技術協力及び青年海外協力隊の事業に関する日本国政府とシエラレオネ共和国政府との間の協定

AGREEMENT ON TECHNICAL COOPERATION AND THE JAPAN OVERSEAS COOPERATION VOLUNTEERS PROGRAM BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE REPUBLIC OF SIERRA LEONE

        技術協力及び青年海外協力隊の事業に関する日本国政府とシエラレオネ共和国政府との間の協定
  
  　日本国政府及びシエラレオネ共和国政府は、
  　両国間に存在する友好関係を技術協力及び青年海外協力隊員（以下「協力隊員」という。）の活動の促進により一層強化することを希望し、
  　それぞれの国の経済開発及び社会開発を促進することにより得られる相互の利益を考慮して、
  　次のとおり協定した。

AGREEMENT ON
TECHNICAL COOPERATION AND
THE JAPAN OVERSEAS COOPERATION VOLUNTEERS PROGRAM BETWEEN
THE GOVERNMENT OF JAPAN AND
THE GOVERNMENT OF THE REPUBLIC OF SIERRA LEONE



 The Government of Japan and the Government of the Republic of Sierra Leone,

 Desiring to strengthen further the friendly relations existing between the two countries by the promotion of technical cooperation and activities of Japan Overseas Cooperation Volunteers (hereinafter referred to as “JOCV”), and

 Considering mutual benefits derived from promoting the economic and social development of their respective countries,

 Have agreed as follows:

  　　　　第一条
  　両政府は、両国間の技術協力及び青年海外協力隊の事業を促進するよう努める。

Article I

 The two Governments shall endeavor to promote technical cooperation and the Japan Overseas Cooperation Volunteers Program between the two countries.

  　　　　第二条
  　この協定に基づいて行われる技術協力の個別の計画を規律する別個の取決めは、両政府の権限のある当局の間で合意される。日本国政府の権限のある当局は外務省であり、シエラレオネ共和国政府の権限のある当局は外務国際協力省である。

Article II

 Separate arrangements which govern specific programs of technical cooperation carried out under this Agreement shall be agreed upon between the competent authorities of the two Governments.  The competent authority of the Government of Japan is the Ministry of Foreign Affairs, and the competent authority of the Government of the Republic of Sierra Leone is the Ministry of Foreign Affairs and International Cooperation.

　　　第三条
  １　次の形態による技術協力は、日本国の現行の法令及び前条に規定する取決めに従い、独立行政法人国際協力機構（以下「ＪＩＣＡ」という。）により、ＪＩＣＡの負担で行われる。
      (a)　技術訓練をシエラレオネ国民に提供すること。
      (b)　ＪＩＣＡからの専門家（以下「ＪＩＣＡ専門家」という。）をシエラレオネ共和国に派遣すること。
      (c)　幅広い技術及び豊かな経験を有する日本人ボランティア（以下「日本人シニア海外ボランティア」という。）をシエラレオネ共和国に派遣すること。
      (d)　シエラレオネ共和国の経済開発及び社会開発に係る計画に関する調査を行うため、日本国の調査団（以下「日本国の調査団」という。）をシエラレオネ共和国に派遣すること。 
      (e)　設備、機械及び資材をシエラレオネ共和国政府に供与すること。
      (f)　両政府間の相互の同意によって決定されるその他の形態の技術協力をシエラレオネ共和国政府に対して行うこと。
　２　協力隊員は、両政府の権限のある当局の間で合意する別個の派遣計画により、日本国の現行の法令に従いＪＩＣＡによりシエラレオネ共和国に派遣される。また、協力隊員の任務の遂行に必要な設備、機械及び資材は、ＪＩＣＡにより使用に供される。

Article III

1. The following forms of technical cooperation will be carried out by the Japan International Cooperation Agency (hereinafter referred to as “JICA”) at its own expense in accordance with the laws and regulations in force in Japan as well as with the arrangements referred to in Article II:

 
 (a) providing technical training to the Sierra Leonean nationals;

 (b) dispatching experts from JICA (hereinafter referred to as the “JICA Experts”) to the Republic of Sierra Leone;

 (c) dispatching Japanese volunteers with a wide range of technical skills and abundant experience (hereinafter referred to as the “Japanese Senior Volunteers”) to the Republic of Sierra Leone;

 (d) dispatching Japanese missions (hereinafter referred to as the “Japanese Missions”) to the Republic of Sierra Leone to conduct surveys of economic and social development projects of the Republic of Sierra Leone;

 (e) providing the Government of the Republic of Sierra Leone with equipment, machinery and materials; and

 (f) providing the Government of the Republic of Sierra Leone with other forms of technical cooperation as may be decided upon by mutual consent between the two Governments.

