技術協力に関する日本国政府と東南アジア諸国連合との間の協定第六条の規定に基づく特権、免除及び便宜に関する日本国政府とフィリピン共和国政府との間の交換公文

 書簡をもって啓上いたします。本使は、二千十九年五月十三日に東京で署名された技術協力に関する日本国政府と東南アジア諸国連合との間の協定（以下「日本・ＡＳＥＡＮ協定」という。）第六条に言及するとともに、日本国政府の代表者とフィリピン共和国政府の代表者との間で到達した次の了解を日本国政府に代わって確認する光栄を有します。




１　ＪＩＣＡが日本・ＡＳＥＡＮ協定に基づきＪＩＣＡ専門家又は日本国の調査団をフィリピン共和国に所在するＡＳＥＡＮ施設に派遣する場合には、フィリピン共和国政府は、二千六年四月四日に東京で署名された技術協力に関する日本国政府とフィリピン共和国政府との間の協定（以下「日本・フィリピン協定」という。）第六条、第七条及び第十二条の規定をフィリピン共和国に滞在中の当該ＪＩＣＡ専門家及び当該日本国の調査団の構成員並びにこれらの者の家族の構成員について準用する。




２　ＪＩＣＡ、ＪＩＣＡ専門家又は日本国の調査団が日本・ＡＳＥＡＮ協定に基づきフィリピン共和国に所在するＡＳＥＡＮ施設に対して設備、機械及び資材を供与する場合には、フィリピン共和国政府は、日本・フィリピン協定第九条の規定を当該設備、機械及び資材について準用する。




  本使は、更に、この書簡及び前記の了解をフィリピン共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成するとともに、その合意が閣下の返簡の日に効力を生ずることを提案する光栄を有します。

  本大臣は、更に、フィリピン共和国政府が前記の了解を受諾し得るものであることから、閣下の書簡及びこの返簡が両政府間の合意を構成するとともに、その合意がこの返簡の日に効力を生ずることを確認する光栄を有します。

Manila, July 23, 2019
				        
Excellency,

	I have the honor to refer to Article VI of the Agreement on Technical Cooperation between the Government of Japan and the Association of Southeast Asian Nations signed at Tokyo on May 13, 2019 (hereinafter referred to as the “Japan-ASEAN Agreement”) and to confirm, on behalf of the Government of Japan, the following understanding reached between the representatives of the Government of Japan and the Government of the Republic of the Philippines:

1.  In the event that JICA dispatches the JICA Experts or the Japanese Missions to ASEAN facilities in the Republic of the Philippines under the Japan-ASEAN Agreement, the Government of the Republic of the Philippines shall apply Articles VI, VII and XII of the Agreement on Technical Cooperation between the Government of Japan and the Government of the Republic of the Philippines signed at Tokyo on April 4, 2006 (hereinafter referred to as the “Japan-Philippines Agreement”), mutatis mutandis, to the JICA Experts, the members of the Japanese Missions and the members of their families, staying in the Republic of the Philippines.

2.　In the event that JICA, the JICA Expert or the Japanese Mission provides with equipment, machinery and materials ASEAN facilities in the Republic of the Philippines under the Japan-ASEAN Agreement, the Government of the Republic of the Philippines shall apply Article IX of the Japan-Philippines Agreement, mutatis mutandis, to such equipment, machinery and materials. 

　I have further the honor to propose that this Note and Your Excellency’s Note in reply confirming on behalf of the Government of the Republic of the Philippines the foregoing understanding shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply. 

　I avail myself of this opportunity to renew to Your Excellency the assurances of my highest consideration.
