  書簡をもって啓上いたします。本使は、日本国の借款に関してこの書簡の付表に掲げる日に日本国政府とミャンマー連邦共和国政府との間で交換された書簡（以下「従前の書簡」という。）、開発途上国の債務及び開発の問題について千九百七十八年三月十一日に国際連合貿易開発会議第九回特別貿易開発理事会第三会期において採択された決議第百六十五号並びに二千十二年四月二十一日付けの「日本・ミャンマー首脳会談に関する共同プレスステートメント」に関し、次の了解を日本国政府に代わって提案する光栄を有します。

Excellency,

 With reference to the Notes exchanged between the Government of Japan and the Government of the Republic of the Union of Myanmar on the dates enumerated in the List attached hereto concerning Japanese loans (hereinafter referred to as “the Previous Notes”) and to the resolution 165 adopted at the Third Part of the Ninth Special Session of the Trade and Development Board of the United Nations Conference on Trade and Development on March 11, 1978 regarding debt and development problems of developing countries, as well as to the Joint Press Statement on Japan-Myanmar Summit Meeting dated April 21, 2012, I have the honour to propose on behalf of the Government of Japan the following understanding:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
１　債務免除方式による債務救済措置が、独立行政法人国際協力機構（以下「ＪＩＣＡ」という。）により、日本国の関係法令に従ってとられることになる。

							

						

						

							

								
1. A debt relief measure in the form of cancellation will be taken in accordance with the relevant laws and regulations of Japan by the Japan International Cooperation Agency (hereinafter referred to as “JICA”).

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
２(1)　免除される債務は、従前の書簡に従って締結された借款契約に基づく次の債務（以下「債務」という。）から成る。
    (a)　二千三年四月一日以後に弁済期限の到来したか又は到来する全ての元本
    (b)　二千三年四月一日から二千十二年三月三十一日までの間（両期日を含む。）に弁済期限の到来した全ての契約上の利子
    (c)　二千十二年三月三十一日以前に生じ、かつ弁済期限の到来していない全ての契約上の利子

							

						

						

							

								
2.(1) The debts to be cancelled consist of the following debts under the loan agreements concluded in accordance with the Previous Notes (hereinafter referred to as “the Debts”):
    (a) all the principal having fallen or falling due on or after April 1, 2003;
　　(b) all the contractual interest having fallen due between April 1, 2003 and March 31, 2012, both dates inclusive; and
    (c) all the contractual interest having accrued and not having fallen due yet on or before March 31, 2012.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(2)　二千十二年三月三十一日時点における債務の総額の見積りは、千二百七十四億三千十二万千八百七円（一二七、四三〇、一二一、八〇七円）である。

							

						

						

							

								
(2) The estimate, as of March 31, 2012, of the total amount of the Debts is one hundred and twenty-seven billion four hundred and thirty million one hundred and twenty-one thousand eight hundred and seven yen (\127,430,121,807).

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(3)　(2)に規定する総額は、ミャンマー連邦共和国政府及びＪＩＣＡが行う最終的照合の後に、日本国政府及びミャンマー連邦共和国政府の権限のある当局間の相互の同意により修正されることがある。

							

						

						

							

								
(3) Modifications may be made to the total amount referred to in sub-paragraph (2) above by mutual consent between the competent authorities of the Government of Japan and of the Government of the Republic of the Union of Myanmar, after the final verification to be made by the Government of the Republic of the Union of Myanmar and JICA.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(4)　ＪＩＣＡの各事業年度における免除の日程は、(1)に規定する各々の元本又は利子の弁済期限の到来のたびにミャンマー連邦共和国政府は当該元本又は利子の支払を免除されるという原則に基づき、同政府とＪＩＣＡとの間で決定される。その日程は、日本国政府及びミャンマー連邦共和国政府の権限のある当局間で確認される。

							

						

						

							

								
(4) The schedule of the cancellation for each JICA’s fiscal year will be determined between the Government of the Republic of the Union of Myanmar and JICA on the basis of the principle that the Government of the Republic of the Union of Myanmar will be exempted from the payment of each principal or interest referred to in sub-paragraph (1) above as they fall due.  The schedule shall be confirmed by the competent authorities of the Government of Japan and of the Government of the Republic of the Union of Myanmar.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(5)　(3)及び(4)に規定する日本国政府の権限のある当局は、外務省及び財務省であり、(3)及び(4)に規定するミャンマー連邦共和国政府の権限のある当局は、財務・歳入省である。

							

						

						

							

								
(5) The competent authorities of the Government of Japan referred to in sub-paragraphs (3) and (4) above will be the Ministry of Foreign Affairs and the Ministry of Finance, and the competent authority of the Government of the Republic of the Union of Myanmar referred to in sub-paragraphs (3) and (4) above will be the Ministry of Finance and Revenue.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
３　債務は、ミャンマー連邦共和国政府に対してＪＩＣＡが行う免除の通告により免除されることになる。二千十二年四月一日から当該通告の日までの間（両期日を含む。）における債務に対する利子は、課されない。

							

						

						

							

								
3. The Debts will be cancelled by notification to that effect to be made by JICA to the Government of the Republic of the Union of Myanmar. ４　ミャンマー連邦共和国政府は、改革努力を継続するために必要な措置をとる。両政府は、その改革努力の継続を共同でモニターする。

							

						

						

							

								
4. The Government of the Republic of the Union of Myanmar shall take necessary measures to continue to make reform efforts. ５　両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
