（日本側書簡） （訳文） 書簡をもって啓上いたします。本使は、ミャンマー連邦共和国の経済の安定及び開発努力を促進するために供与される日本国の借款に関して日本国政府の代表者とミャンマー連邦共和国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。
(Japanese Note) Nay Pyi Taw, January 15, 2013 Excellency, I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Republic of the Union of Myanmar concerning a Japanese loan to be extended with a view to promoting the economic stabilization and development efforts of the Republic of the Union of Myanmar:
１ 千九百八十八億八千百十七万三千三百三十一円（一九八、八八一、一七三、三三一円）の額までの円貨による借款（以下「借款」という。）が、日本国政府とミャンマー連邦共和国政府により共同で準備された社会経済開発支援計画（以下「計画」という。）の下でのミャンマー連邦共和国政府の努力を支援することを目的として、二千十二年四月二十一日付けの「日本・ミャンマー首脳会談に関する共同プレスステートメント」に照らし、独立行政法人国際協力機構（以下「ＪＩＣＡ」という。）により、日本国の関係法令に従って、ミャンマー連邦共和国政府に供与されることになる。
1. A loan in Japanese yen up to the amount of one hundred and ninety-eight billion eight hundred and eighty-one million one hundred and seventy-three thousand three hundred and thirty-one yen (\198,881,173,331) (hereinafter referred to as “the Loan”) will be extended, in accordance with the relevant laws and regulations of Japan, to the Government of the Republic of the Union of Myanmar by the Japan International Cooperation Agency (hereinafter referred to as “JICA”) for the purpose of supporting the Government of the Republic of the Union of Myanmar for its efforts under the Social and Economic Development Support Program jointly prepared by the Government of Japan and the Government of the Republic of the Union of Myanmar (hereinafter referred to as “the Program”) in light of the Joint Press Statement on Japan-Myanmar Summit Meeting of April 21, 2012.
２(1) 借款は、ミャンマー連邦共和国政府とＪＩＣＡとの間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、この了解の範囲内で、なかんずく次の原則を含むことになる前記の借款契約によって規律される。
(a) 償還期間は、十年の据置期間の後三十年とする。
(b) 利子率は、年〇・〇一パーセントとする。
(c) 支出期間は、前記の借款契約の発効の日の後二年とする。
(2) (1)に規定する借款契約は、両政府とＪＩＣＡとの間の必要な調整の後に締結される。
(3) (1)(c)に規定する支出期間は、両政府の関係当局の同意を得て延長することができる。
2.(1) The Loan will be made available by a loan agreement to be concluded between the Government of the Republic of the Union of Myanmar and JICA. The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreement, within the scope of the present understanding, which will contain, inter alia, the following principles:
(a) The repayment period will be thirty (30) years after the grace period of ten (10) years;
(b) The rate of interest will be nought point nought one per cent (0.01%) per annum; and
(c) The disbursement period will be two (2) years after the date of coming into force of the said loan agreement.
(2) The loan agreement mentioned in sub-paragraph (1) above will be concluded after necessary coordination between the two Governments and JICA.
(3) The disbursement period mentioned in sub-paragraph (1)(c) above may be extended with the consent of the authorities concerned of the two Governments.
３ 借款は、ミャンマー連邦共和国の権限のある当局が日本の債権者への債務の返済のために将来行う予算支出を対象として使用に供され、計画の実施を通じてミャンマー連邦共和国の経済の安定及び開発努力の促進に貢献する。
3. The Loan will be made available to cover budget expenditures to be made by the competent authorities of the Republic of the Union of Myanmar for the repayment of the debts to Japanese creditors, which contributes to promoting the economic stabilization and development efforts of the Republic of the Union of Myanmar through the implementation of the Program.
４ ミャンマー連邦共和国政府は、ＪＩＣＡについて、借款及びそれから生ずる利子に対して又はそれらに関連してミャンマー連邦共和国において課される全ての財政課徴金及び租税を免除する。
4. The Government of the Republic of the Union of Myanmar shall exempt JICA from all fiscal levies and taxes imposed in the Republic of the Union of Myanmar on and/or in connection with the Loan as well as interest accruing therefrom.
５ ミャンマー連邦共和国政府は、借款が適正にかつ専ら３に規定する予算支出のために使用されることを確保するために必要な措置をとる。
5. The Government of the Republic of the Union of Myanmar shall take necessary measures to ensure that the Loan be used properly and exclusively for the budget expenditures mentioned in paragraph 3.
６(1) ミャンマー連邦共和国政府は、要請に応じ、日本国政府及びＪＩＣＡに対し、次のものを提供する。
(a) 借款の使途及び計画の実施の進捗状況についての情報及び資料
(b) 借款及び計画に関連するその他の情報
(2) 両政府は、(1)に規定する情報及び資料に基づいて、共同して借款の使途及び計画の実施の進捗状況を随時検討及びモニターし、必要に応じ、借款の適正な使用及び計画の効果的かつ円滑な実施を確保するために適当な措置をとる。ＪＩＣＡは、その検討及びモニターに参加するよう招かれる。
6.(1) The Government of the Republic of the Union of Myanmar shall, upon request, furnish the Government of Japan and JICA with:
(a) Information and data concerning the use of the Loan and the progress of the implementation of the Program; and
(b) any other information related to the Loan and the Program.
(2) The two Governments shall jointly review and monitor from time to time, on the basis of the information and data mentioned in sub-paragraph (1) above, the use of the Loan and the progress of the implementation of the Program, and take, if necessary, appropriate measures to secure the proper use of the Loan as well as the effective and smooth implementation of the Program. JICA will be invited to participate in such review or monitoring.
７ 両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
7. The two Governments shall consult with each other with respect to any matter that may arise from or in connection with the present understanding.
本使は、更に、この書簡及び前記の了解をミャンマー連邦共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
本使は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。
