円借款の供与に関する日本国政府とケニア共和国政府との間の交換公文

  　書簡をもって啓上いたします。本使は、ケニア共和国の経済の安定及び開発努力を促進するために供与される日本国の借款に関して日本国政府の代表者とケニア共和国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。
  １　四十億円（四、〇〇〇、〇〇〇、〇〇〇円）の額までの円貨による借款（以下「借款」という。）が、ユニバーサル・ヘルス・カバレッジの達成のための保健セクター政策借款として、国家開発プログラム「ビジョン二千三十」の下でのユニバーサル・ヘルス・カバレッジの達成のための計画（以下「計画」という。）においてケニア共和国政府を支援することを目的として、独立行政法人国際協力機構（以下「ＪＩＣＡ」という。）により、日本国の関係法令に従って、ケニア共和国政府に供与されることになる。
  ２(1)　借款は、ケニア共和国政府とＪＩＣＡとの間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、この了解の範囲内で、なかんずく次の原則を含むことになる前記の借款契約によって規律される。
      (a)　償還期間は、十年の据置期間の後三十年とする。
      (b)　利子率は、年〇・二五パーセントとする。
      (c)　支出期間は、前記の借款契約の発効の日の後三年とする。
    (2)　(1)(c)に規定する支出期間は、両政府の関係当局の同意を得て延長することができる。

Excellency,

 I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Republic of Kenya concerning a Japanese loan to be extended with a view to promoting the economic stabilization and development efforts of the Republic of Kenya:

1. A loan in Japanese yen up to the amount of four billion yen (\4,000,000,000) (hereinafter referred to as “the Loan”) will be extended, as the Health Sector Policy Loan for Attainment of the Universal Health Coverage, in accordance with the relevant laws and regulations of Japan, to the Government of the Republic of Kenya by the Japan International Cooperation Agency (hereinafter referred to as “JICA”) for the purpose of supporting the Government of the Republic of Kenya in its programs for attainment of the universal health coverage under the National Development Program “VISION 2030” (hereinafter referred to as “the Programs”).

2. (1) The Loan will be made available by a loan agreement to be concluded between the Government of the Republic of Kenya and JICA.  The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreement, within the scope of the present understanding, which will contain, inter alia, the following principles:

 (a) The repayment period will be thirty (30) years after the grace period of ten (10) years;

 (b) The rate of interest will be nought point two five per cent (0.25%) per annum; and
 
 (c) The disbursement period will be three (3) years after the date of coming into force of the said loan agreement.

 (2) The disbursement period mentioned in sub-paragraph (1)(c) above may be extended with the consent of the authorities concerned of the two Governments.

  ３(1)　借款は、計画の実施を支援することを目的として、ケニア共和国政府の権限のある当局が既に行ったか又は将来行う予算支出（両政府の関係当局間で合意する表に掲げる生産物のためのものを除く。）を対象として使用に供される。
    (2)　(1)に規定する表は、両政府の関係当局間の合意によって修正することができる。
  ４　ケニア共和国政府は、ケニア共和国政府の名義で開設される国家予算勘定に借款の円貨による支出額に等しい額をケニアの通貨で振り替えるようにするための措置をとる。このようにして振り替えられた額は、ケニア共和国政府の国家予算に編入される。
  ５　ケニア共和国政府は、借款に基づく生産物又は役務の調達がＪＩＣＡの調達のためのガイドライン（国際競争入札の手続が適用できないか又は適当でない場合を除くほか、従うべき国際競争入札の手続をなかんずく定める。）に従って実施されることを確保する。
  ６　ケニア共和国政府は、借款に基づいて購入される生産物の海上輸送及び海上保険に関し、海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限を課することも差し控える。
  ７　ケニア共和国政府は、ＪＩＣＡについて、借款及びそれから生ずる利子に対して又はそれらに関連してケニア共和国において課される全ての財政課徴金及び租税を免除する。
  ８　ケニア共和国政府は、借款が適正に、かつ、専ら３(1)に規定する予算支出のために使用されることを確保するために必要な措置をとる。
  ９　ケニア共和国政府は、要請に応じ、日本国政府及びＪＩＣＡに対し、次のものを提供する。
  　(a)　借款の使途及び計画の実施の進捗状況についての情報及び資料
  　(b)　借款及び計画に関連するその他の情報
  10　両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。

3. (1) The Loan will be made available to cover budget expenditures already made and/or to be made by the competent authorities of the Government of the Republic of Kenya for the purpose of supporting the implementation of the Programs, except those for such products as will be enumerated in a list to be mutually agreed upon between the authorities concerned of the two Governments.

(2) The list mentioned in sub-paragraph (1) above may be modified by agreement between the authorities concerned of the two Governments.

4. The Government of the Republic of Kenya shall take measures to have the equivalent in Kenyan currency of the amount of yen disbursements of the Loan transferred to the state budget account opened in the name of the Government of the Republic of Kenya. The amount thus transferred shall be included in the state budget of the Government of the Republic of Kenya.

5. The Government of the Republic of Kenya shall ensure that the procurement of products and/or services under the Loan be carried out in accordance with the guidelines for procurement of JICA, which set forth, inter alia, the procedures of international competitive bidding to be followed except where such procedures are inapplicable or inappropriate.

6. With regard to the shipping and marine insurance of the products purchased under the Loan, the Government of the Republic of Kenya shall refrain from imposing any restrictions that may hinder fair and free competition among the shipping and marine insurance companies.

7. The Government of the Republic of Kenya shall exempt JICA from all fiscal levies and taxes imposed in the Republic of Kenya on and/or in connection with the Loan as well as interest accruing therefrom.

8. The Government of the Republic of Kenya shall take necessary measures to ensure that the Loan be used properly and exclusively for the budget expenditures mentioned in sub-paragraph (1) of paragraph 3.

9. The Government of the Republic of Kenya shall, upon request, furnish the Government of Japan and JICA with:

(a) information and data concerning the use of the Loan and the progress of the implementation of the Programs; and

(b) any other information related to the Loan and the Programs.

10. The two Governments shall consult with each other with respect to any matter that may arise from or in connection with the present understanding.