2. JOCV will be dispatched to the Republic of Sierra Leone by JICA in accordance with the laws and regulations in force in Japan, according to schedules to be separately agreed upon between the competent authorities of the two Governments, and equipment, machinery and materials necessary for the performance of their duties will be also made available by JICA.

  　シエラレオネ共和国政府は、前条に規定する日本国の技術協力及び青年海外協力隊の事業の結果としてシエラレオネ国民が取得した技術及び知識並びに供与された設備、機械及び資材がシエラレオネ共和国の経済開発及び社会開発に寄与すること並びに軍事目的に使用されないことを確保する。

Article IV

 The Government of the Republic of Sierra Leone shall ensure that the techniques and knowledge acquired by the Sierra Leonean nationals as well as the equipment, machinery and materials provided as a result of the Japanese technical cooperation and the Japan Overseas Cooperation Volunteers Program as set forth in Article III contribute to the economic and social development of the Republic of Sierra Leone, and are not utilized for military purposes.

  　　　　第五条
  １　ＪＩＣＡがＪＩＣＡ専門家、日本人シニア海外ボランティア、日本国の調査団及び協力隊員を派遣する場合には、シエラレオネ共和国政府は、次のことを行う。
    (1)(a)　ＪＩＣＡ専門家、日本人シニア海外ボランティア、日本国の調査団の構成員及び協力隊員に対し、国外から送金される給与及び手当に対して又は当該給与及び手当に関連して課される租税（所得税を含む。）及び課徴金を免除すること。
      (b)　ＪＩＣＡ専門家、日本人シニア海外ボランティア及び日本国の調査団の構成員並びにこれらの者の家族の構成員並びに協力隊員に対し、次のものの輸入に関し、領事手数料、租税（関税を含む。）及び課徴金並びに輸入許可証及び為替証明書の取得要件を免除すること。
        (i)　携帯荷物
        (ii)　身回品、家財及び消費財
        (iii)　シエラレオネ共和国に派遣されるＪＩＣＡ専門家一名につき一台、ＪＩＣＡ専門家の一家族につき一台、日本人シニア海外ボランティア一名につき一台、日本人シニア海外ボランティアの一家族につき一台及び協力隊員一名につき一台の自動車
      (c)　シエラレオネ共和国に自動車を輸入しないＪＩＣＡ専門家及び日本人シニア海外ボランティア並びにこれらの者の家族並びに協力隊員に対し、当該ＪＩＣＡ専門家及び日本人シニア海外ボランティア並びにこれらの者の家族並びに協力隊員が自動車を現地購入する場合には、ＪＩＣＡ専門家一名につき一台、ＪＩＣＡ専門家の一家族につき一台、日本人シニア海外ボランティア一名につき一台、日本人シニア海外ボランティアの一家族につき一台及び協力隊員一名につき一台の自動車に対して課される租税（付加価値税を含む。）及び課徴金を免除すること。
      (d)　ＪＩＣＡ専門家及び日本人シニア海外ボランティア並びにこれらの者の家族並びに協力隊員に対し、(b)(iii)及び(c)に規定する自動車の登録料を免除すること。

Article V

1. In case JICA dispatches the JICA Experts, the Japanese Senior Volunteers, the Japanese Missions and JOCV, the Government of the Republic of Sierra Leone shall:

 
 (1) (a) exempt the JICA Experts, the Japanese Senior Volunteers, members of the Japanese Missions and JOCV from taxes including income tax and fiscal charges imposed on or in connection with salaries and any allowances remitted to them from abroad;

 (b) exempt the JICA Experts, the Japanese Senior Volunteers, members of the Japanese Missions and members of their families as well as JOCV from consular fees, taxes including customs duties and fiscal charges, as well as from the requirements of obtaining import license and certificate of foreign exchange coverage, in respect of the importation of:

 (i) luggage;

 (ii) personal effects, household effects and consumer goods; and

 (iii) one motor vehicle per JICA Expert, per family of the JICA Expert, per Japanese Senior Volunteer, per family of the Japanese Senior Volunteer and per member of JOCV assigned to stay in the Republic of Sierra Leone; 

 (c) exempt the JICA Experts, the Japanese Senior Volunteers and their families as well as JOCV who do not import any motor vehicle into the Republic of Sierra Leone from taxes including value added tax and fiscal charges in respect of the local purchase of one motor vehicle per JICA Expert, per family of the JICA Expert, per Japanese Senior Volunteer, per family of the Japanese Senior Volunteer and per JOCV; and

 (d) exempt the JICA Experts, the Japanese Senior Volunteers and their families as well as JOCV from the registration fee of the motor vehicles mentioned in (b)(iii) and (c).

