AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF HUNGARY REGARDING A WORKING HOLIDAY SCHEME

      ワーキング・ホリデー制度に関する日本国政府とハンガリー政府との間の協定
      
    日本国政府及びハンガリー政府（以下それぞれ「締約国政府」という。）（以下「両締約国政府」と総称する。）は、
    両国の間の一層緊密な協力関係を促進するとの精神の下に、
    両国の間の相互理解を促進することを目的としてそれぞれの国民、特に青少年に対し、他方の国の文化及び一般的な生活様式を正当に理解するための一層広範な機会を提供することを希望して、
    次のとおり協定した。
AGREEMENT BETWEEN
THE GOVERNMENT OF JAPAN AND
THE GOVERNMENT OF HUNGARY
REGARDING A WORKING HOLIDAY SCHEME



 The Government of Japan and the Government of Hungary (hereinafter referred to collectively as the “Parties” and individually as the “Party”),

 In a spirit of promoting closer co-operative relationship between the two countries, and

 Desirous of providing wider opportunities for their nationals, particularly the youth, to appreciate the culture and general way of life of the other country for the purpose of promoting mutual understanding between the two countries, 

 Have agreed as follows:

第一条
    日本国政府は、ハンガリーに居住する同国国民が次の(a)から(i)までに掲げる要件を全て満たす場合において、適当と認めるときは、当該国民に対し、ワーキング・ホリデー査証を無償で発給する。
    (a)　主として休暇を過ごすために日本国に入国する意図を有すること。
    (b)　当該査証の申請時の年齢が十八歳以上三十歳以下であること。
    (c)　被扶養者を同伴しないこと（被扶養者が日本国政府から発給された当該査証又はその他の査証を所持する場合を除く。）。
    (d)　少なくとも予定される滞在の間有効な旅券及び帰国のための旅行切符又はそのような切符を購入するための十分な資金を所持すること。
    (e)　日本国における滞在の当初の期間生計を維持するための相当な資金を所持すること。
    (f)　滞在終了時に日本国を出国する意図を有し、かつ、滞在の間ワーキング・ホリデー制度の参加者としての在留資格を変更しないこと。
    (g)　以前にワーキング・ホリデー査証の発給を日本国政府から受けていないこと。
    (h)　健康であること及び犯罪経歴を有しないこと。
    (i)　滞在の間、日本国において効力を有する法令を遵守する意図を有すること。
Article 1

 The Government of Japan shall issue, free of charge, to a national of Hungary residing in Hungary a working holiday visa if such national meets all of the following requirements and that the Government of Japan deems appropriate:

 (a) intending to enter Japan primarily for the purpose of spending holidays;

 (b) being between eighteen (18) and thirty (30) years of age, both inclusive, at the time of application for the said visa;

 (c) not being accompanied by dependants except for those in possession of the said visa or other visas issued by the Government of Japan;

 (d) possessing a passport valid for at least the intended period of his or her stay, and a return travel ticket or sufficient funds with which to purchase such ticket;

 (e) possessing reasonable funds for the maintenance of his or her stay in Japan during the initial period of the stay; 

 
 (f) intending to leave Japan at the end of his or her stay and not altering his or her status of residence as a participant of the Working Holiday Scheme during the stay;

 (g) not having previously been issued a working holiday visa by the Government of Japan; 

 (h) being in good health and having no criminal record; and

 (i) intending to comply with the laws and regulations in force in Japan during his or her stay.

第二条
    ハンガリー政府は、次の(a)又は(b)に規定する日本国民の申請に基づき、
    (a)　査証なしで既にハンガリーの領域に入国している者（この場合において、一時滞在許可証の申請者は、全世界のハンガリーの外交代表又は同国にある移民難民局に対してその取得可能性について事前に照会を行っていることが望ましい。）
Article 2

 The Government of Hungary shall, on application by a national of Japan who:

 (a) has already entered the territory of Hungary visa-free (in which case the applicant is advised to make a preliminary inquiry to any Hungarian diplomatic representation in the world or the Immigration and Asylum Office in Hungary on the availability of the temporary residence permit) or;

