（訳文）
  　書簡をもって啓上いたします。本使は、パキスタン・イスラム共和国の経済の安定及び開発努力を促進するために供与される日本国の借款に関して日本国政府の代表者とパキスタン・イスラム共和国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。
  １　五十億円（五、〇〇〇、〇〇〇、〇〇〇円）の額までの円貨による借款（以下「借款」という。）が、日本国、国際開発協会及びアジア開発銀行により準備された電力セクター改革プログラム（第二期）の下での改革計画（以下「改革計画（第二期）」という。）においてパキスタン・イスラム共和国政府を支援することを目的として、独立行政法人国際協力機構（以下「ＪＩＣＡ」という。）により、日本国の関係法令に従って、パキスタン・イスラム共和国政府に供与されることになる。
  ２(1)　借款は、パキスタン・イスラム共和国政府とＪＩＣＡとの間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、この了解の範囲内で、なかんずく次の原則を含むことになる前記の借款契約によって規律される。
      (a)　償還期間は、十年の据置期間の後二十年とする。
      (b)　年間の利子率は、六箇月の貸出しに適用される適用可能なロンドン銀行間取引金利に〇・一パーセントを加えたものとする。
      (c)　(b)の規定にかかわらず、(b)に規定する利子率が〇・一パーセントよりも低い場合には、年間の利子率は〇・一パーセントとする。
      (d)　支出期間は、前記の借款契約の発効の日の後二年とする。
    (2)　(1)(d)に規定する支出期間は、両政府の関係当局の同意を得て延長することができる。


							

						

						

							

								
(Japanese Note)

      Islamabad, February 2, 2016

Excellency,

 I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Islamic Republic of Pakistan concerning a Japanese loan to be extended with a view to promoting the economic stabilization and development efforts of the Islamic Republic of Pakistan:

1. A loan in Japanese yen up to the amount of five billion yen (\5,000,000,000) (hereinafter referred to as “the Loan”) will be extended, in accordance with the relevant laws and regulations of Japan, to the Government of the Islamic Republic of Pakistan by the Japan International Cooperation Agency (hereinafter referred to as “JICA”) for the purpose of supporting the Government of the Islamic Republic of Pakistan in its reform program under the Energy Sector Reform Program (II) prepared by Japan, the International Development Association and the Asian Development Bank (hereinafter referred to as “the Reform Program (II)”).

2. (1) The Loan will be made available by a loan agreement to be concluded between the Government of the Islamic Republic of Pakistan and JICA.  The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreement, within the scope of the present understanding, which will contain, inter alia, the following principles:

 (a) The repayment period will be twenty (20) years after the grace period of ten (10) years;
 
 (b) The rate of interest will be the applicable London inter-bank offered rate applied for six months lending in Japanese yen plus nought point one per cent (0.1%) per annum; 

 (c) Notwithstanding sub-paragraph (b) above, if the rate of interest mentioned in sub-paragraph (b) above is lower than nought point one per cent (0.1%), the rate of interest will be nought point one per cent (0.1%) per annum; and

 (d) The disbursement period will be two (2) years after the date of coming into force of the said loan agreement.

 (2) The disbursement period mentioned in sub-paragraph (1)(d) above may be extended with the consent of the authorities concerned of the two Governments.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ３(1)　借款は、パキスタン・イスラム共和国政府の権限のある当局が、パキスタン・イスラム共和国の経済の安定及び開発努力を促進することを目的として、既に行ったか又は将来行う予算支出（両政府の関係当局間で合意する表に掲げる生産物のためのものを除く。）を対象として使用に供される。
    (2)　(1)に規定する表は、両政府の関係当局間の合意によって修正することができる。
  ４　パキスタン・イスラム共和国政府は、パキスタン・イスラム共和国政府の名義で開設される国家予算勘定に借款の円貨による支出額に等しい額をパキスタンの通貨で振り替えるようにするための措置をとる。このようにして振り替えられた額は、パキスタン・イスラム共和国政府の国家予算に含められる。
  ５　パキスタン・イスラム共和国政府は、借款に基づく生産物又は役務の調達がＪＩＣＡの調達のためのガイドライン（国際競争入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際競争入札の手続をなかんずく定める。）に従って実施されることを確保する。
  ６　パキスタン・イスラム共和国政府は、借款に基づいて購入される生産物の海上輸送及び海上保険に関し、海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限を課することも差し控える。
  ７　パキスタン・イスラム共和国政府は、ＪＩＣＡについて、借款及びそれから生ずる利子に対して又はそれらに関連してパキスタン・イスラム共和国において課される全ての財政課徴金及び租税を免除する。
  ８　パキスタン・イスラム共和国政府は、借款が適正に、かつ、専ら３(1)に規定する予算支出のために使用されることを確保するために必要な措置をとる。
  ９　パキスタン・イスラム共和国政府は、要請に応じ、日本国政府及びＪＩＣＡに対し、次のものを提供する。
  　(a)　借款の使途及び改革計画（第二期）の実施の進捗状況についての情報及び資料
  　(b)　借款及び改革計画（第二期）に関連するその他の情報
  10　両政府は、この了解から、又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。


							

						

						

							

								
3. (1) The Loan will be made available to cover budget expenditures already made and/or to be made by the competent authorities of the Government of the Islamic Republic of Pakistan for the purpose of promoting the economic stabilization and development efforts of the Islamic Republic of Pakistan, except those for such products as will be enumerated in a list to be mutually agreed upon between the authorities concerned of the two Governments.

 (2) The list mentioned in sub-paragraph (1) above may be modified by agreement between the authorities concerned of the two Governments.

4. The Government of the Islamic Republic of Pakistan shall take measures to have the equivalent in Pakistani currency of the amount of yen disbursements of the Loan transferred to the state budget account opened in the name of the Government of the Islamic Republic of Pakistan.  The amount thus transferred shall be included in the state budget of the Government of the Islamic Republic of Pakistan.

5. The Government of the Islamic Republic of Pakistan shall ensure that the procurement of products and/or services under the Loan be carried out in accordance with the guidelines for procurement of JICA, which set forth, inter alia, the procedures of international competitive bidding to be followed except where such procedures are inapplicable or inappropriate.
 
6. With regard to the shipping and marine insurance of the products purchased under the Loan, the Government of the Islamic Republic of Pakistan shall refrain from imposing any restrictions that may hinder fair and free competition among the shipping and marine insurance companies.

7. The Government of the Islamic Republic of Pakistan shall exempt JICA from all fiscal levies and taxes imposed in the Islamic Republic of Pakistan on and/or in connection with the Loan as well as interest accruing therefrom.

8. The Government of the Islamic Republic of Pakistan shall take necessary measures to ensure that the Loan be used properly and exclusively for the budget expenditures mentioned in sub-paragraph (1) of paragraph 3.

9. The Government of the Islamic Republic of Pakistan shall, upon request, furnish the Government of Japan and JICA with: 

 (a) information and data concerning the use of the Loan and the progress of the implementation of the Reform Program (II); and

 (b) any other information related to the Loan and the Reform Program (II).