  　　　　第五条　１
    (2)(a)　ＪＩＣＡ専門家、日本人シニア海外ボランティア、日本国の調査団及び協力隊員の任務の遂行に必要とされる適当な事務所その他の施設（電話及びファクシミリの役務を含む。）を自己の負担で提供し、かつ、当該施設の運営費及び維持費を負担すること。
      (b)　ＪＩＣＡ専門家、日本人シニア海外ボランティア、日本国の調査団及び協力隊員の任務の遂行に必要な現地要員（必要な場合には、英語を解する適当な通訳を含む。）並びにＪＩＣＡ専門家、日本人シニア海外ボランティア、日本国の調査団及び協力隊員の相手方となる当該任務の遂行に必要なシエラレオネ人の要員を自己の負担で提供すること。
      (c)　ＪＩＣＡ専門家、日本人シニア海外ボランティア及び協力隊員に係る次の諸経費を負担すること。
        (i)　通勤費
        (ii)　シエラレオネ共和国内の公用出張旅費
        (iii)　公用通信費
      (d)　ＪＩＣＡ専門家及び日本人シニア海外ボランティア並びにこれらの者の家族の構成員並びに協力隊員に対し、適当な住宅の確保につき便宜を提供すること。
      (e)　ＪＩＣＡ専門家、日本人シニア海外ボランティア及び日本国の調査団の構成員並びにこれらの者の家族の構成員並びに協力隊員に対し、医療上の便宜を提供すること。

Article V　1.

 (2) (a) provide at its own expense suitable office and other facilities including telephone and facsimile services necessary for the performance of the duties of the JICA Experts, the Japanese Senior Volunteers, the Japanese Missions and JOCV as well as bear the expenses for their operation and maintenance;

 (b) provide at its own expense the local staff (including adequate English-speaking interpreters, if necessary) as well as the Sierra Leonean counterparts to the JICA Experts, the Japanese Senior Volunteers, the Japanese Missions and JOCV necessary for the performance of their duties;

 (c) bear expenses of the JICA Experts, the Japanese Senior Volunteers and JOCV for:

 (i) daily transportation to and from their place of work;

 (ii) their official travels within the Republic of Sierra Leone; and

 (iii) their official correspondence;

 (d) provide the convenience for acquisition of appropriate housing accommodation for the JICA Experts, the Japanese Senior Volunteers and members of their families as well as JOCV; and

 (e) provide the convenience for receiving medical care and facilities for the JICA Experts, the Japanese Senior Volunteers, members of the Japanese Missions and members of their families as well as JOCV.

  　　　　第五条　１
    (3)(a)　ＪＩＣＡ専門家、日本人シニア海外ボランティア及び日本国の調査団の構成員並びにこれらの者の家族の構成員並びに協力隊員に対し、任期中、シエラレオネ共和国に入国し、同国から出国し、及び同国に滞在することを許可し、外国人登録要件に係る手続に関する便宜を与え、並びに領事手数料を免除すること。
      (b)　ＪＩＣＡ専門家、日本人シニア海外ボランティア、日本国の調査団の構成員及び協力隊員の任務の遂行に必要な全ての政府機関の協力を確保するため、ＪＩＣＡ専門家、日本人シニア海外ボランティア、日本国の調査団の構成員及び協力隊員に対して身分証明書を発給すること。
      (c)　ＪＩＣＡ専門家及び日本人シニア海外ボランティア並びにこれらの者の家族の構成員並びに協力隊員に対し、自動車運転免許証の取得のための便宜を与えること。
      (d)  協力隊員に対し、その任務の遂行に必要な無線通信機の設置及び使用を許可すること。
      (e)　ＪＩＣＡ専門家、日本人シニア海外ボランティア、日本国の調査団及び協力隊員の任務の遂行に必要なその他の措置をとること。

Article V 1.