(b)　一時滞在許可証を受け取るための資格をその所持者に与える査証であって、在日本国ハンガリー大使館において申請されたものを有する者
　当該日本国民が次の(i)から(ix)までに掲げる要件の全てを満たすときは、当該日本国民に対し、数次入国につ　いて有効であり、かつ、発給の日から一年間ハンガリーで有効である一時滞在許可証を無償で発給する。
    　(i)　主として休暇を過ごすためにハンガリーに入国する意図を有すること。
      (ii)　当該一時滞在許可証の申請時の年齢が十八歳以上三十歳以下であること。
      (iii)　被扶養者を同伴しないこと（被扶養者がハンガリー政府から発給された一時滞在許可証又はその他の査証を所持する場合を除く。）。
      (iv)　少なくとも予定される滞在の間効力を有する有効な旅券及び帰国のための旅行切符又はそのような切符を購入するための十分な資金を所持すること。
      (v)　ハンガリーにおける滞在の当初の期間生計を維持するための相当な資金を所持すること。
      (vi)　滞在終了時にハンガリーを出国する意図を有し、かつ、滞在の間ワーキング・ホリデー制度の参加者としての在留資格を変更しないこと。
      (vii)　以前に一時滞在許可証の発給をハンガリー政府から受けていないこと。
      (viii)　健康であること及び犯罪経歴を有しないこと。
      (ix)　滞在の間、ハンガリーにおいて効力を有する法令を遵守する意図を有すること。
(b) has a visa entitling its holder to collect the temporary residence permit applied for at the Embassy of Hungary in Japan;

issue a temporary residence permit, free of charge, valid for multiple entries and valid in Hungary for a period of one (1) year from the date of issuance, to any person who satisfies all of the following requirements:

  (i) intending to enter Hungary primarily for the purpose of spending holidays;

  (ii) being between eighteen (18) and thirty (30) years of age, both inclusive, at the time of application for the said temporary residence permit;

  (iii) not being accompanied by dependants except for those in possession of a temporary residence permit or other visas issued by the Government of Hungary;

 
  (iv) possessing a valid passport valid for at least the intended period of stay and a return travel ticket or sufficient funds with which to purchase such ticket;

  (v) possessing reasonable funds for the maintenance of his or her stay in Hungary during the initial period of the stay;

  (vi) intending to leave Hungary at the end of his or her stay and not altering his or her status of residence as a participant of the Working Holiday Scheme during the stay;

  (vii) not having previously been issued a temporary residence permit by the Government of Hungary; 

  (viii) being in good health and having no criminal record; and

  (ix) intending to comply with the laws and regulations in force in Hungary during his or her stay.

第三条
  １　日本国政府は、ハンガリー国民に対し、在ハンガリー日本国大使館において、第一条に規定する査証を申請することを許可する。必要な場合には、申請者は、資格を決定するために同大使館の代表者による面接を受ける。
Article 3

1. The Government of Japan shall permit a national of Hungary to apply for the visa mentioned in Article 1 at the Embassy of Japan in Hungary.  When necessary, the applicant will be interviewed by the representative of the Embassy of Japan in Hungary to determine his or her eligibility.

２　ハンガリー政府は、日本国民に対し、前条に規定する一時滞在許可証を受け取るための資格をその所持者に与える査証又は一時滞在許可証を申請することを許可する。必要な場合には、申請者は、資格を決定するために在日本国ハンガリー大使館の代表者又はハンガリーにある移民難民局地方事務所の職員による面接を受ける。
2. The Government of Hungary shall permit a national of Japan to apply for a visa entitling its holder to collect a temporary residence permit or a temporary resident permit mentioned in Article 2.  When necessary, the applicant will be interviewed by the representative of the Embassy of Hungary in Japan or an official of the Regional Directorate of the Immigration and Asylum Office in Hungary to determine his or her eligibility.

第四条
  １　日本国政府は、日本国の有効なワーキング・ホリデー査証を所持するハンガリー国民に対し、入国の日から一年までの期間、日本国における滞在を許可する。
Article 4

1. The Government of Japan shall permit the national of Hungary who possesses valid working holiday visa of Japan to stay in Japan for a period of up to one (1) year from the date of entry.

２　第二条(a)に規定する日本国民であって、査証なしでハンガリーの領域に入国し、一時滞在許可証を発給されたものは、当該許可証の発給の日から一年までの期間、ハンガリー政府によって同国における滞在を許可される。同条(b)に規定する日本国民であって、一時滞在許可証を受け取るための資格をその所持者に与える査証を発給されたものは、ハンガリーに到着した後三十日以内に同国にある移民難民局地方事務所で一時滞在許可証を無償で受領する。当該同条(b)に規定する日本国民は、当該許可証の発給の日から一年までの期間、ハンガリー政府によってハンガリーにおける滞在を許可される。
2. Any national of Japan who has entered the territory of Hungary visa-free and who have been issued a temporary residence permit mentioned in paragraph (a) of Article 2, shall be permitted by the Government of Hungary to stay in Hungary for a period up to one (1) year from the date of issuance of the said permit.  Any national of Japan who has been issued a visa entitling its holder to collect the temporary residence permit mentioned in paragraph (b) of Article 2, will receive, free of charge, a temporary residence permit at the Regional Directorate of the Immigration and Asylum Office in Hungary within thirty (30) days after his or her arrival in Hungary.  Such national of Japan shall be permitted by the Government of Hungary to stay in Hungary for a period of up to one (1) year from the date of issuance of the said permit.

