PROTOCOL AMENDING THE AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE COMMONWEALTH OF THE BAHAMAS FOR THE EXCHANGE OF INFORMATION FOR THE PURPOSE OF THE PREVENTION OF FISCAL EVASION AND THE ALLOCATION OF RIGHTS OF TAXATION WITH RESPECT TO INCOME OF INDIVIDUALS
日本国政府及びバハマ国政府は、
The Government of Japan and the Government of the Commonwealth of The Bahamas,
二千十一年一月二十七口にナッソーで署名された脱税の防止のための情報の交換及び個人の所得についての課税権の配分に関する日本国政府とバハマ国政府との間の協定(以下「協定」という。)を改正することを希望して、
Desiring to amend the Agreement between the Government of Japan and the Government of the Commonwealth of The Bahamas for the Exchange of Information for the Purpose of the Prevention of Fiscal Evasion and the Allocation of Rights of Taxation with respect to Income of Individuals, signed at Nassau on 27th January, 2011 (hereinafter referred to as “the Agreement”),
次のとおり協定した。
Have agreed as follows:
第一条 協定第•五条の次に次の一条を加える。 第五条のA 自動的な情報の交換 両締約国の権限のある当局は、両締約国の権限のある当局の間の合意によって決定する区分の事案に関しては、その合意によって決定する手続に従い、第二条に規定する目的のため、情報を自動的に交換する。
ARTICLE I The following new ARTICLE shall be inserted immediately after ARTICLE 5 of the Agreement: “ARTICLE 5A AUTOMATIC EXCHANGE OF INFORMATION With respect to categories of cases and in accordance with procedures which the competent authorities of the Contracting Parties shall determine by mutual agreement, they shall automatically exchange information for the purposes referred to in ARTICLE 2.”
第二条 協定第三条を次のように改める。 第三条 管轄一方の締約国は、その当局によって保有されておらず、かつ、その領域的管轄内にある者によって保有され、又は管理されていない情報については、それを提供する義務を負わない。
ARTICLE II ARTICLE 3 of the Agreement shall be deleted and replaced by the following: “ARTICLE 3 JURISDICTION A Contracting Party is not obligated to provide information which is neither held by its authorities nor in the possession or control of persons who are within its territorial jurisdiction.”
第三条 協定第八条第四文を次のように改める。 当該情報は、情報を提供する締約国の権限のある当局の書面による明示の同意がない場合には、他の者又は当局(非締約国内にあるものを含む。)に開示することができない。
ARTICLE III ARTICLE 8 of the Agreement shall be amended by deleting the last sentence and replacing it with the following sentence: “The information may not be disclosed to any other person or authority, including those in nonContracting Parties, without the express written consent of the competent authority of the Contracting Party providing the information.”
第四条 協定第十八条3の次に次の4を加える。 ４ ２の規定にかかわらず、第五条のAの規定は、次のものについて適用する。 (a) 課税年度に基づいて課される租税に関しては、二千十七年一月一日以後に開始する各課税年度の租税 (b) 課税年度に基づかないで課される租税に関しては、二千十七年一月一日以後に課される租税
ARTICLE IV The following new paragraph shall be inserted immediately after paragraph 3 of ARTICLE 18 of the Agreement: “4. Notwithstanding paragraph 2, ARTICLE 5A shall be applicable: (a) with respect to taxes levied on the basis of a taxable year, for taxes for any taxable years beginning on or after 1 January 2017; and (b) with respect to taxes not levied on the basis of a taxable year, for taxes levied on or after 1 January 2017.”
第五条 １ この議定書は、両締約国のそれぞれの法令上の手続に従って承認されなければならない。この議定書は、その承認を通知する外交上の公文の交換の日の後三十日目の日に効力を生ずる。 ２ 協定の不可分の一部を成すこの議定書は、協定が有効である限り効力を有する。
ARTICLE V 1. This Protocol shall be approved in accordance with the legal procedures of each of the Contracting Parties and shall enter into force on the thirtieth day after the date of exchange of diplomatic notes indicating such approval. 2. This Protocol, which shall form an integral part of the Agreement, shall remain in force as long as the Agreement remains in force.
以上の証拠として、下名は、各自の政府から正当に委任を受けてこの議定書に署名した。 二千十七年二月九日にナッソーで、ひとしく正文である日本語及び英語により本書二通を作成した。
IN WITNESS WHEREOF the undersigned, being duly authorised thereto by their respective Governments, have signed this Protocol. DONE in duplicate at Nassau this ninth day of February, 2017, in the Japanese and English languages, each text being equally authentic.
