 I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of the United Republic of Tanzania concerning a Japanese loan to be extended with a view to promoting the economic stabilization and development efforts of the United Republic of Tanzania:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
１　十五億円（一、五〇○、〇〇〇、〇〇〇円）の額までの円貨による借款（以下「借款」という。）が、国際開発協会による第十次貧困削減支援貸付の下での成長及び貧困削減のためのプログラム（以下「プログラム」という。）においてタンザニア連合共和国政府を支援することを目的として、独立行政法人国際協力機構（以下「ＪＩＣＡ」という。）により、日本国の関係法令に従って、タンザニア連合共和国政府に供与されることになる。

							

						

						

							

								
1. A loan in Japanese yen up to the amount of one billion five hundred million yen (\1,500,000,000) (hereinafter referred to as “the Loan”) will be extended, in accordance with the relevant laws and regulations of Japan, to the Government of the United Republic of Tanzania by the Japan International Cooperation Agency (hereinafter referred to as “JICA”) for the purpose of supporting the Government of the United Republic of Tanzania in its programs for growth and reduction of poverty under the Tenth Poverty Reduction Support Credit by the International Development Association (hereinafter referred to as “the Programs”).

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
２(1)　借款は、タンザニア連合共和国政府とＪＩＣＡとの間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、この了解の範囲内で、なかんずく次の原則を含むことになる前記の借款契約によって規律される。         
    (a)　償還期間は、十年の据置期間の後三十年とする。
    (b)　利子率は、年〇・〇一パーセントとする。            
    (c)　支出期間は、前記の借款契約の発効の日の後一年とする。
  (2)　(1)(c)に規定する支出期間は、両政府の関係当局の同意を得て延長することができる。

							

						

						

							

								
2.(1) The Loan will be made available by a loan agreement to be concluded between the Government of the United Republic of Tanzania and JICA.  The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreement, within the scope of the present understanding, which will contain, inter alia, the following principles:
    (a) The repayment period will be thirty (30) years after the grace period of ten (10) years;
    (b) The rate of interest will be nought point nought one per cent (0.01%) per annum; and
    (c) The disbursement period will be one (1) year after the date of coming into force of the said loan agreement.
  (2) The disbursement period mentioned in sub-paragraph (1)(c) above may be extended with the consent of the authorities concerned of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
３(1)　借款は、タンザニア連合共和国の権限のある当局が既に行ったか又は将来行う予算支出（両政府の関係当局間で合意する表に掲げる生産物のためのものを除く。）を対象として使用に供される。
  (2)　(1)に規定する表は、両政府の関係当局間の合意によって修正することができる。

							

						

						

							

								
3.(1) The Loan will be made available to cover budget expenditures already made and/or to be made by the competent authorities of the United Republic of Tanzania, except those for such products as will be enumerated in a list to be mutually agreed upon between the authorities concerned of the two Governments.
  (2) The list mentioned in sub-paragraph (1) above may be modified by agreement between the authorities concerned of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
４　タンザニア連合共和国政府は、タンザニア連合共和国政府の名義で開設される国家予算勘定に借款の円貨による支出額に等しい額をタンザニアの通貨で振り替えるようにするための措置をとる。このようにして振り替えられた額は、タンザニア連合共和国政府の国家予算に編入され、二千十年七月に承認されたタンザニア連合共和国の第二次成長及び貧困削減のための国家戦略（以下「ＭＫＵＫＵＴＡⅡ」という。）の政策目標を達成するためのタンザニア連合共和国のプログラムの実施を支援するために使用される。

							

						

						

							

								
4. The Government of the United Republic of Tanzania shall take measures to have the equivalent in Tanzanian currency of the amount of yen disbursements of the Loan transferred to the state budget account opened in the name of the Government of the United Republic of Tanzania.  The amount thus transferred shall be included in the state budget of the Government of the United Republic of Tanzania, and shall be used to support the implementation of the Programs of the United Republic of Tanzania to achieve policy goals stated in National Strategy for Growth and Reduction of Poverty II of the United Republic of Tanzania approved in July 2010 (hereinafter referred to as “the MKUKUTA II”).

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
５　タンザニア連合共和国政府は、借款に基づく生産物又は役務の調達がＪＩＣＡの調達のためのガイドライン（国際競争入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際競争入札の手続をなかんずく定める。）に従って調達されることを確保する。

							

						

						

							

								
5. The Government of the United Republic of Tanzania shall ensure that the procurement of products and/or services under the Loan be carried out in accordance with the guidelines for procurement of JICA, which set forth, inter alia, the procedures of international competitive bidding to be followed except where such procedures are inapplicable or inappropriate.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
６　タンザニア連合共和国政府は、ＪＩＣＡについて、借款及びそれから生ずる利子に対して又はそれらに関連してタンザニア連合共和国において課される全ての財政課徴金及び租税を免除する。

							

						

						

							

								
6. The Government of the United Republic of Tanzania shall exempt JICA from all fiscal levies and taxes imposed in the United Republic of Tanzania on and/or in connection with the Loan as well as interest accruing therefrom.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
７　タンザニア連合共和国政府は、借款が適正にかつ専ら３(1)に規定する予算支出のために使用されることを確保するために必要な措置をとる。

							

						

						

							

								
7. The Government of the United Republic of Tanzania shall take necessary measures to ensure that the Loan be used properly and exclusively for the budget expenditures mentioned in sub-paragraph (1) of paragraph 3.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
８　タンザニア連合共和国政府は、要請に応じ、日本国政府及びＪＩＣＡに対し、次のものを提供する。
  (a)　借款の使途及びＭＫＵＫＵＴＡⅡの実施の進捗状況についての情報及び資料
  (b)　借款及びＭＫＵＫＵＴＡⅡの実施に関連するその他の情報

							

						

						

							

								
8. The Government of the United Republic of Tanzania shall, upon request, furnish the Government of Japan and JICA with:
  (a) information and data concerning the use of the Loan and the progress of the implementation of the MKUKUTA II; and

９　両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。

  本使は、更に、この書簡及び前記の了解をタンザニア連合共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
