　　書簡をもって啓上いたします。本使は、千九百九十八年三月四日にドーハで署名された航空業務に関する日本国とカタル国との間の協定（以下「協定」という。）第十四条及び第十六条の規定に従って二千十二年五月三十日及び三十一日にドーハで行われた日本国及びカタール国の航空当局の間の協議に言及する光栄を有します。
　　本使は、また、前記の協議において到達した合意に基づき、及び協定第十六条の規定に従い、この書簡に添付する新たな付表が日本語、アラビア語及び英語で作成された協定の現行の付表に代わることを日本国政府に代わって提案する光栄を有します。
　　本使は、更に、前記の提案がカタール国政府にとって受諾し得るものであるときは、この書簡及びその旨の閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。
　　本使は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。

Doha, May 29, 2014

Excellency,

 I have the honour to refer to the consultations held in Doha on May 30 and 31, 2012, between the aeronautical authorities of Japan and of the State of Qatar, in accordance with Articles 14 and 16 of the Agreement between Japan and the State of Qatar for Air Services, signed at Doha on March 4, 1998 (hereinafter referred to as “the Agreement”).

 I have further the honour to propose, on behalf of the Government of Japan, that the new Schedule attached to this Note shall replace the existing Schedule to the Agreement done in the Japanese, Arabic and English languages, based on the agreement reached at the said consultations and pursuant to Article 16 of the Agreement.

 I have further the honour to propose that if the above proposal is acceptable to the Government of the State of Qatar, this Note and Your Excellency’s Note in reply to that effect shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply.

 I avail myself of this opportunity to extend to Your Excellency the assurances of my highest consideration.

  １　日本国の一又は二以上の指定航空企業が両方向に運営する路線            
      　日本国内の地点－東南アジア地域内の二地点－インド亜大陸内の二地点－中間の地点（注１）－湾岸諸国内の地点（注２）－ドーハ－後に特定される以遠の二地点－以遠の地点（注２）
          注１　日本国の一又は二以上の指定航空企業は、航空機を運航しない航空企業としてのコードシェア業務のためにのみ、「中間の地点」に業務を行うことができる。
          注２　日本国の一又は二以上の指定航空企業は、ドーハと「湾岸諸国内の地点」との間及びドーハと「以遠の地点」との間においては、自己が運送する途中降機の旅客についてのみ第五の自由の運輸権を行使することができる。
          注３　日本国の一又は二以上の指定航空企業が提供する協定業務は、日本国内の一地点をその起点としなければならないが、特定路線上の他の地点は、いずれかの又は全ての飛行に当たり当該指定航空企業の選択によって省略することができる。
  ２　カタル国の一又は二以上の指定航空企業が両方向に運営する路線
      　カタル国内の地点－湾岸諸国内の地点－インド亜大陸内の二地点（注１）－東南アジア地域内の二地点（注１）－中間の地点（注２）－東京、大阪及び（又は）名古屋－ソウル（注１及び３）－ロサンゼルス又はサンフランシスコ（注１及び４）
          注１　カタル国の一又は二以上の指定航空企業は、東京を含む路線においては、「インド亜大陸内の二地点」、「東南アジア地域内の二地点」、ソウル及び「ロサンゼルス又はサンフランシスコ」に業務を行うことができない。
          注２　カタル国の一又は二以上の指定航空企業は、航空機を運航しない航空企業としてのコードシェア業務のためにのみ、「中間の地点」に業務を行うことができる。
          注３　カタル国の一又は二以上の指定航空企業は、大阪とソウルとの間においては、自己が運送する途中降機の旅客についてのみ第五の自由の運輸権を行使することができる。
          注４　カタル国の一又は二以上の指定航空企業は、大阪を含む路線においては、旅客業務のためにのみ、「ロサンゼルス又はサンフランシスコ」に業務を行うことができる。
          注５　カタル国の一又は二以上の指定航空企業が提供する協定業務は、カタル国内の一地点をその起点としなければならないが、特定路線上の他の地点は、いずれかの又は全ての飛行に当たり当該指定航空企業の選択によって省略することができる。
  ３　この付表において「湾岸諸国」とは、バーレーン王国、オマーン国及びアラブ首長国連邦をいう。

							

						

						

							

								
SCHEDULE



1.  Routes to be operated in both directions by the designated airline or airlines of Japan:

Points in Japan – two points in South East Asia – two points in Indian Subcontinent – any intermediate points (Note 1)- points in the Gulf countries (Note 2) – Doha – two points beyond to be specified later - points beyond (Note 2)

Note 1:   The designated airline or airlines of Japan may
serve “any intermediate points” only for
code sharing services as a marketing airline or
marketing airlines.

Note 2: The designated airline or airlines of Japan may exercise fifth freedom traffic rights only for its or their own stopover passengers between Doha and “points in the Gulf countries” and between Doha and “points beyond”.

Note 3: The agreed services provided by the designated airline or airlines of Japan shall begin at a point in Japan, but other points on the specified route may at the option of the designated airline be omitted on any or all flights.


2.  Routes to be operated in both directions by the designated airline or airlines of the State of Qatar:

Points in the State of Qatar – points in the Gulf countries – two points in Indian Subcontinent (Note 1) – two points in South East Asia (Note 1) – any intermediate points (Note 2) – Tokyo, Osaka and/or Nagoya – Seoul (Notes 1 and 3) – Los Angeles or San Francisco (Notes 1 and 4)

Note 1:  The designated airline or airlines of the State of Qatar may not serve any of “two points in Indian Subcontinent”, “two points in South East Asia”, Seoul and “Los Angeles or San Francisco” on the routes involving Tokyo.

Note 2: The designated airline or airlines of the State of Qatar may serve “any intermediate points” only for code sharing services as a marketing airline or marketing airlines.


Note 3:  The designated airline or airlines of the State of Qatar may exercise fifth freedom traffic rights only for its or their own stopover passengers between Osaka and Seoul.

 I have the honour to acknowledge the receipt of Your Excellency’s Note of today’s date, which reads as follows:

 I have further the honour to inform Your Excellency, on behalf of the Government of the State of Qatar, that the Government of the State of Qatar accepts the above proposal of the Government of Japan and to confirm that Your Excellency’s Note and this Note in reply shall constitute an agreement between the two Governments, which shall enter into force on the date of this Note in reply.

 I avail myself of this opportunity to extend to Your Excellency the assurances of my highest consideration.
