(Japanese Note) Tokyo, June 9, 2011 Excellency,
書簡をもって啓上いたします。本大臣は、日本国の借款に関してこの書簡の付表に掲げる日に日本国政府とトーゴ共和国政府との間で交換された書簡（以下「従前の書簡Ⅰ」という。）、債務救済措置に関して二千八年十二月十六日に日本国政府とトーゴ共和国政府との間で交換された書簡（以下「従前の書簡Ⅱ」という。）、債務免除方式による債務救済措置に関して二千四年九月十五日に日本国政府とトーゴ共和国政府との間で交換された書簡（以下「従前の書簡Ⅲ」という。）、重債務貧困国の政府開発援助債務の完全な免除に関する日本国、カナダ、フランス共和国、ドイツ連邦共和国、イタリア共和国、グレートブリテン及び北アイルランド連合王国及びアメリカ合衆国の元首及び政府の長により千九百九十九年六月十八日にケルンで発出された声明並びにトーゴ共和国が拡大重債務貧困国イニシアティブの下で包括的な債務救済を受けるために必要な条件を満たしたことについて国際通貨基金及び国際開発協会によりそれぞれ二千十年十二月十日及び十四日になされた承認に関し、次の了解を日本国政府に代わって提案する光栄を有します。
With reference to the Notes exchanged between the Government of Japan and the Government of the Republic of Togo on the dates enumerated in the List attached hereto concerning Japanese loans (hereinafter referred to as “the Previous Notes I”), to the Notes exchanged between the Government of Japan and the Government of the Republic of Togo on December 16, 2008 concerning a debt relief measure (hereinafter referred to as “the Previous Notes II”), to the Notes exchanged between the Government of Japan and the Government of the Republic of Togo on September 15, 2004 concerning a debt relief measure in the form of cancellation (hereinafter referred to as “the Previous Notes III”), to the statement issued at Cologne on June 18, 1999 by the heads of State and Government of Japan, Canada, the French Republic, the Federal Republic of Germany, the Republic of Italy, the United Kingdom of Great Britain and Northern Ireland and the United States of America regarding the full cancellation of official development assistance debt of the Heavily Indebted Poor Countries and to the approval given by the International Monetary Fund and the International Development Association on December 10 and 14, 2010 respectively that the Republic of Togo has met necessary conditions to receive comprehensive debt relief under the Enhanced Heavily Indebted Poor Countries Initiative, I have the honour to propose on behalf of the Government of Japan the following understanding:
１ 債務免除方式による債務救済措置が、独立行政法人国際協力機構（以下「ＪＩＣＡ」という。）により、日本国の関係法令に従ってとられることになる。
1. A debt relief measure in the form of cancellation will be taken in accordance with the relevant laws and regulations of Japan by the Japan International Cooperation Agency (hereinafter referred to as “JICA”).
２ 免除される債務は、従前の書簡Ⅰに従って締結された借款契約及び従前の書簡Ⅱに従って締結された債務繰延契約に基づく次の債務（以下「債務」という。）から成る。
2. (1) The debts to be cancelled consist of the following debts under the loan agreements concluded in accordance with the Previous Notes I and the rescheduling agreement concluded in accordance with the Previous Notes II (hereinafter referred to as “the Debts”):
(a) 二千十年十二月一日現在で償還されていない全ての元本
(a) all the principal outstanding as of December 1, 2010; and
(b) 二千十年十一月三十日以前に生じた未払の全ての利子（遅延利子を含む。）
(b) all the interest (including late interest) having accrued on or before November 30, 2010 and not paid.
(2) 債務の総額は、九十六億三千百二十三万七千五百五十五円（九、六三一、二三七、五五五円）になる。
(2) The total amount of the Debts will be nine billion six hundred and thirty-one million two hundred and thirty-seven thousand five hundred and fifty-five yen (\9,631,237,555).
(3) (2)に規定する総額は、日本国政府及びトーゴ共和国政府の権限のある当局間の同意により修正することができる。日本国政府の権限のある当局は、外務省及び財務省であり、トーゴ共和国政府の権限のある当局は、経済・財務省である。
(3) Modifications may be made to the total amount referred to in sub-paragraph (2) above by mutual consent between the competent authorities of the Government of Japan and of the Government of the Republic of Togo. The competent authorities of the Government of Japan will be the Ministry of Foreign Affairs and the Ministry of Finance, and the competent authorities of the Government of the Republic of Togo will be the Ministry of Economy and Finance.
３ 債務は、トーゴ共和国政府に対してＪＩＣＡが行う免除の通告により免除されることになる。二千十年十二月一日から当該通告の日までの間（両期日を含む。）における債務に対する利子は、課されない。
3. The Debts will be cancelled by notification to that effect to be made by JICA to the Government of the Republic of Togo. No interest will be charged on the Debts between December 1, 2010 and the date of such notification, both dates inclusive.
４ トーゴ共和国政府は、債務が免除される事実を考慮し、政府間協議の結果に従って、トーゴ共和国の貧困を削減し並びに社会的及び経済的開発を促進するために必要な措置をとる。
4. The Government of the Republic of Togo shall, in accordance with the result of the consultations between the two Governments, take necessary measures to reduce poverty and promote social and economic development of the Republic of Togo, taking into account the fact that the Debts will be cancelled.
５ 両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
5. The two Governments shall consult with each other in respect of any matter that may arise from or in connection with the present understanding.
６ 従前の書簡Ⅲに述べられた了解は、この書簡が交換された日からこの了解によって代替され、無効となる。
6. The understanding contained in the Previous Notes III is superseded by the present understanding and shall be null and void from the date of exchange of the present Notes.
従前の書簡Ⅲに述べられた了解に基づき、一定の債務が、二千三年四月一日から二千四年三月三十一日までの二千三年度、二千四年四月一日から二千五年三月三十一日までの二千四年度、二千五年四月一日から二千六年三月三十一日までの二千五年度、二千六年四月一日から二千七年三月三十一日までの二千六年度、二千七年四月一日から二千八年三月三十一日までの二千七年度、二千八年四月一日から二千九年三月三十一日までの二千八年度及び二千九年四月一日から二千十年三月三十一日までの二千九年度の各事業年度における免除の日程に従って既に免除された。
(1) The certain debts have been cancelled, pursuant to the understanding contained in the Previous Notes III, according to the schedule of cancellation for the fiscal years 2003, 2004, 2005, 2006, 2007, 2008 and 2009 which is respectively from April 1, 2003 to March 31, 2004, from April 1, 2004 to March 31, 2005, from April 1, 2005 to March 31, 2006, from April 1, 2006 to March 31, 2007, from April 1, 2007 to March 31, 2008, from April 1, 2008 to March 31, 2009 and from April 1, 2009 to March 31, 2010.
(2) に規定する免除された債務の総額は、九億六千三百八万九千六百七十六円（九六三、〇八九、六七六円）であった。
(2) The total amount of the debts cancelled referred to in sub-paragraph (1) above was nine hundred and sixty-three million eighty-nine thousand six hundred and seventy-six yen (\963,089,676).
本大臣は、更に、この書簡及び前記の了解をトーゴ共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency’s Note in reply confirming on behalf of the Government of the Republic of Togo the foregoing understanding shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply.