 (3) (a) permit the JICA Experts, the Japanese Senior Volunteers, members of the Japanese Missions and members of their families as well as JOCV to enter, leave and sojourn in the Republic of Sierra Leone for the duration of their assignment therein, offer them the convenience for procedures of alien registration requirements, and exempt them from consular fees;

 (b) issue identification cards to the JICA Experts, the Japanese Senior Volunteers, members of the Japanese Missions and JOCV to secure the cooperation of all governmental organizations necessary for the performance of their duties; 

 (c) offer the JICA Experts, the Japanese Senior Volunteers and members of their families as well as JOCV the convenience for acquisition of car driving license;

 (d) permit JOCV to install and use radio communication sets necessary for the performance of their duties; and 
 
 (e) carry out other measures necessary for the performance of the duties of the JICA Experts, the Japanese Senior Volunteers, the Japanese Missions and JOCV.

  　　　　第五条
  ２　１に規定する自動車が、その後シエラレオネ共和国内において、租税（関税を含む。）の免除又は同様の特権を受ける権利を有しない個人又は団体に売却され、又は譲渡される場合には、当該自動車に対して当該租税が課される。

Article V

2. The motor vehicles mentioned in paragraph 1 shall be subject to payment of taxes including customs duties if they are subsequently sold or transferred within the Republic of Sierra Leone to individuals or organizations not entitled to exemption from such taxes or similar privileges.

  　　　　第五条
 ３　シエラレオネ共和国政府は、ＪＩＣＡ専門家、日本人シニア海外ボランティア及び日本国の調査団の構成員並びにこれらの者の家族の構成員並びに協力隊員に対し、シエラレオネ共和国において同様の任務を遂行しているいかなる第三国又は国際機関の専門家、シニアボランティア及び調査団の構成員並びにこれらの者の家族の構成員並びに協力隊員に類するボランティアに与えられているものよりも不利でない特権、免除及び便宜を与える。

Article V

3. The Government of the Republic of Sierra Leone shall accord the JICA Experts, the Japanese Senior Volunteers, members of the Japanese Missions and members of their families as well as JOCV such privileges, exemptions and benefits as are no less favorable than those accorded to experts, senior volunteers, members of missions and members of their families as well as similar volunteers of any third country or of any international organization performing a similar mission in the Republic of Sierra Leone.

  　　　　第六条
  　シエラレオネ共和国政府は、ＪＩＣＡ専門家、日本人シニア海外ボランティア、日本国の調査団の構成員又は協力隊員の任務の遂行に起因し、当該任務の遂行中に発生し、又は当該任務の遂行に関連して当該ＪＩＣＡ専門家、日本人シニア海外ボランティア、日本国の調査団の構成員又は協力隊員に対する請求が生じた場合には、当該請求について責任を負う。ただし、当該請求が当該ＪＩＣＡ専門家、日本人シニア海外ボランティア、日本国の調査団の構成員又は協力隊員の重大な過失又は故意から生じたことについて両政府が合意する場合は、この限りでない。

Article VI

 The Government of the Republic of Sierra Leone shall bear the responsibilities for claims, if any arises, against the JICA Experts, the Japanese Senior Volunteers, members of the Japanese Missions or JOCV resulting from, occurring in the course of, or otherwise connected with, the performance of their duties, except when the two Governments agree that such claims arise from gross negligence or willful misconduct on the part of the JICA Experts, the Japanese Senior Volunteers, members of the Japanese Missions or JOCV.

  　　　　第七条
  １(1)　ＪＩＣＡがシエラレオネ共和国政府に対して設備、機械及び資材を供与する場合には、シエラレオネ共和国政府は、当該設備、機械及び資材の輸入に関し、領事手数料、租税（関税を含む。）及び課徴金並びに輸入許可証及び為替証明書の取得要件を免除する。当該設備、機械及び資材は、陸揚港において保険料及び運賃込みの条件でシエラレオネ共和国政府の権限のある当局に引き渡された時にシエラレオネ共和国政府の財産となる。
    (2)　ＪＩＣＡがシエラレオネ共和国政府に対して設備、機械及び資材を供与する場合には、シエラレオネ共和国政府は、当該設備、機械及び資材の現地購入に関し、租税（付加価値税を含む。）及び課徴金を免除する。
    (3)　(1)及び(2)に規定する設備、機械及び資材は、両政府の権限のある当局の間に別段の合意がある場合を除くほか、第二条に規定する取決めに定める目的のために使用される。
    (4)　(1)及び(2)に規定する設備、機械及び資材のシエラレオネ共和国内における輸送のための費用並びにこれらの交換、維持及び修理のための費用については、シエラレオネ共和国政府が負担する。

