技術協力及び青年海外協力隊の事業に関する日本国政府と南アフリカ共和国政府との間の協定
AGREEMENT ON TECHNICAL COOPERATION AND THE JAPAN OVERSEAS COOPERATION VOLUNTEERS PROGRAM BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE REPUBLIC OF SOUTH AFRICA
日本国政府及び南アフリカ共和国政府（以下「両締約国政府」という。）は、
The Government of Japan and the Government of the Republic of South Africa (hereinafter referred to as "the Parties");
南アフリカ共和国における技術協力及び青年海外協力隊員の活動の促進により両国間に存在する友好関係を一層強化することを希望し、
DESIRING to strengthen further the friendly relations existing between the two countries by the promotion of technical cooperation and activities of the Japan Overseas Cooperation Volunteers in the Republic of South Africa; and
両国の経済的及び社会的発展の促進によりもたらされる相互の利益を考慮して、
CONSIDERING mutual benefits to be derived from promoting the economic and social development of their respective countries;
次のとおり協定した。
HAVE AGREED as follows:
第一条
Article I
この協定の適用上、
For the purpose of this Agreement:
(a) 「専門家」とは、第三条１に規定する取決めによって規律される個別の技術協力計画を実施するために独立行政法人国際協力機構（以下「ＪＩＣＡ」という。）が特定の期間南アフリカ共和国に派遣する者（(b)に定めるシニア海外ボランティアを除く。）をいう。
(a) "Expert" means a person, excluding the Senior Volunteer provided for in (b) below, dispatched by the Japan International Cooperation Agency (hereinafter referred to as "JICA") to the Republic of South Africa for a specific period of time in order to implement specific technical cooperation programs governed by the arrangements referred to in paragraph 1 of Article III;
(b) 「シニア海外ボランティア」とは、第三条１に規定する取決めによって規律される個別の技術協力計画を実施するためにＪＩＣＡが特定の期間南アフリカ共和国に派遣する幅広い技術及び豊かな経験を有する日本人ボランティアをいう。
(b) "Senior Volunteer" means a Japanese volunteer with a wide range of technical skills and abundant experience dispatched by JICA to the Republic of South Africa for a specific period of time in order to implement specific technical cooperation programs governed by the arrangements referred to in paragraph 1 of Article III;
(c) 「家族」とは、次の者をいう。
(c) "member of a family" means:
(i) 配偶者
(i) the spouse;
(ii) 十八歳未満の被扶養者である子
(ii) any dependent child under the age of 18 years;
(iii) ＪＩＣＡが公式に家族と認めるその他の被扶養者であって、南アフリカ共和国国際関係・協力省がそのような者として受け入れるもの
(iii) any other dependent person officially recognized as a member of a family by JICA and accepted as such by the Department of International Relations and Co-operation of the Republic of South Africa; and
(iv) ＪＩＣＡが公式に家族と認めるパートナーであって、南アフリカ共和国国際関係・協力省がそのような者として受け入れるもの
(iv) the life partner officially recognized as a member of a family by JICA and accepted as such by the Department of International Relations and Co-operation of the Republic of South Africa;
(d) 「調査団」とは、南アフリカ共和国における経済及び社会開発計画の調査を行うためにＪＩＣＡが特定の期間同国に派遣する日本国の調査団をいう。
(d) "Mission" means a Japanese survey team dispatched by JICA to the Republic of South Africa for a specific period of time in order to conduct surveys of economic and social development projects in the Republic of South Africa;
(e) 「青年海外協力隊員」とは、一定の水準の技術を有する日本人ボランティアであって、第四条２(a)に規定する派遣計画に基づき、青年海外協力隊の事業における個別の計画を実施するためにＪＩＣＡが特定の期間南アフリカ共和国に派遣するものをいう。
(e) "Japan Overseas Cooperation Volunteer" means a Japanese volunteer with a certain level of technical skills dispatched by JICA to the Republic of South Africa for a specific period of time in order to implement specific programs of the Japan Overseas Cooperation Volunteers Program according to the schedules referred to in sub-paragraph (a) of paragraph 2 of Article IV;
