  　書簡をもって啓上いたします。本使は、ウクライナの経済の安定及び開発努力を促進するために供与される日本国の借款に関して日本国政府の代表者とウクライナ政府の代表者との間で最近到達した次の了解を確認する光栄を有します。

Excellency,

 I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of Ukraine concerning a Japanese loan to be extended with a view to promoting the economic stabilization and development efforts of Ukraine:


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  １　三百六十九億六千九百万円（三六、九六九、〇〇〇、〇〇〇円）の額までの円貨による借款（以下「借款」という。）が、経済改革開発政策借款（第二期）として、ウクライナ閣僚会議行動計画の下での改革計画（以下「改革計画」という。）においてウクライナ政府を支援することを目的として、独立行政法人国際協力機構（以下「ＪＩＣＡ」という。）により、日本国の関係法令に従って、ウクライナ政府に供与されることになる。


							

						

						

							

								
1. A loan in Japanese yen up to the amount of thirty-six billion nine hundred and sixty-nine million yen (\36,969,000,000) (hereinafter referred to as “the Loan”) will be extended, as the Economic Reform Development Policy Loan (II), in accordance with the relevant laws and regulations of Japan, to the Government of Ukraine by the Japan International Cooperation Agency (hereinafter referred to as “JICA”) for the purpose of supporting the Government of Ukraine in its reform program under the Action Program of the Cabinet of Ministers of Ukraine (hereinafter referred to as “the Reform Program”).

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ２(1)　借款は、ウクライナ政府とＪＩＣＡとの間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、この了解の範囲内で、なかんずく次の原則を含むことになる前記の借款契約によって規律される。


							

						

						

							

								
2. (1) The Loan will be made available by a loan agreement to be concluded between the Government of Ukraine and JICA.  The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreement, within the scope of the present understanding, which will contain, inter alia, the following principles:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (a)　償還期間は、六年の据置期間の後十四年とする。


							

						

						

							

								
 (a) The repayment period will be fourteen (14) years after the grace period of six (6) years;

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (b)　年間の利子率は、六箇月の貸出しに適用される適用可能なロンドン銀行間取引金利に〇・〇五パーセントを加えたものとする。        


							

						

						

							

								
 (b) The rate of interest will be the applicable London inter-bank offered rate applied for six months lending in Japanese yen plus nought point nought five per cent (0.05%) per annum; 

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (c)　(b)にかかわらず、(b)に規定する利子率が〇・一パーセントよりも低い場合には、年間の利子率は〇・一パーセントとする。


							

						

						

							

								
 (c) Notwithstanding sub-paragraph (b) above, if the rate of interest mentioned in sub-paragraph (b) above is lower than nought point one per cent (0.1%), the rate of interest will be nought point one per cent (0.1%) per annum; and

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (d)　支出期間は、前記の借款契約の発効の日の後一年とする。


							

						

						

							

								
 (d) The disbursement period will be one (1) year after the date of coming into force of the said loan agreement.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　(1)(d)に規定する支出期間は、両政府の関係当局の同意を得て延長することができる。


							

						

						

							

								
 (2) The disbursement period mentioned in sub-paragraph (1)(d) above may be extended with the consent of the authorities concerned of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ３(1)　借款は、改革計画の実施を支援することを目的として、ウクライナ政府の権限のある当局が将来行う予算支出（両政府の関係当局間で合意する表に掲げる生産物のためのものを除く。）を対象として使用に供される。


							

						

						

							

								
3. (1) The Loan will be made available to cover budget expenditures to be made by the competent authorities of the Government of Ukraine for the purpose of supporting the implementation of the Reform Program, except those for such products as will be enumerated in a list to be mutually agreed upon between the authorities concerned of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　(1)に規定する表は、両政府の関係当局間の合意によって修正することができる。


							

						

						

							

								
 (2) The list mentioned in sub-paragraph (1) above may be modified by agreement between the authorities concerned of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ４　ウクライナ政府は、その指定する国家予算勘定に借款の円貨による支出額に等しい額をウクライナの通貨で振り替えるようにするための措置をとる。このようにして振り替えられた額は、ウクライナの国家予算に編入される。


							

						

						

							

								
4. The Government of Ukraine shall take measures to have the equivalent in Ukrainian currency of the amount of yen disbursements of the Loan transferred to the state budget account designated by the Government of Ukraine.  The amount thus transferred shall be included in the State Budget of Ukraine.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ５　ウクライナ政府は、借款に基づいて購入される生産物の海上輸送及び海上保険に関し、海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限を課することも差し控える。


							

						

						

							

								
5. With regard to the shipping and marine insurance of the products purchased under the Loan, the Government of Ukraine shall refrain from imposing any restrictions that may hinder fair and free competition among the shipping and marine insurance companies.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ６　ウクライナ政府は、ＪＩＣＡについて、借款及びそれから生ずる利子に対して又はそれらに関連してウクライナにおいて課される全ての財政課徴金及び租税を免除する。


							

						

						

							

								
6. The Government of Ukraine shall exempt JICA from all fiscal levies and taxes imposed in Ukraine on and/or in connection with the Loan as well as interest accruing therefrom.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ７　ウクライナ政府は、借款が適正に、かつ、専ら３(1)に規定する予算支出のために使用されることを確保するために必要な措置をとる。


							

						

						

							

								
7. The Government of Ukraine shall take necessary measures to ensure that the Loan be used properly and exclusively for the budget expenditures mentioned in sub-paragraph (1) of paragraph 3.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ８　ウクライナ政府は、要請に応じ、日本国政府及びＪＩＣＡに対し、次のものを提供する。

  　(a)　借款の使途及び改革計画の実施の進捗状況についての情報及び資料


							

						

						

							

								
 (a) information and data concerning the use of the Loan and the progress of the implementation of the Reform Program; and



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  　(b)　借款及び改革計画に関連するその他の情報


							

						

						

							

								
 (b) any other information related to the Loan and the Reform Program.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ９　両政府は、この了解から、又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。


							

						

						

							

								
9. The two Governments shall consult with each other with respect to any matter that may arise from or in connection with the present understanding.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  　本使は、更に、この書簡及び前記の了解をウクライナ政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意がその効力発生のために必要な国内手続を完了した旨のウクライナ政府からの書面による通告を日本国政府が受領した日に効力を生ずるものとすることを提案する光栄を有します。


							

						

						

							

								
 I have further the honour to propose that this Note and Your Excellency’s Note in reply confirming on behalf of the Government of Ukraine the foregoing understanding shall constitute an agreement between the two Governments, which shall enter into force on the date of receipt by the Government of Japan of the written notification from the Government of Ukraine of the completion of necessary domestic procedures for the entry into force of such agreement.
