航空業務に関する日本国政府とビルマ連邦政府との間の協定を改正する議定書

PROTOCOL
AMENDING THE AGREEMENT
BETWEEN THE GOVERNMENT OF JAPAN
AND THE GOVERNMENT OF THE UNION OF BURMA
FOR AIR SERVICES

日本国政府及びミャンマー連邦共和国政府は、
  　千九百七十二年二月一日にヤンゴンで署名された航空業務に関する日本国政府とビルマ連邦政府との間の協定（以下「協定」という。）を改正することを希望して、
  　次のとおり協定した。
  　　　　第一条
  　協定中「ビルマ連邦」を「ミャンマー連邦共和国」に改める。
  　　　　第二条
  　協定第一条１(b)を次のように改める。
  　　(b)　「航空当局」とは、日本国にあつては国土交通大臣及び同大臣が現在遂行している民間航空に関する任務又はこれに類する任務を遂行する権限を与えられる人又は機関をいい、ミャンマー連邦共和国にあつては運輸省管下の民間航空局又は運輸省が現在遂行している任務を遂行する権限を与えられる人若しくは機関をいう。

The Government of Japan and the Government of the Republic of the Union of Myanmar,

 Desiring to amend the Agreement between the Government of Japan and the Government of the Union of Burma for Air Services signed at Yangon on 1 February 1972 (hereinafter referred to as “the Agreement”),

 Have agreed as follows:

Article 1

 The words “Union of Burma” shall be deleted and replaced by the words “Republic of the Union of Myanmar” wherever they appear in the Agreement.

Article 2

 Sub-paragraph (b) of Paragraph 1 of Article 1 of the Agreement shall be deleted and replaced by the following:

      “(b) the term “aeronautical authorities” means, in the case of Japan, the Minister of Land, Infrastructure, Transport and Tourism and any person or body authorised to perform any functions on civil aviation at present exercised by the said Minister or similar functions, and, in the case of the Republic of the Union of Myanmar, the Department of Civil Aviation under the Ministry of Transport or any person or agency authorised to perform the functions exercised at present by the Ministry of Transport;”

  １　協定の正文（英語）第二条１及び２、第四条、第七条、第十条並びに第十一条中「designated airline」を「designated airlines」に改める。
  ２　協定の正文（英語）第二条３中「airline」を「airlines」に改める。
  ３　協定第三条１中「一の航空企業」を「一又は二以上の航空企業」に改める。
  ４　協定の正文（英語）第三条２中「airline designated」を「airline or airlines designated」に改める。
  ５　協定の正文（英語）第三条３から５までの規定中「the airline designated」を「an airline designated」に改める。
  ６　協定の正文（英語）第三条４及び６、第五条１及び２並びに第八条２中「the designated airline」を「a designated airline」に改める。
  ７　協定の正文（英語）第七条中「provides」を「provide」に改める。
  ８　協定の正文（英語）第九条２(a)中「between the designated airlines」を「by the designated airlines」に改める。
  ９　協定の正文（英語）第十条中「that airline」を「those airlines」に改める。

Article 3

1. Paragraphs 1 and 2 of Article 2, Article 4, Article 7, Article 10 and Article 11 of the Agreement shall be amended by deleting the words “designated airline” and replacing them with the words “designated airlines”.

2. Paragraph 3 of Article 2 of the Agreement shall be amended by deleting the word “airline” and replacing it with the word “airlines”.

3. Paragraph 1 of Article 3 of the Agreement shall be amended by deleting the words “one airline” and replacing them with the words “one or more airlines”.

4. Paragraph 2 of Article 3 of the Agreement shall be amended by deleting the words “airline designated” and replacing them with the words “airline or airlines designated”.

5. Paragraphs 3, 4 and 5 of Article 3 of the Agreement shall be amended by deleting the words “the airline designated” and replacing them with the words “an airline designated”.

6. Paragraphs 4 and 6 of Article 3, paragraphs 1 and 2 of Article 5, and paragraph 2 of Article 8 of the Agreement shall be amended by deleting the words “the designated airline” and replacing them with the words “a designated airline”.

7. Article 7 of the Agreement shall be amended by deleting the word “provides” and replacing it with the word “provide”.

8. Sub-paragraph (a) of paragraph 2 of Article 9 of the Agreement shall be amended by deleting the words “between the designated airlines” and replacing them with the words “by the designated airlines”.

9. Article 10 of the Agreement shall be amended by deleting the words “that airline” and replacing them with the words “those airlines”.

第四条
  　この議定書の附属書をもって、協定附属書に代える。
  　　　　第五条
  １　この議定書は、各締約国によりその国内法上の手続に従って承認されるものとし、その承認を通知する外交上の公文が交換された日に効力を生ずる。
  ２　この議定書は、協定が有効である限り効力を有する。

Article 4

 The Annex of the Agreement shall be replaced by the new Annex attached to this Protocol.

Article 5

1. This Protocol shall be approved by each Contracting Party in accordance with its legal procedures and shall enter into force on the date of exchange of diplomatic notes indicating such approval.

 
2. This Protocol shall remain in effect as long as the Agreement remains in force.

  １　日本国の一又は二以上の指定航空企業が両方向に運営する路線
    (a)　東京－香港及び（又は）マニラ－ベトナム内の二地点、カンボジア内の二地点及び（又は）ラオス内の一地点－シンガポール－クアラルンプール及び（又は）ペナン－バンコク－ミャンマー連邦共和国内の地点
    (b)　日本国内の地点－中間の地点－ミャンマー連邦共和国内の地点－以遠の地点
  ２　ミャンマー連邦共和国の一又は二以上の指定航空企業が両方向に運営する路線
    (a)　ミャンマー連邦共和国内の地点－バンコク及び（又は）チェンマイ－クアラルンプール及び（又は）シンガポール－ラオス内の一地点、カンボジア内の二地点及び（又は）ベトナム内の二地点－香港及び（又は）マニラ－東京
    (b)　ミャンマー連邦共和国内の地点－中間の地点－東京以外の日本国内の地点－以遠の地点
  ３　いずれか一方の締約国の一又は二以上の指定航空企業が行う協定業務は、当該一方の締約国の領域内の一地点を起点としなければならないが、特定路線上の他の地点は、いずれかの又は全ての飛行に当たりその指定航空企業の選択によつて省略することができる。

ANNEX



1. Routes to be operated in both directions by the designated airline or airlines of Japan:

 (a) Tokyo – Hong Kong and/or Manila – two points in Viet Nam, two points in Cambodia and/or one point in Laos – Singapore – Kuala Lumpur and/or Penang – Bangkok – points in the Republic of the Union of Myanmar.

 (b) Points in Japan – intermediate points – points in the Republic of the Union of Myanmar – points beyond. 

2. Routes to be operated in both directions by the designated airline or airlines of the Republic of the Union of Myanmar:

 (a) Points in the Republic of the Union of Myanmar – Bangkok and/or Chiang Mai – Kuala Lumpur and/or Singapore – one point in Laos, two points in Cambodia and/or two points in Viet Nam – Hong Kong and/or Manila – Tokyo. 

 (b) Points in the Republic of the Union of Myanmar – intermediate points – points in Japan other than Tokyo – points beyond.  

3. The agreed services provided by the designated airline or airlines of either Contracting Party shall begin at a point in the territory of that Contracting Party, but other points on the specified routes may at the option of the designated airline or airlines be omitted on any or all flights.