Article VII

1. (1) In case JICA provides the Government of the Republic of Sierra Leone with equipment, machinery and materials, the Government of the Republic of Sierra Leone shall exempt such equipment, machinery and materials from consular fees, taxes including customs duties and fiscal charges, as well as from the requirements of obtaining import license and certificate of foreign exchange coverage, in respect of the importation.  The equipment, machinery and materials mentioned above shall become the property of the Government of the Republic of Sierra Leone upon being delivered c.i.f. at the port of the disembarkation to the competent authorities of the Government of the Republic of Sierra Leone.

 
 (2) In case JICA provides the Government of the Republic of Sierra Leone with equipment, machinery and materials, the Government of the Republic of Sierra Leone shall exempt such equipment, machinery and materials from taxes including value added tax and fiscal charges in respect of the local purchase.

 (3) The equipment, machinery and materials mentioned in sub-paragraphs (1) and (2) shall be utilized for the purpose specified in the arrangements referred to in Article II unless otherwise agreed upon between the competent authorities of the two Governments.

 (4) The expenses for the transportation within the Republic of Sierra Leone of the equipment, machinery and materials mentioned in sub-paragraphs (1) and (2) and the expenses for their replacement, maintenance and repair shall be borne by the Government of the Republic of Sierra Leone.

  　　　　第七条
  ２(1)　ＪＩＣＡ専門家、日本人シニア海外ボランティア、日本国の調査団の構成員及び協力隊員の任務の遂行に必要な設備、機械及び資材であってＪＩＣＡが用意するものは、両政府の権限のある当局の間に別段の合意がある場合を除くほか、引き続きＪＩＣＡの財産とする。
    (2)　シエラレオネ共和国政府は、ＪＩＣＡ専門家、日本人シニア海外ボランティア、日本国の調査団の構成員及び協力隊員に対し、(1)に規定する設備、機械及び資材の輸入に関し、領事手数料、租税（関税を含む。）及び課徴金並びに輸入許可証及び為替証明書の取得要件を免除する。
    (3)　シエラレオネ共和国政府は、ＪＩＣＡ専門家、日本人シニア海外ボランティア、日本国の調査団の構成員及び協力隊員に対し、(1)に規定する設備、機械及び資材の現地購入に関し、租税（付加価値税を含む。）及び課徴金を免除する。

Article VII

2. (1) The equipment, machinery and materials, prepared by JICA, necessary for the performance of the duties of the JICA Experts, the Japanese Senior Volunteers, members of the Japanese Missions and JOCV shall remain the property of JICA unless otherwise agreed upon between the competent authorities of the two Governments.

 (2) The Government of the Republic of Sierra Leone shall exempt the JICA Experts, the Japanese Senior Volunteers, members of the Japanese Missions and JOCV from consular fees, taxes including customs duties and fiscal charges, as well as from the requirements of obtaining import license and certificate of foreign exchange coverage, in respect of the importation of the equipment, machinery and materials mentioned in sub-paragraph (1).

 (3) The Government of the Republic of Sierra Leone shall exempt the JICA Experts, the Japanese Senior Volunteers, members of the Japanese Missions and JOCV from taxes including value added tax and fiscal charges in respect of the local purchase of the equipment, machinery and materials mentioned in sub-paragraph (1).

  　シエラレオネ共和国政府は、その指定する機関を通じ、ＪＩＣＡ専門家、日本人シニア海外ボランティア、日本国の調査団の構成員及び協力隊員と密接な連絡を維持する。

Article VIII

 The Government of the Republic of Sierra Leone shall maintain close contact, through organizations designated by it, with the JICA Experts, the Japanese Senior Volunteers, members of the Japanese Missions and JOCV.