３　各締約国政府は、それぞれの国において効力を有する法令に従い、１又は２に規定する他方の国の国民に対し、旅行資金を補うために休暇の付随的な活動として就労許可証なしに就労することを認める。
3. Each Party shall allow the national of the other country as referred to in paragraph 1 or 2 above to engage in employment without work permit as an incidental activity of his or her holidays for the purpose of supplementing his or her travel funds in accordance with the laws and regulations in force in each country.

第五条
    各締約国政府は、他方の国の国民に対し発給する第一条に規定する査証又は他方の国の国民に対し発給する第二条に規定する一時滞在許可証の数を毎年決定し、他方の締約国政府に対し、この数を外交上の経路を通じて通報する。
Article 5

 Each Party shall determine annually the number of the visas mentioned in Article 1 or temporary residence permits mentioned in Article 2 to be issued for nationals of the other country and shall notify the other Party of such number through diplomatic channels.

第六条
    いずれか一方の国の国民であって、ワーキング・ホリデー制度の参加者として他方の国に入国したものは、滞在の間、当該他方の国において効力を有する法令に従う。
Article 6

 Nationals of either country who have entered the other country as participants of the Working Holiday Scheme shall comply with the laws and regulations in force in that other country during their stay.

第七条
    この協定の規定は、それぞれの国において効力を有する法令に従って実施される。
Article 7

 The provisions of this Agreement shall be implemented in accordance with the laws and regulations in force in the respective countries.

第八条
  １　いずれの締約国政府も、他方の締約国政府に対し、この協定の効力発生のために必要な国内手続の完了を書面により通報する。この協定は、それらの通報が受領された日のうちいずれか遅い方の日の後三十日目の日に効力を生ずる。
Article 8

1. The Parties shall notify each other, in writing, of the completion of their respective internal procedures necessary for the entry into force of this Agreement.  The Agreement shall enter into force on the thirtieth day after the latter of the dates of receipt of the notifications.

２　この協定の解釈に関するいかなる紛争も、両締約国政府により、外交上の経路を通じて解決される。
2. Any dispute regarding the interpretation of this Agreement shall be resolved by the Parties through diplomatic channels.

３　この協定の改正については、いつでも両締約国政府間で交渉することができる。これらの改正は、書面により行われる。この協定の条項については、いつでも外交上の経路を通じた両締約国政府間の協議の対象とすることができる。
3. Amendments to this Agreement may be negotiated between the Parties at any time.  These amendments shall be concluded in a written form.  The provisions of this Agreement may, at any time, be subject to consultations between the Parties through diplomatic channels.

４　いずれの締約国政府も、前記の規定の全部又は一部の実施を公の政策上の理由により一時的に停止することができる。このような停止は、外交上の経路を通じて他方の締約国政府に直ちに通告される。
4. Either Party may suspend the implementation of the foregoing provisions, in whole or in part, temporarily for reasons of public policy.  Any such suspension shall be notified immediately to the other Party through diplomatic channels.

５　いずれの締約国政府も、三箇月前までに他方の締約国政府に対して書面により通告することにより、この協定を終了させることができる。
5. Either Party may terminate this Agreement by giving three (3) months written notice to the other Party.

６　この協定の終了又はこの協定のいかなる規定の実施の停止の後においても、両締約国政府が外交上の経路を通じて別段の決定をする場合を除くほか、各締約国政府は、その終了又は停止の日において第一条に規定する有効な査証又は第二条に規定する一時滞在許可証を発給されている他方の国の国民の入国又は滞在の希望について好意的な考慮を払う。
6. Notwithstanding the termination of this Agreement or suspension of the implementation of any provisions of this Agreement, unless otherwise decided by the Parties through diplomatic channels, each Party shall afford favourable consideration to the request for entry or stay of any national of the other country who, at the date of such termination or suspension, has been issued a valid visa mentioned in Article 1 or the temporary residence permit mentioned in Article 2.

以上の証拠として、下名は、各自の政府から正当に委任を受けてこの協定に署名した。
