国際連合工業開発機関投資技術促進事務所のための拠出金に関する日本国政府と国際連合工業開発機関との間の交換公文
（国際連合工業開発機関投資技術促進事務所のための拠出に関する日本国政府と国際連合工業開発機関との間の交換公文） （日本側書簡） （訳文） 書簡をもって啓上いたします。本使は、開発途上国における工業投資の促進のための国際連合工業開発機関（以下「ＵＮＩＤＯ」という。）工業投資促進事務所（以下「事務所」という。）のための日本国政府の拠出に関して二千十三年十二月十一日にウィーンで行われた日本国政府の代表者とＵＮＩＤＯの代表者との間の交換公文に言及するとともに、事務所を日本国に設置して行うＵＮＩＤＯの世界的規模の事業（以下「事業」という。）の期間が二千十六年十二月三十一日に終了することを考慮して、事業に関する次の取極を日本国政府に代わって提案する光栄を有します。
(Japanese Note) Vienna, 16 December, 2016 Excellency, I have the honour to refer to the Exchange of Notes between the representatives of the Government of Japan and of the United Nations Industrial Development Organization (hereinafter referred to as “UNIDO”) done at Vienna on 11 December 2013 concerning the contribution of the Government of Japan for the UNIDO Service for the Promotion of Industrial Investment in Developing Countries (hereinafter referred to as “the Service”) and, taking into account that the global project of UNIDO for the establishment in Japan of the Service (hereinafter referred to as “the Project”) terminates on 31 December 2016, to propose on behalf of the Government of Japan the following arrangements in respect of the Project:
１ 事業は、工業協力の分野において、投資事業の促進及び投資事業に関連する技術の移転についての日本国と開発途上国との間の協力を強化することを目的とする。この目的は、開発途上国の包摂的かつ持続可能な工業開発のための国際連合の機関であるＵＮＩＤＯと日本国の企業との緊密なかつ信頼のある接触によって推進される。
1. The objective of the Project is to strengthen the cooperation between Japan and the developing countries in the area of industrial cooperation, in the promotion of investment projects and the related transfer of technology. This objective will be furthered by close and trustful contacts between UNIDO as the UN organization for the inclusive and sustainable industrial development of developing countries and Japanese enterprises.
２ この取極の対象となる事業の期間は、二千十七年一月一日から二千二十二年十二月三十一日までとする。この取極の適用上、一年目は二千十七年一月一日から十二月三十一日まで、その後の各年は各暦年の一月一日から十二月三十一日までとする。
2. The duration of the Project covered by the present arrangements shall be from 1 January 2017 to 31 December 2022. For the purpose of the present arrangements, the first year shall be from 1 January to 31 December 2017, each subsequent year shall be from 1 January to 31 December of the respective calendar year.
３ 事務所は、投資技術促進事務所（以下「ＩＴＰＯ」という。）の名称の下にその任務を遂行する。事業は、ＩＴＰＯにより引き続き実施される。
3. The Service shall discharge its functions under the name of Investment and Technology Promotion Office (hereinafter referred to as “the ITPO”) and the Project will continue to be implemented by the ITPO.
４ 日本国政府は、日本国において施行される法令及び利用可能な予算に従い、事業に要する経費を負担するため、ＵＮＩＤＯに対し、その工業開発基金に対する目的指定拠出を日本円で行う。一年目の拠出の額については、一億九千万円（一九○、○○○、○○○円）とする。その後の各年の拠出については、日本国において施行される法令及び利用可能な予算に従って行う。
4. The Government of Japan, in accordance with the laws and regulations in force in Japan and subject to the availability of appropriated funds, shall place at the disposal of UNIDO for the purpose of meeting the costs of the Project a special-purpose contribution to the Industrial Development Fund of UNIDO in Japanese yen. Concerning the financial contribution for the first year, the amount to be placed shall be one hundred and ninety million yen (¥190,000,000). The financial contribution for each subsequent year shall be made in accordance with the laws and regulations in force in Japan and subject to the availability of appropriated funds.