　　　　第九条
  １　日本国から派遣され、この協定に基づく技術協力の計画及び青年海外協力隊の事業に関連してＪＩＣＡにより与えられる任務をシエラレオネ共和国において遂行する駐在員、職員並びに日本人シニア海外ボランティア及び協力隊員の調整員（以下それぞれ「ＪＩＣＡ駐在員」、「ＪＩＣＡ職員」及び「ＪＩＣＡ調整員」という。）を置く海外事務所（以下「ＪＩＣＡ事務所」という。）をＪＩＣＡがシエラレオネ共和国において維持することができることが確認される。

Article IX

1. It is confirmed that JICA may maintain its overseas office in the Republic of Sierra Leone (hereinafter referred to as the “JICA Office”) with a resident representative and his/her staff and resident co-ordinators for the Japanese Senior Volunteers and JOCV (hereinafter referred to as the “JICA Representative”, the “JICA Staff” and the “JICA Co-ordinators” respectively) to be dispatched from Japan who perform the duties to be assigned to them by JICA relative to the programs of technical cooperation and the Japan Overseas Cooperation Volunteers Program under this Agreement in the Republic of Sierra Leone.

２　シエラレオネ共和国政府は、次のことを行う。
    (1)(a)　ＪＩＣＡ駐在員、ＪＩＣＡ職員及びＪＩＣＡ調整員に対し、国外から送金される給与及び手当に対して又は当該給与及び手当に関連して課される租税（所得税を含む。）及び課徴金を免除すること。
　　　(b)　ＪＩＣＡ駐在員、ＪＩＣＡ職員及びＪＩＣＡ調整員並びにこれらの者の家族の構成員に対し、次のものの輸入に関し、領事手数料、租税（関税を含む。）及び課徴金並びに輸入許可証及び為替証明書の取得要件を免除すること。
        (i)　携帯荷物
        (ii)　身回品、家財及び消費財
        (iii)　シエラレオネ共和国に派遣されるＪＩＣＡ駐在員一名につき一台、ＪＩＣＡ駐在員の一家族につき一台、ＪＩＣＡ職員一名につき一台、ＪＩＣＡ職員の一家族につき一台、ＪＩＣＡ調整員一名につき一台及びＪＩＣＡ調整員の一家族につき一台の自動車
      (c)　シエラレオネ共和国に自動車を輸入しないＪＩＣＡ駐在員、ＪＩＣＡ職員及びＪＩＣＡ調整員並びにこれらの者の家族に対し、当該ＪＩＣＡ駐在員、ＪＩＣＡ職員及びＪＩＣＡ調整員並びにこれらの者の家族が自動車を現地購入する場合には、ＪＩＣＡ駐在員一名につき一台、ＪＩＣＡ駐在員の一家族につき一台、ＪＩＣＡ職員一名につき一台、ＪＩＣＡ職員の一家族につき一台、ＪＩＣＡ調整員一名につき一台及びＪＩＣＡ調整員の一家族につき一台の自動車に対して課される租税（付加価値税を含む。）及び課徴金を免除すること。
      (d)　ＪＩＣＡ駐在員、ＪＩＣＡ職員及びＪＩＣＡ調整員並びにこれらの者の家族に対し、(b)(iii)及び(c)に規定する自動車の登録料を免除すること。
      (e)　ＪＩＣＡ駐在員、ＪＩＣＡ職員及びＪＩＣＡ調整員並びにこれらの者の家族の構成員に対し、任期中、シエラレオネ共和国に入国し、同国から出国し、及び同国に滞在することを許可し、外国人登録要件に係る手続に関する便宜を与え、並びに領事手数料を免除すること。
      (f)　ＪＩＣＡ駐在員、ＪＩＣＡ職員及びＪＩＣＡ調整員に対し、身分証明書並びにＪＩＣＡ専門家、日本人シニア海外ボランティア、日本国の調査団の構成員及び協力隊員を送迎するために空港及び海港に出入国手続地点を越えて入るための特別通行証を発給すること。
      (g)　ＪＩＣＡ駐在員、ＪＩＣＡ職員及びＪＩＣＡ調整員並びにこれらの者の家族の構成員に対し、自動車運転免許証の取得のための便宜を与えること。
      (h)　ＪＩＣＡ調整員に対し、その任務の遂行に必要な無線通信機の設置及び使用を許可すること。　
      (i)　ＪＩＣＡ駐在員、ＪＩＣＡ職員及びＪＩＣＡ調整員の任務の遂行に必要なその他の措置をとること。

Article IX

2. The Government of the Republic of Sierra Leone shall:

 (1) (a) exempt the JICA Representative, the JICA Staff and the JICA Co-ordinators from taxes including income tax and fiscal charges imposed on or in connection with salaries and any allowances remitted to them from abroad;

