　書簡をもって啓上いたします。本使は、モンゴル国の経済の安定及び開発努力を促進するために供与される日本国の借款に関して日本国政府の代表者とモンゴル国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。

Excellency,

　I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of Mongolia concerning a Japanese loan to be extended with
a view to promoting the economic stabilization and development efforts of Mongolia:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
１　十五億五千万円（一、五五〇、〇〇〇、〇〇〇円）の額までの円貨による借款（以下「借款」という。）が、アジア開発銀行による社会セクター支援プログラムの下での改革計画（以下「改革計画」という。）においてモンゴル国政府を支援することを目的として、独立行政法人国際協力機構（以下「ＪＩＣＡ」という。）により、日本国の関係法令に従って、モンゴル国政府に供与されることになる。

							

						

						

							

								
1.　A loan in Japanese yen up to the amount of one billion five hundred and fifty million yen (\1,550,000,000) (hereinafter referred to as “the Loan”) will be extended, in accordance with the relevant laws and regulations of Japan, to the Government of Mongolia by the Japan International Cooperation Agency (hereinafter referred toas “JICA”) for the purpose of supporting the Government of Mongolia in its reform program under the Social Sectors Support Program by the Asian Development Bank (hereinafter referred to as “the Reform Program”).

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
２(1)　借款は、モンゴル国政府とＪＩＣＡとの間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、この了解の範囲内で、なかんずく次の原則を含むことになる前記の借款契約によって規律される。
　(a)　償還期間は、六年の据置期間の後十四年とする。
　(b)　利子率は、年〇・八パーセントとする。
　(c)　支出期間は、前記の借款契約の発効の日の後三年とする。


							

						

						

							

								
2.(1)　The Loan will be made available by a loan agreement to be concluded between the Government of Mongolia and JICA.  The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreement, within the scope of the present understanding, which will contain, inter alia, the following principles:
　(a)　The repayment period will be fourteen (14) years after the grace period of six (6) years;
　(b)　The rate of interest will be nought point eight per cent (0.8%) per annum; and
　(c)　The disbursement period will be three (3) years after the date of coming into force of the said loan agreement.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(2)　(1)(c)に規定する支出期間は、両政府の関係当局の同意を得て延長することができる。

３(1)　借款は、モンゴル国の権限のある当局が既に行ったか又は将来行う予算支出（両政府の関係当局間で合意する表に掲げる生産物のためのものを除く。）を対象として使用に供される。

							

						

						

							

								
3.(1)　The Loan will be made available to cover budget expenditures already made and/or to be made by the competent authorities of Mongolia, except those for such products as will be enumerated in a list to be mutually agreed upon between the authorities concerned of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(2)　(1)に規定する表は、両政府の関係当局間の合意によって修正することができる。

４　モンゴル国政府は、モンゴル国政府の名義でモンゴル銀行に開設される国家予算勘定に借款の円貨による支出額に等しい額をモンゴルの通貨で振り替えるようにするための措置をとる。このようにして振り替えられた額は、モンゴル国政府の国家予算に編入され、モンゴル国の経済の安定及び開発努力を促進するために使用される。

							

						

						

							

								
4.　The Government of Mongolia shall take measures to have the equivalent in Mongolian currency of the amount of yen disbursements of the Loan transferred to the state budget account opened in the name of the Government of Mongoliaat Bank of Mongolia.  The amount thus transferred shall be included in the state budget of the Government of Mongolia, and shall be used to promote the economic stabilization and development efforts of Mongolia.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
５　モンゴル国政府は、借款に基づく生産物又は役務の調達がＪＩＣＡの調達のためのガイドライン（国際競争入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際競争入札の手続をなかんずく定める。）に従って調達されることを確保する。

							

						

						

							

								
5.　The Government of Mongolia shall ensure that the procurement of products and/or services under the Loan be carried out in accordance with the guidelines for procurement of JICA, which set forth, inter alia, the procedures of international competitive bidding to be followed except where such procedures are inapplicable or inappropriate.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
６　モンゴル国政府は、借款に基づいて購入される生産物の海上輸送及び海上保険に関し、海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限を課することも差し控える。

							

						

						

							

								
6.　With regard to the shipping and marine insurance of the products purchased under the Loan, the Government of Mongolia shall refrain from imposing any restrictions that may hinder fair and free competition among the shipping and marine insurance companies.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
７　モンゴル国政府は、ＪＩＣＡについて、借款及びそれから生ずる利子に対して又はそれらに関連してモンゴル国において課される全ての財政課徴金及び租税を免除する。


							

						

						

							

								
7.　The Government of Mongolia shall exempt JICA from all fiscal levies and taxes imposed in Mongolia on and/or in connection with the Loan as well as interest accruing therefrom.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
８　モンゴル国政府は、借款が適正にかつ専ら３(1)に規定する予算支出のために使用されることを確保するために必要な措置をとる。


							

						

						

							

								
8.　The Government of Mongolia shall take necessary measures to ensure that the Loan be used properly and exclusively for the budget expenditures mentioned in

９　モンゴル国政府は、要請に応じ、日本国政府及びＪＩＣＡに対し、次のものを提供する。
　(a)　改革計画の実施の進捗状況についての情報及び資料
　(b)　借款及び改革計画に関連するその他の情報


							

						

						

							

								
9.　The Government of Mongolia shall, upon request, furnish the Government of Japan and JICA with:
　(a)　information and data concerning the progress of the implementation of the Reform Program; and
　(b)　any other information related to the Loan and the Reform Program.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
10　両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。

							

						

						

							

								
10.　The two Governments shall consult with each other with respect to any matter that may arise from or in connection with the present understanding.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
　本使は、更に、この書簡及び前記の了解をモンゴル国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意がその効力発生のために必要な国内手続を完了した旨のモンゴル国政府からの書面による通告を日本国政府が受領した日に効力を生ずるものとすることを提案する光栄を有します。


							

						

						

							

								
　I have further the honour to propose that this Note and Your Excellency’s Note in reply confirming on behalf of the Government of Mongolia the foregoing understanding shall constitute an agreement between the two Governments, which shall become effective on the date of receipt by the Government of Japan of the written notification from the Government of Mongolia of the completion of necessary domestic procedures for the entry into force of such agreement.
