AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF UKRAINE CONCERNING COOPERATION TO ADVANCE AFTERMATH RESPONSE TO ACCIDENTS AT NUCLEAR POWER STATIONS

　日本国政府及びウクライナ政府（以下「両締約国政府」という。）は、

　The Government of Japan and the Government of Ukraine, hereinafter referred to as the “Parties”,

　両国がそれぞれの国に甚大な影響を与えた原子力発電所における事故を経験したこと、特にチェルノブイリ原子力発電所における事故からウクライナが得た知見から日本国が多くを学び得ることを想起し、

　Recalling that both States have experienced accidents at nuclear power stations, which have had an enormous impact on each State, and that Japan, in particular, may be able to learn much from Ukraine’s expertise acquired from the accident at Chernobyl Nuclear Power Station,

　原子力発電所における事故へのその後の対応に関する情報（低線量被ばくによる影響を含む人間及び環境に対する影響等）を収集し、及び分析する必要性を意識し、

　Conscious of the need to collect and analyze information related to aftermath response to accidents at nuclear power stations, such as effects on human and the environment, including those from the exposure to low radiation doses,

　事故の後にとった措置（生活環境の復旧及び住民の保護のための措置並びに放射性廃棄物の取扱い及び緊急事態への対応のための計画を含む。）に関する情報の共有の重要性に留意し、

　Mindful of the importance of sharing the information on the measures taken after the accidents, including those for the restoration of living conditions and the protection of population as well as the treatment of radioactive wastes and the plans for emergency responses,

　両締約国政府の国の間の協力が両国及び国際社会における人間の安全保障の促進に貢献し得ること並びに両締約国政府の国の間の協力の成果を国際社会と共有することが国際社会全体にも利益をもたらし得ることを認識して、

　Recognizing that the cooperation between the States of the Parties may contribute to the promotion of human security in both States and the international community, and that the sharing of the outcome of the cooperation between the States of the Parties with the international community may also benefit the international community as a whole,

　次のとおり協定した。

　Have agreed as follows:

第一条
　両締約国政府は、それぞれの国において効力を有する法令及び予算の範囲内で、かつ、関係する国際約束に基づくそれぞれの権利及び義務に従い、原子力発電所における事故へのその後の対応を推進するための次の分野における協力を促進するよう努力する。
　(a)　原子力発電所における事故の人間及び環境に対する影響
　(b)　(a)に関してとった措置及びその評価
　(c)　両締約国政府が合意するその他の分野

Article I
　The Parties shall endeavor to promote, within the scope of the laws and regulations in force and within the limit of the budgetary appropriations of the respective States and in accordance with their respective rights and obligations under applicable international agreements, cooperation to advance aftermath response to accidents at nuclear power stations in the following fields: 
　(a)　Effects of accidents at nuclear power stations on human and the environment;
　(b)　Measures taken with regard to paragraph (a) above and their evaluation; and
　(c)　Other fields as may be agreed between the Parties.

第二条
　前条に規定する協力は、次の方法により行う。
　　(a)　情報の交換
　　(b)　研究者、技術者その他の専門家の交流
　　(c)　共同セミナーのような行事の開催
　　(d)　両締約国政府が合意するその他の方法

Article II
　The cooperation mentioned in Article I of this Agreement will be undertaken through the following means:
　(a)　Exchange of information;
　(b)　Exchange of researchers, technical personnel and other experts;
　(c)　Holding of such events as joint seminars; and
　(d)　Other means as may be agreed between the Parties.

第三条
　両締約国政府は、第一条に規定する協力の効果的な実施のため、合同委員会を設置する。合同委員会は、原則として毎年一回、日本国又はウクライナにおいて会合する。

Article III
　For the purpose of effective implementation of the cooperation mentioned in Article I of this Agreement, the Parties shall establish a Joint Committee.  The Joint Committee shall meet in principle once a year in Japan or Ukraine.

第四条
　この協定は、日本国又はウクライナを締約国とする他の現行の二国間又は多数国間の国際約束に基づくそれぞれの国の権利及び義務に影響を及ぼすものではない。

Article IV
　This Agreement shall not affect rights and obligations of Japan or Ukraine under any other existing bilateral or multilateral international agreements a party of which is Japan or Ukraine.

第五条
　１　この協定は、日本国政府がウクライナ政府からこの協定の効力発生のために必要な国内手続を完了した旨の書面による通告を受領した日に効力を生ずる。
　２　この協定は、いずれか一方の締約国政府が他方の締約国政府に対しこの協定を終了させる意思を書面により通告した日から六箇月を経過するまで効力を有する。
　３　この協定は、両締約国政府間の書面による合意により改正することができる。

Article V
1.　This Agreement shall enter into force on the date of the receipt by the Government of Japan of the written notification from the Government of Ukraine of the completion of necessary domestic procedures for the entry into force of this Agreement.
2.　This Agreement shall remain in force until the expiry of six months from the day on which either Party gives to the other Party written notification of its intention to terminate this Agreement.
3.　This Agreement may be amended by mutual agreement in writing of the Parties.

　二千十二年四月十八日に東京で、ひとしく正文である日本語、ウクライナ語及び英語により本書二通を作成した。この協定の解釈に相違がある場合には、英語の本文による。

　Done at Tokyo, on April 18, 2012, in duplicate, in the Japanese, Ukrainian and English languages, all texts being equally authentic.  In case of any divergence of the interpretation of this Agreement, the English text shall prevail.