(f) 「駐在員」とは、南アフリカ共和国におけるＪＩＣＡの海外事務所（以下「ＪＩＣＡ事務所」という。）の長として日本国から派遣された常駐代表であって、この協定に基づく技術協力及び青年海外協力隊の事業に関連してＪＩＣＡにより与えられる公務を南アフリカ共和国において遂行するものをいう。
(f) "Representative" means the resident representative to be dispatched from Japan who is the head of the overseas office of JICA in the Republic of South Africa (hereinafter referred to as "the JICA Office") and exercises the official functions to be assigned to him/her by JICA relative to technical cooperation and the Japan Overseas Cooperation Volunteers Program under this Agreement in the Republic of South Africa; and
(g) 「職員」とは、この協定に基づく技術協力及び青年海外協力隊の事業に関連してＪＩＣＡにより与えられる公務を南アフリカ共和国において遂行する日本国から派遣されたＪＩＣＡ事務所の職員（駐在員を除く。）をいう。
(g) "Staff" means staff of the JICA Office, excluding the Representative, to be dispatched from Japan who exercises the official functions to be assigned to him/her by JICA relative to technical cooperation and the Japan Overseas Cooperation Volunteers Program under this Agreement in the Republic of South Africa.
第二条
Article II
両締約国政府は、両締約国政府間の技術協力及び青年海外協力隊の事業を促進するよう努力する。
The Parties shall endeavor to promote technical cooperation and the Japan Overseas Cooperation Volunteers Program between the Parties.
第三条
Article III
１ この協定の下で実施される個別の技術協力計画を規律する別途の取決めが、両締約国政府の権限のある当局間で合意される。日本国政府の権限のある当局は外務省であり、南アフリカ共和国政府の権限のある当局は財務省である。
1. Separate arrangements which govern specific technical cooperation programs carried out under this Agreement shall be agreed upon between the competent authorities of the Parties. The competent authority of the Government of Japan is the Ministry of Foreign Affairs, and the competent authority of the Government of the Republic of South Africa is the National Treasury.
２ １に規定する取決めに基づき、個別の技術協力計画の細目及び手続を規律する別途の実施取決めが、南アフリカ共和国政府の権限のある当局の関与の下、同国政府の関係当局又はその計画の実施に責任を有する同国の機関とＪＩＣＡとの間で合意されることになる。
2. On the basis of the arrangements referred to in paragraph 1, separate implementing arrangements which govern details and procedures of specific technical cooperation programs will be agreed upon between the relevant authorities of the Government of the Republic of South Africa or South African agencies responsible for the implementation of such programs, with the involvement of the competent authority of the Government of the Republic of South Africa, and JICA.
第四条
Article IV
１ 次の形態による技術協力が、ＪＩＣＡにより、日本国の現行法令に従い、かつ、前条１に規定する取決めに基づき、ＪＩＣＡの負担で行われることになる。
1. The following forms of technical cooperation will be carried out by JICA at its own expense in accordance with the laws and regulations in force in Japan as well as with the arrangements referred to in paragraph 1 of Article III:
(a) 技術訓練を南アフリカ国民に提供すること。
(a) providing technical training to South African nationals;
(b) 専門家を南アフリカ共和国に派遣すること。
(b) dispatching the Experts to the Republic of South Africa;
(c) シニア海外ボランティアを南アフリカ共和国に派遣すること。
(c) dispatching the Senior Volunteers to the Republic of South Africa;
(d) 調査団を南アフリカ共和国に派遣すること。
(d) dispatching the Missions to the Republic of South Africa;
(e) 設備、機械及び資材を南アフリカ共和国政府に供与すること。
(e) providing the Government of the Republic of South Africa with equipment, machinery and materials; and
(f) 両締約国政府間で相互の同意により決定されるその他の形態の技術協力を南アフリカ共和国政府に対して行うこと。
(f) providing the Government of the Republic of South Africa with other forms of technical cooperation as may be decided upon by mutual consent between the Parties.
