航空業務に関する日本国とネパール王国との間の協定の付表の改正に関する交換公文

(Japanese Note)Kathmandu, January 9, 2019
（訳文）書簡をもって啓上いたします。本大臣は、千九百九十三年二月十七日にカトマンズで署名された航空業務に関する日本国とネパール王国との間の協定（以下「協定」という。）に関し二千十八年六月十八日に東京において日本国及びネパールの航空当局の間で行われた協議に言及するとともに、別添の修正された付表が協定の現行の付表に代わることを提案する光栄を有します。
Excellency, I have the honour to refer to the consultations held in Tokyo on 18 June 2018 between the aeronautical authorities of Japan and Nepal concerning the Agreement between Japan and the Kingdom of Nepal for Air Services signed at Kathmandu on 17 February 1993 (hereinafter referred to as "the Agreement"), and to propose that the revised Schedule as set out in the Attachment shall replace the existing Schedule to the Agreement.
本大臣は、更に、前記の提案がネパール政府にとって受諾し得るものであるときは、この書簡及びその旨の閣下の返簡が両国政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。
I have further the honour to propose that if the above proposal is acceptable to the Government of Nepal, this Note and Your Excellency’s Note in reply to that effect shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply.

SCHEDULE
１ 日本国の一又は二以上の指定航空企業が両方向に運営する路線
1. Routes to be operated in both directions by the designated airline or airlines of Japan:
日本国内の地点－後に特定される中間の二地点－ネパール内の地点－後に特定される以遠の二地点
Points in Japan – two intermediate points to be specified later – points in Nepal – two points beyond to be specified later
注 日本国の一又は二以上の指定航空企業は、「後に特定される中間の二地点」とカトマンズとの間を除くほか、特定路線上で第五の自由の運輸権を行使することができない。
Note: The designated airline or airlines of Japan may not exercise fifth freedom traffic rights on the specified route except between the “two intermediate points to be specified later” and Kathmandu.
２ ネパールの一又は二以上の指定航空企業が両方向に運営する路線
2. Routes to be operated in both directions by the designated airline or airlines of Nepal:
ネパール内の地点－香港及び（又は）上海－日本国内の地点－後に特定される以遠の二地点（アメリカ合衆国内の地点を除く。）
Points in Nepal – Hong Kong and/or Shanghai – points in Japan – two points beyond, excluding points in the United States of America, to be specified later
注 ネパールの一又は二以上の指定航空企業は、香港と大阪との間を除くほか、特定路線上で第五の自由の運輸権を行使することができない。
Note: The designated airline or airlines of Nepal may not exercise fifth freedom traffic rights on the specified route except between Hong Kong and Osaka.
３ いずれの締約国の一又は二以上の指定航空企業が提供する協定業務も、当該締約国の領域内の一地点をその起点としなければならないが、特定路線上の他の地点は、いずれかの又は全ての飛行に当たり当該指定航空企業の選択によって省略することができる。
3. The agreed services provided by the designated airline or airlines of either Contracting Party shall begin at a point in the territory of that Contracting Party, but other points on the specified route may at the option of the designated airline or airlines be omitted on any or all flights.

Excellency, I have the honour to refer to Your Excellency's Note of today's date, which reads as follows:

本大臣は、更に、ネパール政府が日本国政府の前記の提案を受諾する旨を閣下に通報するとともに、閣下の書簡及びこの返簡が両国政府間の合意を構成し、その合意がこの返簡の日付の日に効力を生ずることを確認する光栄を有します。
I have further the honour to inform Your Excellency that the Government of Nepal accepts the above proposal of the Government of Japan and to confirm that Your Excellency's Note and this Note in reply shall constitute an agreement between the two Governments, which shall enter into force on the date of this Note in reply.
