航空業務に関する日本国とラオス人民民主共和国との間の協定の付表の改正に関する交換公文

（日本側書簡）

(Japanese Note)Tokyo, May 30, 2019

（訳文）書簡をもって啓上いたします。本使は、二千十五年一月十六日にビエンチャンで署名された航空業務に関する日本国とラオス人民民主共和国との間の協定（以下「協定」という。）に関し二千十七年三月二十二日及び二十三日にビエンチャンにおいて日本国及びラオス人民民主共和国の航空当局の間で行われた協議に言及するとともに、別添の修正された付表が協定の現行の付表に代わることを提案する光栄を有します。

Excellency, I have the honour to refer to the consultations held in Vientiane on 22 and 23 March 2017 between the aeronautical authorities of Japan and the Lao People’s Democratic Republic concerning the Agreement between Japan and the Lao People’s Democratic Republic for Air Services signed at Vientiane on 16 January 2015 (hereinafter referred to as “the Agreement”), and to propose that the revised Schedule as set out in the Attachment shall replace the existing Schedule to the Agreement.

本使は、更に、前記の提案がラオス人民民主共和国政府にとって受諾し得るものであるときは、この書簡及びその旨の閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。

I have further the honour to propose that if the above proposal is acceptable to the Government of the Lao People’s Democratic Republic, this Note and Your Excellency’s Note in reply to that effect shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply.

SCHEDULE

１　日本国の一又は二以上の指定航空企業が両方向に運営する路線

1. Routes to be operated in both directions by the designated airline or airlines of Japan:

（ａ）　日本国内の地点－ラオス人民民主共和国内の地点

(a) Points in Japan – points in the Lao People’s Democratic Republic.

（ｂ）　東京－東南アジア諸国連合の構成国内の地点－ラオス人民民主共和国内の地点

(b) Tokyo – points in Member States of the Association of Southeast Asian Nations - points in the Lao People’s Democratic Republic.

（ｃ）　東京以外の日本国内の地点－中間の地点－ラオス人民民主共和国内の地点－以遠の地点

(c) Points in Japan other than Tokyo – intermediate points – points in the Lao People’s Democratic Republic – points beyond.

（ｄ）　日本国内の地点－中間の地点－ラオス人民民主共和国内の地点－以遠の地点

(d) Points in Japan – intermediate points – points in the Lao People’s Democratic Republic – points beyond.

注１　日本国の一又は二以上の指定航空企業は、路線（ａ）においてラオス人民民主共和国内のいずれの地点もコターミナル地点として使用することができる。

Note 1: On Route (a), the designated airline or airlines of Japan may use any points in the Lao People's Democratic Republic as co-terminal points.

注２　日本国の一又は二以上の指定航空企業は、自己が運送する途中降機の貨客を除くほか、第五の自由の運輸権を行使することなく、航空機を運航しない航空企業としてのコードシェア業務のためにのみ路線（ｄ）において業務を行うことができる。

Note 2: Route (d) may be served by the designated airline or airlines of Japan only for code sharing services as a marketing airline or airlines without exercising fifth freedom traffic rights, except for its or their own stopover traffic.

２　ラオス人民民主共和国の一又は二以上の指定航空企業が両方向に運営する路線

Democratic Republic:

（ａ）　ラオス人民民主共和国内の地点－日本国内の地点

(a) Points in the Lao People’s Democratic Republic – points in Japan.

（ｂ）　ラオス人民民主共和国内の地点－東南アジア諸国連合の構成国内の地点－東京

(b) Points in the Lao People’s Democratic Republic – points in Member States of the Association of Southeast Asian Nations – Tokyo.

（ｃ）　ラオス人民民主共和国内の地点－中間の地点－東京以外の日本国内の地点－以遠の地点

(c) Points in the Lao People’s Democratic Republic – intermediate points – points in Japan other than Tokyo – points beyond.

注１　ラオス人民民主共和国の一又は二以上の指定航空企業は、路線（ａ）において日本国内のいずれの地点もコターミナル地点として使用することができる。

３　いずれの締約国の一又は二以上の指定航空企業が提供する協定業務も、当該締約国の領域内の一地点をその起点としなければならないが、特定路線上の他の地点は、いずれかの又は全ての飛行に当たり当該指定航空企業の選択によって省略することができる。

3. The agreed services provided by the designated airline or airlines of either Contracting Party shall begin at a point in the territory of that Contracting Party, but other points on the specified route may at the option of the designated airline or airlines be omitted on any or all flights.

（訳文）書簡をもって啓上いたします。本使は、本日付けの閣下の次の書簡に言及する光栄を有します。

Excellency, I have the honour to refer to Your Excellency’s Note of today’s date, which reads as follows:

本使は、更に、ラオス人民民主共和国政府が日本国政府の前記の提案を受諾する旨を閣下に通報するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成し、その合意がこの返簡の日付の日に効力を生ずることを確認する光栄を有します。

I have further the honour to inform Your Excellency that the Government of the Lao People’s Democratic Republic accepts the above proposal of the Government of Japan and to confirm that Your Excellency’s Note and this Note in reply shall constitute an agreement between the two Governments, which shall enter into force on the date of this Note in reply.