２(a) 青年海外協力隊員が、両締約国政府の権限のある当局間で別途合意する派遣計画に基づいて青年海外協力隊の事業における個別の計画を実施するために、ＪＩＣＡにより日本国の現行法令に従って派遣されることになる。また、青年海外協力隊員の公務の遂行に必要な設備、機械及び資材が、ＪＩＣＡにより、その使用に供されることになる。
2. (a) The Japan Overseas Cooperation Volunteers will be dispatched to the Republic of South Africa by JICA, in accordance with the laws and regulations in force in Japan, in order to implement specific programs of the Japan Overseas Cooperation Volunteers Program according to schedules to be separately agreed upon between the competent authorities of the Parties, and equipment, machinery and materials necessary for the exercise of their official functions will be made available by JICA.
(b) (a)に規定する派遣計画に基づき、青年海外協力隊の事業 における個別の計画の細目及び手続を規律する別途の実施取決めが、南アフリカ共和国政府の権限のある当局の関与の下、同国政府の関係当局又はその計画の実施に責任を有する同国の機関とＪＩＣＡとの間で合意されることになる。
(b) On the basis of the schedules referred to in sub-paragraph (a), separate implementing arrangements which govern details and procedures of specific programs of the Japan Overseas Cooperation Volunteers Program will be agreed upon between the relevant authorities of the Government of the Republic of South Africa or South African agencies responsible for the implementation of such programs, with the involvement of the competent authority of the Government of the Republic of South Africa, and JICA.
第五条
Article V
南アフリカ共和国政府は、前条に規定する日本国の技術協力及び青年海外協力隊の事業の結果として南アフリカ国民が取得した技術及び知識並びに南アフリカ共和国政府に贈与された設備、機械及び資材が同国の経済的及び社会的発展に寄与し、かつ、軍事目的に使用されないことを確保するため、同国の国内法令を適用する。
The Government of the Republic of South Africa shall apply South African domestic laws and regulations in order to ensure that the techniques and knowledge acquired by South African nationals as well as the equipment, machinery and materials donated to the Government of the Republic of South Africa as a result of the Japanese technical cooperation and the Japan Overseas Cooperation Volunteers Program as set forth in Article IV contribute to the economic and social development of the Republic of South Africa, and are not utilized for military purposes.
第六条
Article VI
１ 南アフリカ共和国政府は、専門家、シニア海外ボランティア、調査団の構成員及び青年海外協力隊員に対し、次のことを行う。
1. The Government of the Republic of South Africa shall accord the Experts, the Senior Volunteers, members of the Missions and the Japan Overseas Cooperation Volunteers:
(a) 公務の遂行において行った口頭又は書面による陳述及び行動に関し、民事及び刑事の裁判権から免除すること。
(a) immunity from civil and criminal jurisdiction with respect to words spoken or written and acts performed by them in the exercise of their official functions;
(b) ＪＩＣＡが支払う給料及び手当に対する租税その他の課徴金の賦課を免除すること。
(b) exemption from taxation and imposition of other fiscal charges on the salaries and emoluments paid to them by JICA;
(c) 為替の便益に関して、南アフリカ共和国に派遣されている者であって、ＪＩＣＡ事務所と同様の地位にある他の事務所において専門家、シニア海外ボランティア、調査団の構成員又は青年海外協力隊員に相当する地位にあるものに与えられる特権と同一の特権を与えること。
(c) the same privileges in respect of exchange facilities as are accorded to representatives and/or staff of comparable ranks at offices of similar status accredited to the Republic of South Africa;
(d) 国際的な危機の場合に、南アフリカ共和国に派遣されている者であって、ＪＩＣＡ事務所と同様の地位にある他の事務所において専門家、シニア海外ボランティア、調査団の構成員又は青年海外協力隊員に相当する地位にあるものに与えられる帰国の便益と同一の帰国の便益を与えること（この便益は、専門家、シニア海外ボランティア、調査団の構成員及び青年海外協力隊員の家族に対しても与えられる。）。
(d) together with members of their families, the same repatriation facilities in time of international crisis as are accorded to representatives and/or staff of comparable ranks at offices of similar status accredited to the Republic of South Africa;
