the Government of Japan and the United Nations Environment Programme, respectively, have on behalf of the Parties signed the present Agreement at Osaka this thirteeth day of October, 1992.
