円借款の供与に関する取極の修正に関する日本国政府とインド政府との間の交換公文

書簡をもって啓上いたします。本官は、インドの経済の安定及び開発努力を促進するために供与される日本国の借款に関する二千十五年一月十六日付けの交換公文に関し、インド政府の代表者と日本国政府の代表者との間で最近到達した次の了解をインド政府に代わって確認する光栄を有します。
１ 前記の交換公文の２(1)(b)を次のように改める。
(b) 年間の利子率は、六箇月の貸出しに適用される適用可能なロンドン銀行間取引金利とする。
２ 前記の交換公文の改正された２(1)(b)の次に、次の新たな規定を加える。
(c) (b)にかかわらず、(b)に規定する利子率が〇・一パーセントよりも低い場合には、利子率は年〇・一パーセントとする。
３ 前記の交換公文の２(1)(c)を２(1)(d)に修正する。
本官は、更に、この書簡及び前記の了解を日本国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
本官は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。

Excellency,
With reference to the Exchange of Notes dated
January 16, 2015, concerning a Japanese loan to be extended with a view to promoting the economic stabilization and development efforts of India, I have the honour to confirm, on behalf of the Government of India, the following understanding recently reached between the representatives of the Government of India and of the Government of Japan:
1. Sub-paragraph (1)(b) of paragraph 2 of the said Exchange of Notes shall be deleted and replaced by the following:
“(b) The rate of interest will be the applicable London inter-bank offered rate applied for six months lending in Japanese yen per annum;”
2. The following new sub-paragraph shall be inserted immediately after sub-paragraph (1)(b) of paragraph 2 of the said Exchange of Notes as amended:
“(c) Notwithstanding sub-paragraph (b) above, if the rate of interest mentioned in sub-paragraph (b) above is lower than nought point one per cent (0.1%), the rate of interest will be nought point one per cent (0.1%) per annum; and”
3. Sub-paragraph (1)(c) of paragraph 2 of the said Exchange of the Notes shall be renumbered as (1)(d).
I have further the honour to propose that this Note and Your Excellency’s Note in reply confirming on behalf of the Government of Japan the foregoing understanding shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply.
I avail myself of this opportunity to extend to Your Excellency the assurance of my highest consideration.

本使は、更に、前記の了解を日本国政府に代わって確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成し、その合意がこの返簡の日付の日に効力を生ずるものとすることに同意する光栄を有します。
本使は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。

I have further the honour to confirm on behalf of the Government of Japan the foregoing understanding and to agree that Your Excellency’s Note and this Note in reply shall constitute an agreement between the two Governments, which shall enter into force on the date of this Note in reply.