 (b) exempt the JICA Representative, the JICA Staff, the JICA Co-ordinators and members of their families from consular fees, taxes including customs duties and fiscal charges, as well as from the requirements of obtaining import license and certificate of foreign exchange coverage, in respect of the importation of:

 (i) luggage;

 (ii) personal effects, household effects and consumer goods; and 

 (iii) one motor vehicle per JICA Representative, per family of the JICA Representative, per JICA Staff, per family of the JICA Staff, per JICA Co-ordinator and per family of the JICA Co-ordinator assigned to stay in the Republic of Sierra Leone;

 (c) exempt the JICA Representative, the JICA Staff, JICA Co-ordinators and their families who do not import any motor vehicle into the Republic of Sierra Leone from taxes including value added tax and fiscal charges in respect of the local purchase of one motor vehicle per JICA Representative, per family of the JICA Representative, per JICA Staff, per family of the JICA Staff, per JICA Co-ordinator and per family of the JICA Co-ordinator;
 
 (d) exempt the JICA Representative, the JICA Staff, the JICA Co-ordinators and their families from the registration fee of the motor vehicles mentioned in (b)(iii) and (c);

 (e) permit the JICA Representative, the JICA Staff, the JICA Co-ordinators and members of their families to enter, leave and sojourn in the Republic of Sierra Leone for the duration of their assignment therein, offer them the convenience for procedures of alien registration requirements, and exempt them from consular fees;

 (f) issue identification cards to the JICA Representative, the JICA Staff and the JICA Co-ordinators and issue special passes to the JICA Representative, the JICA Staff and the JICA Co-ordinators to enter airport/seaport beyond passport control point to receive and send off the JICA Experts, the Japanese Senior Volunteers, members of the Japanese Missions and JOCV;

 (g) offer the JICA Representative, the JICA Staff, the JICA Co-ordinators and members of their families the convenience for acquisition of car driving license; 

 (h) permit the JICA Co-ordinators to install and use radio-communication sets necessary for the performance of their duties; and

 (i) carry out other measures necessary for the performance of the duties of the JICA Representative, the JICA Staff and the JICA Co-ordinators.

   (2)(a)　ＪＩＣＡ事務所に対し、ＪＩＣＡ事務所の活動に必要な設備、機械及び資材（自動車を含む。）の輸入に関し、領事手数料、租税（関税を含む。）及び課徴金並びに輸入許可証及び為替証明書の取得要件を免除すること。
      (b)　ＪＩＣＡ事務所に対し、ＪＩＣＡ事務所の任務の遂行に必要な設備、機械及び資材（自動車を含む。）の現地購入に関し、租税（付加価値税を含む。）及び課徴金を免除すること。
      (c)　ＪＩＣＡ事務所に対し、（a）及び(b)に規定する自動車の登録料を免除すること。
      (d)　ＪＩＣＡ事務所に対し、国外から送金されるＪＩＣＡ事務所の経費に対して又は当該経費に関連して課される租税（所得税を含む。）及び課徴金を免除すること。

Article IX　2.

 (2) (a) exempt the JICA Office from consular fees, taxes including customs duties and fiscal charges, as well as from the requirements of obtaining import license and certificate of foreign exchange coverage, in respect of the importation of the equipment, machinery and materials, including motor vehicles, necessary for activities of the JICA Office;

 (b) exempt the JICA Office from taxes including value added tax and fiscal charges in respect of the local purchase of the equipment, machinery and materials, including motor vehicles, necessary for the functions of the JICA Office; 

 (c) exempt the JICA Office from the registration fee of the motor vehicles mentioned in (a) and (b); and

 (d) exempt the JICA Office from taxes including income tax and fiscal charges imposed on or in connection with office expenses remitted from abroad.

  ３　２に規定する自動車が、その後シエラレオネ共和国内において、租税（関税を含む。）の免除又は同様の特権を受ける権利を有しない個人又は団体に売却され、又は譲渡される場合には、当該自動車に対して当該租税が課される。

Article IX

3. The motor vehicles mentioned in paragraph 2 shall be subject to payment of taxes including customs duties if they are subsequently sold or transferred within the Republic of Sierra Leone to individuals or organizations not entitled to exemption from such taxes or similar privileges.

