所得に対する租税に関す二重課税の回避及び脱税の防止のための日本国とスウェーデンとの間の条約を改正する議定書によって改正される条約に関する交換公文

  　  書簡をもって啓上いたします。本使は、千九百九十九年二月十九日付けの日本国政府とスウェーデン政府との間の交換公文（以下「千九百九十九年交換公文」という。）による合意及び千九百九十九年二月十九日にストックホルムで署名された議定書によって改正された千九百八十三年一月二十一日にストックホルムで署名された所得に対する租税に関する二重課税の回避及び脱税の防止のための日本国とスウェーデンとの間の条約を改正する二千十三年十二月五日にストックホルムで署名された議定書（以下「二千十三年議定書」という。）に言及するとともに、次の提案を日本国政府に代わって行う光栄を有します。
  　千九百九十九年交換公文に含まれる合意は、終了し、かつ、適用されなくなることが了解される。
  　本使は、前記の了解がスウェーデン政府により受諾される場合には、この書簡及びその旨の貴官の返簡が両政府間の合意を構成し、その合意が、二千十三年議定書第二十条２の規定に従って二千十三年議定書が適用される最初の日に効力を生ずるものとすることを提案する光栄を有します。
  　本使は、以上を申し進めるに際し、ここに貴官に向かって敬意を表します。

Madam:

 I have the honour to refer to the agreements effected by the exchange of notes between the Government of Japan and the Government of Sweden dated on 19 February 1999 (hereinafter referred to as “the Notes of 1999”), and to the Protocol, signed at Stockholm on 5 December 2013, amending the Convention between Japan and Sweden for the avoidance of double taxation and the prevention of fiscal evasion with respect to taxes on income signed at Stockholm on 21 January 1983, as amended by the Protocol signed at Stockholm on 19 February 1999 (hereinafter referred to as “the Protocol of 2013”), and to make, on behalf of the Government of Japan, the following proposals:

 It is understood that the agreements contained in the Notes of 1999 shall terminate and cease to have effect.

 If the foregoing understanding is acceptable to the Government of Sweden, I have the honour to suggest that the present Note and your Note in reply to that effect should constitute an agreement between the two Governments in this matter, which shall enter into force on the first date on which the Protocol of 2013 has effect in accordance with the provisions of paragraph 2 of Article XX of the Protocol of 2013.

 I avail myself of this opportunity to extend to you the assurance of my high consideration.

 I have the honour to acknowledge receipt of Your Excellency’s Note of today’s date which reads as follows:

 The foregoing understanding being acceptable to the Government of Sweden, I have the honour to confirm that Your Excellency’s Note and this Note in reply shall constitute an agreement between the two Governments in this matter, which shall enter into force on the first date on which the Protocol signed at Stockholm on 5 December 2013 has effect in accordance with the provisions of paragraph 2 of Article XX of that Protocol.

 I avail myself of this opportunity to extend to Your Excellency the assurance of my highest consideration.