(e) 最初の到着後六箇月以内に、全ての租税（関税を含む。）その他の課徴金並びに輸入許可証及び為替証明書の取得要件を免除されて、私用に供される携帯荷物、身回品、家財及び消費財を輸入する権利を与えること（この権利は、専門家、シニア海外ボランティア、調査団の構成員及び青年海外協力隊員の家族に対しても与えられる。）。
(e) together with members of their families, the right to import, free of all taxes, including customs duties, and other fiscal charges as well as of the requirements of obtaining import licenses and certificates of foreign exchange coverage, their luggage, personal effects, household effects and consumer goods for personal use within six months of their initial arrival;
(f) 調査団の構成員の場合を除くほか、最初の到着後六箇月以内に、全ての租税（関税及び付加価値税を含む。）その他の課徴金並びに輸入許可証及び為替証明書の取得要件を免除されて、第一条(c)に定義する家族を一人以上同伴する場合には二台、そのような家族を同伴しない場合には一台の自動車を輸入し、又は現地購入する権利を与えること。
(f) with the exception of the members of the Missions, the right to import or purchase locally, free of all taxes, including customs duties and value added tax, and other fiscal charges as well as of the requirements of obtaining import licenses and certificates of foreign exchange coverage, two motor vehicles if they are accompanied by one or more members of their family as defined in sub-paragraph (c) of Article I and one motor vehicle if they are not accompanied by such members of their family within six months of their initial arrival;
(g) 青年海外協力隊員に関し、南アフリカ共和国政府の関係当局の定める条件に基づき、その公務の遂行に必要な無線通信機を設置し、及び使用する許可を与えること。
(g) with respect to the Japan Overseas Cooperation Volunteers, permission to install and use radio communication sets necessary for the exercise of their official functions under such conditions as determined by the relevant authorities of the Government of the Republic of South Africa; and
(h) 出入国制限及び外国人登録を免除すること（この免除は、専門家、シニア海外ボランティア、調査団の構成員及び青年海外協力隊員の家族に対しても与えられる。）。
(h) together with members of their families, exemption from immigration restrictions and alien registration.
２ 南アフリカ共和国政府は、専門家、シニア海外ボランティア、調査団の構成員及び青年海外協力隊員に対し、その公務の遂行に必要な全ての政府機関の協力を確保するため、有効な身分証明書又は適当な文書を発給する。
2. The Government of the Republic of South Africa shall issue applicable identification cards or appropriate documentation to the Experts, the Senior Volunteers, members of the Missions and the Japan Overseas Cooperation Volunteers to secure the cooperation of all governmental organizations necessary for the exercise of their official functions.
３ １(f)に規定する自動車が、その後南アフリカ共和国において、租税（関税及び付加価値税を含む。）の免除又は同様の特権を有しない個人又は団体に売却され、又は譲渡される場合には、適用のある同国の国内法令に従い、当該自動車に対してそれらの租税（関税及び付加価値税を含む。）が課される。
3. The motor vehicles mentioned in sub-paragraph (f) of paragraph 1 shall be subject to payment of taxes including customs duties and value added tax, in accordance with the applicable South African domestic laws and regulations, if they are subsequently sold or transferred within the Republic of South Africa to individuals or organizations not entitled to exemption from such taxes or similar privileges.
４ 南アフリカ共和国政府は、専門家、シニア海外ボランティア、調査団の構成員、青年海外協力隊員及びそれらの家族に対し、同国に派遣されている者であって、ＪＩＣＡ事務所と同様の地位にある他の事務所において専門家、シニア海外ボランティア、調査団の構成員又は青年海外協力隊員に相当する地位にあるものに与えられている特権、免除及び便宜よりも不利でない特権、免除及び便宜を与える。
4. The Government of the Republic of South Africa shall accord the Experts, the Senior Volunteers, members of the Missions, the Japan Overseas Cooperation Volunteers and members of their families such privileges, exemptions and benefits as are no less favorable than those accorded to representatives and/or staff of comparable ranks at offices of similar status accredited to the Republic of South Africa.