  ４　シエラレオネ共和国政府は、ＪＩＣＡ駐在員、ＪＩＣＡ職員及びＪＩＣＡ調整員並びにこれらの者の家族の構成員並びにＪＩＣＡ事務所に対し、シエラレオネ共和国において同様の任務を遂行しているいかなる第三国又は国際機関の駐在員、職員及び調整員並びにこれらの者の家族の構成員並びに事務所に与えられているものよりも不利でない特権、免除及び便宜を与える。

Article IX

4. The Government of the Republic of Sierra Leone shall accord the JICA Representative, the JICA Staff, the JICA Co-ordinators and members of their families as well as the JICA Office such privileges, exemptions and benefits as are no less favorable than those accorded to representatives, staff, co-ordinators and members of their families as well as offices of any third country or of any international organization performing a similar mission in the Republic of Sierra Leone.

  　シエラレオネ共和国政府は、シエラレオネ共和国に滞在中のＪＩＣＡ専門家、日本人シニア海外ボランティア、日本国の調査団の構成員、ＪＩＣＡ駐在員、ＪＩＣＡ職員及びＪＩＣＡ調整員並びにこれらの者の家族の構成員並びに協力隊員の安全を確保するために必要な措置をとる。

Article X

 The Government of the Republic of Sierra Leone shall take necessary measures to ensure security of the JICA Experts, the Japanese Senior Volunteers, members of the Japanese Missions, the JICA Representative, the JICA Staff, the JICA Co-ordinators and members of their families as well as JOCV, staying in the Republic of Sierra Leone.

  　両政府は、この協定から又はこの協定に関連して生ずることのあるいかなる事項についても相互に協議する。

Article XI

 The two Governments shall consult with each other in respect of any matter that may arise from or in connection with this Agreement.

    　　　　第十二条
  １　この協定の規定は、この協定の効力発生の後、この協定の効力発生の前に開始した技術協力の個別の計画にも適用され、かつ、シエラレオネ共和国に滞在中のＪＩＣＡ専門家、日本人シニア海外ボランティア、日本国の調査団の構成員、ＪＩＣＡ駐在員、ＪＩＣＡ職員及びＪＩＣＡ調整員並びにこれらの者の家族の構成員であって当該計画に関連するもの並びに当該計画に関連する設備、機械及び資材にも適用される。
  ２　この協定の終了は、両政府間の相互の同意により別段の決定が行われる場合を除くほか、実施中の技術協力の個別の計画及び青年海外協力隊の事業が完了する日までの間当該計画及び当該事業に影響を及ぼすものではなく、また、当該計画及び当該事業に関連する自己の任務を遂行するためにシエラレオネ共和国に滞在中のＪＩＣＡ専門家、日本人シニア海外ボランティア、日本国の調査団の構成員、ＪＩＣＡ駐在員、ＪＩＣＡ職員及びＪＩＣＡ調整員並びにこれらの者の家族の構成員並びに協力隊員に与えられる特権、免除及び便宜に影響を及ぼすものでもない。

Article XII

1. The provisions of this Agreement shall also apply, after the entering into force of this Agreement, to the specific programs of technical cooperation which have commenced prior to the entering into force of this Agreement, and to the JICA Experts, the Japanese Senior Volunteers, members of the Japanese Missions, the JICA Representative, the JICA Staff, the JICA Co-ordinators and members of their families, staying in the Republic of Sierra Leone as well as to the equipment, machinery and materials, related to the said programs.
 
2. The termination of this Agreement shall neither affect the specific programs of technical cooperation and the Japan Overseas Cooperation Volunteers Program being carried out until the date of the completion of the said programs, unless otherwise decided upon by mutual consent between the two Governments, nor affect the privileges, exemptions and benefits accorded to the JICA Experts, the Japanese Senior Volunteers, members of the Japanese Missions, the JICA Representative, the JICA Staff, the JICA Co-ordinators and members of their families as well as JOCV, staying in the Republic of Sierra Leone for the performance of their duties in connection with the said programs.

  　　　　第十三条
  １　この協定は、署名の日に効力を生ずる。
  ２　この協定は、一年間効力を有するものとし、いずれか一方の政府が他方の政府に対しこの協定を終了させる意思を書面により少なくとも六箇月の予告をもって通告しない限り、毎年自動的に一年ずつ更新される。

Article XIII

1. This Agreement shall enter into force on the date of the signature thereof.

2. This Agreement shall remain in force for a period of one year, and shall be automatically renewed every year for another period of one year each, unless either Government has given to the other Government at least six months’ written advance notice of its intention to terminate this Agreement.
