　書簡をもって啓上いたします。本使は、二千十年五月二十一日にベルンで署名された議定書によって改正された千九百七十一年一月十九日に東京で署名された所得に対する租税に関する二重課税の回避のための日本国とスイスとの間の条約（以下「条約」という。）に言及するとともに、両政府間で到達した次の了解を日本国政府に代わって確認する光栄を有します。

Berne, 7 September, 2012

Excellency,

　I have the honour to refer to the Convention between Japan and Switzerland for the Avoidance of Double Taxation with respect to Taxes on Income signed at Tokyo on 19 January 1971 as amended by the Protocol signed at Berne on 21 May 2010 (hereinafter referred to as “the Convention”) and to confirm, on behalf of the Government of Japan, the following understanding reached between the two Governments:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
　条約第十一条４の規定に関し、株式会社国際協力銀行は、条約第十一条４(a)(v)に規定する機関とされることが了解される。

							

						

						

							

								
　With reference to paragraph 4 of Article 11 of the Convention, it is understood that the Japan Bank for International Cooperation shall be regarded as an institution referred to in paragraph 4(a)(v)of Article 11 of the Convention. 

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
　本使は、更に、この書簡及び前記の了解をスイス連邦政府に代わって確認される閣下の返簡が両政府間の合意を構成するとともに、その合意が閣下の返簡の日付の日に効力を生じ、二千十二年四月一日以後に租税を課される額について適用されるものとすることを提案する光栄を有します。

							

						

						

							

								
　I have further the honour to propose that the present Note and Your Excellency’s Note in reply confirming on behalf of the Swiss Federal Council the foregoing understanding shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply and shall be applicable for amounts taxable on or after the first day of April, 2012.