第七条
Article VII
専門家、シニア海外ボランティア、調査団の構成員及び青年海外協力隊員に関し、南アフリカ共和国政府の関係当局又は個別の技術協力計画若しくは青年海外協力隊の事業における個別の計画の実施に責任を有する同国の機関により、第三条２及び第四条２(b)に規定する実施取決めに基づき、かつ、同国の国内法令に従って、次のことが行われることになる。
With regard to the Experts, the Senior Volunteers, members of the Missions and the Japan Overseas Cooperation Volunteers, the following measures will be taken by the relevant authorities of the Government of the Republic of South Africa or South African agencies responsible for the implementation of specific technical cooperation programs and specific programs of the Japan Overseas Cooperation Volunteers Program on the basis of the implementing arrangements referred to in paragraph 2 of Article III and sub-paragraph (b) of paragraph 2 of Article IV and in compliance with South African domestic laws and regulations:
(a) 専門家、シニア海外ボランティア、調査団の構成員及び青年海外協力隊員の公務の遂行に必要な適当な事務所その他の施設（電話及びファクシミリの役務を含む。）を自己の負担で提供し、並びにそれらの運営費及び維持費を負担すること。
(a) provision, at their own expense, of suitable office and other facilities including telephone and facsimile services necessary for the exercise of their official functions as well as payment of expenses for their operation and maintenance;
(b) 専門家、シニア海外ボランティア、調査団の構成員及び青年海外協力隊員の公務の遂行に必要な現地要員（必要な場合には、適当な通訳を含む。）並びに専門家、シニア海外ボランティア、調査団の構成員及び青年海外協力隊員の相手方となる南アフリカ人の要員を自己の負担で提供すること。
(b) provision, at their own expense, of the local staff (including adequate interpreters, if necessary) as well as South African counterparts necessary for the exercise of their official functions;
(c) 次の諸経費を負担すること。
(c) payment of expenses for:
(i) 通勤費
(i) daily transportation to and from their place of work;
(ii) 南アフリカ共和国内の公用出張旅費
(ii) their official travels within the Republic of South Africa; and
(iii) 公用通信費
(iii) their official correspondence;
(d) 次のものに係る援助を提供すること（この援助は、専門家、シニア海外ボランティア、調査団の構成員及び青年海外協力隊員の家族に対しても提供される。）。
(d) together with members of their families, provision of assistance for:
(i) 適当な住居の確保
(i) acquisition of appropriate housing accommodation;
(ii) 医療上の便宜
(ii) obtaining medical care and facilities; and
(iii) 自動車運転免許証の取得
(iii) acquisition of car driving licenses;
(e) 専門家、シニア海外ボランティア、調査団の構成員及び青年海外協力隊員の任期中、南アフリカ共和国に入国し、同国に滞在し、及び同国から出国するための援助（外国人登録要件に係る手続に関するものを含む。）を提供すること（この援助は、専門家、シニア海外ボランティア、調査団の構成員及び青年海外協力隊員の家族に対しても提供される。）。
(e) together with members of their families, provision of assistance for the entry into, sojourn in and departure from the Republic of South Africa for the duration of their assignment therein, including assistance with procedures of alien registration requirements; and
(f) 専門家、シニア海外ボランティア、調査団の構成員及び青年海外協力隊員の公務の遂行に必要なその他の援助を提供すること。
(f) provision of such other assistance as is necessary for the exercise of their official functions.
第八条
Article VIII
１ ＪＩＣＡが南アフリカ共和国政府に設備、機械及び資材を供与する場合には、それらの設備、機械及び資材は、同国政府の関係当局若しくは個別の技術協力計画若しくは青年海外協力隊の事業における個別の計画の実施に責任を有する同国の機関に引き渡された時に、又は同国への輸入に際し陸揚港において保険料及び運賃込みの条件で引き渡された時に、同国政府に贈与され、同国政府の財産となる。
1. In cases where JICA provides the Government of the Republic of South Africa with equipment, machinery and materials, such equipment, machinery and materials shall be donated to and become the property of the Government of the Republic of South Africa upon delivery, or in case of importation to the Republic of South Africa, upon delivery c.i.f. at the port of the disembarkation, to the relevant authorities of the Government of the Republic of South Africa or South African agencies responsible for the implementation of specific technical cooperation programs and specific programs of the Japan Overseas Cooperation Volunteers Program.
