国際連合工業開発機関工業投資促進事務所のための拠出に関する日本国政府と国際連合工業開発機関との間の交換公文

(Japanese Note)

　Vienna, September 29, 1992

　書簡をもって啓上いたします。本使は、開発途上国における工業投資の促進のための国際連合工業開発機関工業投資促進事務所(以下「事務所」という。)のための日本国政府の拠出に関して千九百八十九年八月二十九日にウィーンで行われた日本国政府の代表者と国際連合工業開発機関(以下「UNID0」という。)の代表者との間の書簡の交換に言及するとともに、事務所を日本国に設置して行う複数の地域を対象とするUNIDOの事業(以下「事業」という。)の期間が千九百九十二年八月三十一日に終了したことを考慮して、事業に関する次の取極を日本国政府に代わって提案する光栄を有します。

　Sir,
   I have the honour to refer to the Exchange of Notes between the representatives of the Government of Japan and of the United Nations Industrial Development Organization (hereinafter referred to as "UNIDO") done at Vienna On August 29, 1989 concerning the contribution of the Government of Japan for the UNIDO Service for the Promotion of Industrial Investment in Developing Countries (hereinafter referred to as "the Service") and, taking into account that the interregional project of UNIDO for the establishment in Japan of the Service (hereinafter referred to as "the Project") terminated on August 31, 1992, to propose on behalf of the Government of Japan the following arrangements in respect of the Project:

1　事業は、工業協力の分野において、投資事業の促進及びこれらに関連する技術の移転についての日本国と開発途上国との間の協力を強化することを目的とする。この目的は、開発途上国の工業化のための国際連合の機関であるUNID0と日本国の企業との緊密なかつ信頼のある接触によって達成されることとなる。

1. The objective of the project is to strengthen the co-operation between Japan and the developing countries in the area of industrial co-operation, in the promotion of investment projects and the related transfer of technology. This objective will be furthered by close and trustful contacts between UNIDO as the UN Organization for the industrialization of developing countries and Japanese enterprises.

2　この取極の対象となる事業の期間は、千九百九十二年九月二十九日から千九百九十五年八月三十一日までとする。この取極の適用上、一年目は千九百九十二年九月二十九日から千九百九十三年八月三十一日までとし、二年月及び三年月は千九百九十三年九月一日から千九百九十四年八月三十一日まで及び千九百九十四年九月一日から千九百九十五年八月三十一日までとする。

2. The duration of the Project covered by the present arrangements shall be from September 29, 1992 to August 31, 1995. For the purpose of the present arrangements, the first year shall be from September 29, 1992 to August 31, 1993, the second and third years shall be from September 1, 1993 to August 31, 1994 and from September 1. 1994 to August 31, 1995.

3　日本国政府は、日本国において施行されている法令に従い、事業に要する経費を負担するため、UNID0に対し、UNID0の工業開発基金に対する目的指定拠出を日本円で行う。一年目の拠出については、一合衆国ドル当たり百二十九円の為替換算率で百七万合衆国ドル(一、〇七〇、〇〇〇合衆国ドル)に相当する額の供与を日本円で行う。二年目及び三年目の拠出については、日本国において施行されている法令に従って行う。

3. The Government of Japan, in accordance with the laws and regulations in force in Japan, shall place at the disposal of UNIDO for the purpose of meeting the costs of the Project a special-purpose contribution to the Industrial Development Fund of UNIDO in Japanese yen. Concerning the financial contribution for the first year, the amount to be placed shall be, in Japanese yen, the equivalent of one million seventy thousand US dollars (US$1,070,000) at the exchange rate of one hundred twenty-nine yen per one US dollar. The financial contribution for the second and third years shall be made in accordance with the laws and regulations in force in Japan.

4　UNID0は、その財政規則及び他の関連規則に従い、3に規定する目的指定拠出を管理し、及び日本国政府に対し目的指定拠出に関する年次会計報告書を提出する。

4. UNIDO, in accordance with its financial rules and other applicable regulations, shall administer the special-purpose contribution referred to in paragraph 3 above and provide the Government of Japan with an annual financial statement in respect of the special-purpose contribution.

5　事務所の職員の採用は、UNID0の職員規則に従って行う。事務所長は、日本国政府との協議の上、かつ、その意見を尊重しつつ任命する。

5. The recruitment of personnel for the Service shall be effected in accordance with the staff rules and regulations of UNIDO. The appointment of the Head of the Service will be made after consultation with and respecting the opinion of the Government of Japan.

6　東京の事務所及びその職員について国際連合の特権及び免除に関する条約を適用することを確認する。日本国が専門機関の特権及び免除に関する条約をUNID0について適用することとしたときは、同条約を適用する。

6. It is confirmed that the Convention on the Privileges and Immunities of the United Nations (1946) applies to the Service in Tokyo and its personnel until the Convention on the Privileges and Immunities of the Specialized Agencies enters into effect for Japan with respect to UNIDO, after which time the letter convention shall apply.

7　この取極から生ずる間題についての日本国政府からUNI0及びUNID0から日本国政府に対するいかなる公的な連絡も、在ウィーン国際機関日本政府代表部を通じて行う。

7. Any official communication from the Government of Japan to UNIDO and from TJNIDO to the Government of Japan with regard to matters Drisin9 from the present arrangements shall be made through the Permanent Mission of Jap8n to the International Organizations in vienna.

8　この取極の実施に必要な他のすべての細目は、一年目については千九百九十二年九月三十日前に、二年目及び三年目についてはそれぞれ千九百九十三年九月一日前及び千九百九十四年九月一日前に、日本国政府とUNIDOのとの間で交渉し、取り決める。

8. All other details necessary to implement the arrangements for the first year shall be negotiated and arranged between the Government of Japan and UNIDO before September 30, 1992, and for the second and third years before September 1, 1993, and 1994, respectively.

9　UNID0は、事業の終了の後遅くとも六箇月以内に、日本国政府に対し、事業の実施に関する最終報告書(3に規定する目的指定拠出の通用に係る最終的な決算書を含む。)を提出する。最終報告書には、この取極の終了の遅くとも六箇月前に日本国政府及びUNID0の双方によつて行われる合同評価を基礎としてUNID0が事業について行う評価を含める。

9. UNIDO shall submit to the Government of Japan not later than six months after completion of the Project a final report on its implementation, including the final accounts covering the utilization of the special-purpose contribution referred to in paragraph 3 above. The final report shall contain the evaluation of the Project by UNIOO on the basis of the joint evaluation which shall be carried out by both sides not later than six months prior to the expiry of the present arrangements.

　本使は、更に、この書簡及びUNID0に代わって前記の取極を確認される貴官の返簡が日本国政府とUNID0との間の合意を構成するものとみなし、その合意が貴官の返簡の日付の日に効力を生ずることを提案する光栄を有します。

　I have further the honour to propose that the present Note and your Note in reply thereto confirming on behalf of UNIDO the foregoing arrangements shall be regarded as constituting an agreement between the Government of Japan and UNIDO. which will enter into force on the date of your reply.

　I have further the honour to confirm on behalf of UNIDO the foregoing arrangements and to agree that Your Excellency's Note and this Note shall be regarded as constituting an agreement between UNIDO and the Government of J8pan, which will enter into force on the date of this reply.
