  　書簡をもって啓上いたします。本使は、日本国とマレーシアとの間の友好関係及び経済協力を強化することを目的とした日本国のマレーシアに対する経済及び発展のための協力（巡視船の贈与を含む。）に関して日本国政府の代表者とマレーシア政府の代表者との間で最近行われた討議に言及するとともに、次の取極を日本国政府に代わって提案する光栄を有します。

Excellency,

 I have the honour to refer to the recent discussions held between the representatives of the Government of Japan and of the Government of Malaysia concerning Japan’s economic and development cooperation to Malaysia including the grant of patrol vessels, which is to be made with a view to strengthening the friendly relations and economic cooperation between the two countries, and to propose on behalf of the Government of Japan the following arrangements:

１　日本国政府は、海上における安全のためのマレーシアの能力の向上、マレーシアの経済社会開発及びマレーシア国民の福祉に寄与するため、日本国の関係法令に従い、マレーシア政府に対し、巡視船二隻並びに搭載される小型船舶五隻及び巡視船の運航に関連するその他の機材（以下「巡視船等」と総称する。）を贈与する。

1. For the purpose of contributing to enhancing Malaysia’s capacity for maritime security and realizing the economic and social development of Malaysia as well as the well-being of the people of Malaysia, the Government of Japan will grant to the Government of Malaysia, in accordance with the relevant laws and regulations of Japan, two patrol vessels with five on-board small vessels and other equipment related to the operation of the patrol vessels (hereinafter jointly referred to as “the patrol vessels”).

２　マレーシア政府は、次のことのために必要な措置をとる。
    (a)　巡視船等が、適正にかつ海上における安全のためのマレーシアの能力の向上、マレーシアの経済社会開発及びマレーシア国民の福祉のためにのみ使用されるようにし、軍事目的に使用されないようにすること。
    (b)　両政府間に別段の合意がない限り、巡視船等のために又はそれに関連して必要な全ての経費を負担すること。
    (c)　要請に応じ、日本国政府に対し、贈与された巡視船等に関する情報を提供すること。
    (d)　日本国政府の書面による事前の同意を得ないで、贈与された巡視船等に係る権原又は占有権がマレーシア政府の職員以外の者又は他の政府に移転されないようにすること。

2. The Government of Malaysia shall take necessary measures:

 (a) to ensure that the patrol vessels are used properly and exclusively for the purpose of enhancing Malaysia’s capacity for maritime security and the economic and social development of Malaysia as well as the well-being of the people of Malaysia, and not for military purposes;

 (b) to bear all the expenses necessary for or in connection with the patrol vessels unless otherwise agreed upon between the two Governments;

 (c) to furnish the Government of Japan, upon request, with information concerning the patrol vessels granted; and

 
 (d) to ensure that the title to or possession of the patrol vessels granted will not be transferred to any person not an officer of the Government of Malaysia, or to any other government, without the prior written consent of the Government of Japan.

３　この取極を実施するために必要な細目取決め（１の贈与についての条件を含む。）が、両政府の権限のある当局の間で行われる。日本国政府の権限のある当局は、日本国海上保安庁とする。マレーシア政府の権限のある当局は、マレーシア海上法令執行庁とする。

3. Detailed arrangements necessary to implement the present arrangements, including the terms and conditions of the grant referred to in paragraph 1. above, shall be made between the competent authorities of the two Governments.  The competent authority of the Government of Japan shall be the Japan Coast Guard; the competent authority of the Government of Malaysia shall be the Malaysian Maritime Enforcement Agency.

４　両政府は、この取極から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。

4. The two Governments shall consult with each other in respect of any matter that may arise from or in connection with the present arrangements.

本使は、更に、この書簡及びマレーシア政府に代わって前記の取極を確認される閣下の返簡が両政府間の合意を構成するものとし、その合意が閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。

I have further the honour to propose that the present Note and Your Excellency’s Note in reply confirming on behalf of the Government of Malaysia the foregoing arrangements shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply.