２ １の規定に従って南アフリカ共和国政府に贈与された設備、機械及び資材の同国内における輸送のための費用並びにそれらの交換、維持及び修理のための費用は、第三条２及び第四条２(b)に規定する実施取決めに基づいて同国政府が負担する。
2. The expenses for the transportation within the Republic of South Africa of the equipment, machinery and materials donated to the Government of the Republic of South Africa in accordance with the provisions of paragraph 1 and the expenses for their replacement, maintenance and repair shall be borne by the Government of the Republic of South Africa, on the basis of the implementing arrangements referred to in paragraph 2 of Article III and sub-paragraph (b) of paragraph 2 of Article IV.
３ １の規定に従って南アフリカ共和国政府に贈与された設備、機械及び資材は、両締約国政府の権限のある当局間で別段の合意がある場合を除くほか、この協定に定める目的のために使用される。
3. The equipment, machinery and materials donated to the Government of the Republic of South Africa in accordance with the provisions of paragraph 1 shall be utilized for the purpose prescribed in this Agreement unless otherwise agreed upon between the competent authorities of the Parties.
４ 専門家、シニア海外ボランティア、調査団の構成員及び青年海外協力隊員の公務の遂行のために必要な設備、機械及び資材であってＪＩＣＡによって取得されたものは、両締約国政府の権限のある当局間で別段の合意がある場合を除くほか、ＪＩＣＡの財産とする。
4. The equipment, machinery and materials, acquired by JICA, necessary for the exercise of the official functions of the Experts, the Senior Volunteers, members of the Missions and the Japan Overseas Cooperation Volunteers shall remain the property of JICA unless otherwise agreed upon between the competent authorities of the Parties.
５ 南アフリカ共和国政府は、同国政府の権限のある当局を通じ、１及び４に規定する設備、機械及び資材について、それらの輸入及び現地購入に関し、全ての租税（関税及び付加価値税を含む。）その他の課徴金並びに輸入許可証及び為替証明書の取得要件を免除する。
5. The Government of the Republic of South Africa shall, through the competent authority of the Government of the Republic of South Africa, exempt equipment, machinery and materials mentioned in paragraphs 1 and 4 from all taxes, including customs duties and value added tax, and other fiscal charges as well as from the requirements of obtaining import licenses and certificates of foreign exchange coverage, in respect of their importation and local purchase.
第九条
Article IX
南アフリカ共和国政府の関係当局又はこの協定に基づく個別の技術協力計画若しくは青年海外協力隊の事業における個別の計画の実施に責任を有する同国の機関は、専門家、シニア海外ボランティア、調査団の構成員及び青年海外協力隊員と緊密に連絡を保つものとする。
The relevant authorities of the Government of the Republic of South Africa or South African agencies responsible for the implementation of specific technical cooperation programs and specific programs of the Japan Overseas Cooperation Volunteers Program under this Agreement shall maintain close contact with the Experts, the Senior Volunteers, members of the Missions and the Japan Overseas Cooperation Volunteers.
第十条
Article X
１ ＪＩＣＡが駐在員及び職員を置くＪＩＣＡ事務所を南アフリカ共和国において維持することができることが確認される。
1. It is confirmed that JICA may maintain the JICA Office with the Representative and the Staff in the Republic of South Africa.
