　書簡をもって啓上いたします。本大臣は、二千十年五月二十一日にベルンで署名された議定書によって改正された千九百七十一年一月十九日に東京で署名された所得に対する租税に関する二重課税の回避のための日本国とスイスとの間の条約（以下「条約」という。）及び二千十年五月二十一日にベルンで署名された条約の不可分の一部を成す議定書（以下「議定書」という。）に言及するとともに、両政府間で到達した次の了解をスイス連邦政府に代わって確認する光栄を有します。

Excellency,

　I have the honour to refer to the Convention between Japan and Switzerland for the Avoidance of Double Taxation with respect to Taxes on Income signed at Tokyo on 19 January 1971 as amended by the Protocol signed at Berne on 21 May 2010 (hereinafter referred to as “the Convention”) as well as the Protocol which forms an integral part of the Convention signed at Berne on 21 May 2010 (hereinafter referred to as “the Protocol”) and to confirm, on behalf of the Swiss Federal Council, the following understanding reached between the two Governments:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
　議定書５(c)の規定に関し、議定書５(c)(i)から(iv)までの規定によって要求される情報であって、要請国から提供されるもののほか、当該要請国から提供されるその他の情報を通じて、要請する情報を保有していると認められる者が特定できる場合においても、行政上の支援の要請に応ずることが了解される。

							

						

						

							

								
　In respect of subparagraph (c) of paragraph 5 of the Protocol, it is understood that an administrative assistance request is also to be complied with in case where the person believed to be in possession of the requested information can be identified through other information which is provided by the requesting State, further to the information provided by that requesting State as required by (i) to (iv) of subparagraph (c) of paragraph 5 of the Protocol. 

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
　本大臣は、この書簡及び前記の了解を日本国政府に代わって確認される閣下の返簡が両政府間の合意を構成するとともに、その合意が閣下の返簡の日付の日に効力を生じ、二千十二年一月一日以後適用するものとすることを提案する光栄を有します。


							

						

						

							

								
　I have the honour to propose that the present Note and Your Excellency’s Note in reply confirming on behalf of the Government of Japan the foregoing understanding shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply and shall be applicable on or after 1 January 2012.