５ ＵＮＩＤＯは、その財政規則及び他の関連規則に従い、４に規定する目的指定拠出を管理し、及び日本国政府に対し目的指定拠出に関する年次会計報告書を提出する。
5. UNIDO, in accordance with its financial rules and other applicable regulations, shall administer the special-purpose contribution referred to in paragraph 4 above and provide the Government of Japan with an annual financial statement in respect of the special-purpose contribution.
６ ＩＴＰＯの職員の採用は、ＵＮＩＤＯの職員規則に従って行う。ＩＴＰＯの所長については、日本国政府との協議の上、かつ、その意見を尊重しつつ、任命される。
6. The recruitment of personnel for the ITPO shall be effected in accordance with the staff rules and regulations of UNIDO. The appointment of the Head of the ITPO will be made after consultation with and respecting the opinion of the Government of Japan.
７ 東京のＩＴＰＯ及びその職員について国際連合の特権及び免除に関する条約を適用することを確認する。
7. It is confirmed that the Convention on the Privileges and Immunities of the United Nations (1946) applies to the ITPO in Tokyo and its personnel.
８ この取極から生ずる問題についての日本国政府からＵＮＩＤＯに対する及びＵＮＩＤＯから日本国政府に対するいかなる公式の連絡も、在ウィーン国際機関日本政府代表部を通じて行う。
8. Any official communication from the Government of Japan to UNIDO and from UNIDO to the Government of Japan with regard to matters arising from the present arrangements shall be made through the Permanent Mission of Japan to the International Organizations in Vienna.
９ この取極の実施に必要な他の全ての細目は、一年目については二千十七年一月一日前に、その後の各年については各暦年の一月一日前に、日本国政府とＵＮＩＤＯとの間で交渉し、取り決める。
9. All other details necessary to implement the arrangements for the first year shall be negotiated and arranged between the Government of Japan and UNIDO before 1 January 2017, and for each subsequent year before 1 January of the respective calendar year.
10 ＵＮＩＤＯは、三年目の終了の後遅くとも六箇月以内に、日本国政府に対し、事業の実施に関する中間報告書（４に規定する目的指定拠出の使用に係る中間的な決算書を含む。）を提出する。
10. UNIDO shall submit to the Government of Japan not later than six months after the end of the third year an interim report on the implementation of the Project, including an interim statement of accounts regarding the utilization of the special-purpose contribution referred to in paragraph 4 above.
11 ＵＮＩＤＯは、事業の終了の後遅くとも六箇月以内に、日本国政府に対し、事業の実施に関する最終報告書（４に規定する目的指定拠出の使用に係る最終的な決算書を含む。）を提出する。最終報告書には、この取極の終了の遅くとも六箇月前に日本国政府及びＵＮＩＤＯの双方によって行われる合同評価を基礎としてＵＮＩＤＯが事業について行う評価を含める。
11. UNIDO shall submit to the Government of Japan not later than six months after completion of the Project a final report on its implementation, including the final statement of accounts covering the utilization of the special-purpose contribution referred to in paragraph 4 above. The final report shall contain the evaluation of the Project by UNIDO on the basis of the joint evaluation which shall be carried out by both sides not later than six months prior to the expiry of the present arrangements.
本使は、更に、この書簡及びＵＮＩＤＯに代わって前記の取極を確認される貴官の返簡が日本国政府とＵＮＩＤＯとの間の合意を構成するものとみなし、その合意が貴官の返簡の日付の日に効力を生ずることを提案する光栄を有します。
I have further the honour to propose that the present Note and your Excellency’s Note in reply thereto, confirming on behalf of UNIDO the foregoing arrangements, shall be regarded as constituting an agreement between the Government of Japan and UNIDO, which will enter into force on the date of your Excellency’s reply.