２ 南アフリカ共和国政府は、駐在員及び職員に対し、次のことを行う。
2. The Government of the Republic of South Africa shall accord the Representative and the Staff:
(a) 公務の遂行において行った口頭又は書面による陳述及び行動に関し、民事及び刑事の裁判権から免除すること。
(a) immunity from civil and criminal jurisdiction with respect to words spoken or written and acts performed by them in the exercise of their official functions;
(b) ＪＩＣＡが支払う給料及び手当に対する租税その他の課徴金の賦課を免除すること。
(b) exemption from taxation and imposition of other fiscal charges on the salaries and emoluments paid to them by JICA;
(c) 為替の便益に関して、南アフリカ共和国に派遣されている者であって、ＪＩＣＡ事務所と同様の地位にある他の事務所において駐在員又は職員に相当する地位にあるものに与えられる特権と同一の特権を与えること。
(c) the same privileges in respect of exchange facilities as are accorded to representatives and/or staff of comparable ranks at offices of similar status accredited to the Republic of South Africa;
(d) 国際的な危機の場合に、南アフリカ共和国に派遣されている者であって、ＪＩＣＡ事務所と同様の地位にある他の事務所において駐在員又は職員に相当する地位にあるものに与えられる帰国の便益と同一の帰国の便益を与えること（この便益は、駐在員及び職員の家族に対しても与えられる。）。
(d) together with members of their families, the same repatriation facilities in time of international crisis as are accorded to representatives and/or staff of comparable ranks at offices of similar status accredited to the Republic of South Africa;
(e) 最初の到着後六箇月以内に、全ての租税（関税を含む。）その他の課徴金並びに輸入許可証及び為替証明書の取得要件を免除されて、私用に供される携帯荷物、身回品、家財及び消費財を輸入する権利を与えること（この権利は、駐在員及び職員の家族に対しても与えられる。）。
(e) together with members of their families, the right to import, free of all taxes, including customs duties, and other fiscal charges as well as of the requirements of obtaining import licenses and certificates of foreign exchange coverage, their luggage, personal effects, household effects and consumer goods for personal use within six months of their initial arrival;
(f) 最初の到着後六箇月以内に、全ての租税（関税及び付加価値税を含む。）その他の課徴金並びに輸入許可証及び為替証明書の取得要件を免除されて、第一条(c)に定義する家族を一人以上同伴する場合には二台、そのような家族を同伴しない場合には一台の自動車を輸入し、又は現地購入する権利を与えること。
(f) the right to import or purchase locally, free of all taxes, including customs duties and value added tax, and other fiscal charges as well as of the requirements of obtaining import licenses and certificates of foreign exchange coverage, two motor vehicles if they are accompanied by one or more members of their family as defined in sub-paragraph (c) of Article I and one motor vehicle if they are not accompanied by such members of their family within six months of their initial arrival;
(g) 出入国制限及び外国人登録を免除すること（この免除は、駐在員及び職員の家族に対しても与えられる。）。
(g) together with members of their families, exemption from immigration restrictions and alien registration;
(h) 駐在員及び職員の任期中、南アフリカ共和国に入国し、同国に滞在し、及び同国から出国するための援助（外国人登録要件に係る手続に関するものを含む。）を提供すること（この援助は、駐在員及び職員の家族に対しても提供される。）。
(h) together with members of their families, provision of assistance for the entry into, sojourn in and departure from the Republic of South Africa for the duration of their assignment therein, including assistance with procedures of alien registration requirements;
(i) 自動車運転免許証の取得のための援助を提供すること（この援助は、駐在員及び職員の家族に対しても提供される。）。
(i) together with members of their families, provision of assistance for the acquisition of car driving licenses; and
(j) 駐在員及び職員の公務の遂行に必要なその他の援助を提供すること。
(j) provision of such other assistance as is necessary for the exercise of their official functions.
３ 南アフリカ共和国政府は、駐在員及び職員に対し、有効な身分証明書を発給する。
3. The Government of the Republic of South Africa shall issue applicable identification cards to the Representatives and the Staff.
４ 南アフリカ共和国政府は、ＪＩＣＡ事務所に対し、次のことを行う。
4. The Government of the Republic of South Africa shall accord the JICA Office:
(a) ＪＩＣＡ事務所の活動及び公務に必要な設備、機械及び資材（自動車を含む。）の輸入及び現地購入に関し、全ての租税（関税及び付加価値税を含む。）その他の課徴金を免除し、並びに禁止及び制限を課すことを免除すること。ただし、両締約国政府の権限のある当局間で別段の合意がある場合を除くほか、輸入され、又は現地購入されたそれらの設備、機械及び資材（自動車を含む。）が、南アフリカ共和国内で売却されないことを条件とする。
(a) exemption from all taxes, including customs duties and value added tax, and other fiscal charges as well as from prohibition and restrictions on the equipment, machinery and materials, including motor vehicles, necessary for the activities and the official functions of the JICA Office in respect of their importation and local purchase, subject to the requirement that such equipment, machinery and materials, including motor vehicles, imported and purchased locally will not be sold in the Republic of South Africa unless otherwise agreed upon between the competent authorities of the Parties;
(b) ＪＩＣＡ事務所の建物、財産、資産及び通貨に関し、全ての租税（付加価値税を含む。）その他の課徴金を免除すること（公益事業及び公共の役務の使用料に相当するものを除く。）。
(b) exemption from all taxes, including value added tax, and other fiscal charges, except for charges for public utilities and services, with respect to the building, property, funds and currency of the JICA Office; and
(c) 次の権利を与えること。
(c) the right to:
(i) いかなる種類の資金及び通貨をも保持し、並びにいかなる通貨の勘定をも運用する権利
(i) hold funds and currency of any kind, and operate accounts in any currency; and
(ii) ＪＩＣＡ事務所が保持する資金及び通貨を南アフリカ共和国へ及び同国から自由に移転し、並びにＪＩＣＡ事務所が保持する通貨をいかなる他の通貨にも交換する権利
(ii) freely transfer its funds and currency to and from the Republic of South Africa, and convert its currency into any other currency.
５ ２(f)及び４(a)に規定する自動車が、その後南アフリカ共和国において、租税（関税及び付加価値税を含む。）の免除又は同様の特権を有しない個人又は団体に売却され、又は譲渡される場合には、適用のある同国の国内法令に従い、当該自動車に対してそれらの租税（関税及び付加価値税を含む。）が課される。
5. The motor vehicles mentioned in sub-paragraph (f) of paragraph 2 and sub-paragraph (a) of paragraph 4 shall be subject to payment of taxes, including customs duties and value added tax, in accordance with the applicable South African domestic laws and regulations, if they are subsequently sold or transferred within the Republic of South Africa to individuals or organizations not entitled to exemption from such taxes or similar privileges.
６ 南アフリカ共和国政府は、駐在員、職員及びそれらの家族並びにＪＩＣＡ事務所に対し、同国に派遣されている者であって、ＪＩＣＡ事務所と同様の地位にある他の事務所において駐在員又は職員に相当する地位にあるもの及びそのような他の事務所に与えられている特権、免除及び便宜よりも不利でない特権、免除及び便宜を与える。
6. The Government of the Republic of South Africa shall accord the Representative, the Staff and members of their families as well as the JICA Office such privileges, exemptions and benefits as are no less favorable than those accorded to representatives and/or staff of comparable ranks at offices of similar status accredited to the Republic of South Africa as well as to such offices.
第十一条
Article XI
南アフリカ共和国政府は、同国に滞在する専門家、シニア海外ボランティア、調査団の構成員、青年海外協力隊員、駐在員、職員及びそれらの家族並びにＪＩＣＡ事務所に関し、同国に派遣されている者であって、ＪＩＣＡ事務所と同様の地位にある他の事務所において駐在員又は職員に相当する地位にあるもの及びそれらの家族並びにそのような他の事務所に与えられている安全及び保護と同一の水準の安全及び保護を確保するために必要な措置をとる。
The Government of the Republic of South Africa shall take necessary measures to ensure for the Experts, the Senior Volunteers, members of the Missions, the Japan Overseas Cooperation Volunteers, the Representative, the Staff and members of their families staying in the Republic of South Africa as well as for the JICA Office, the same level of security and protection as are provided to representatives and/or staff of comparable ranks at offices of similar status accredited to the Republic of South Africa and members of their families as well as to such offices.
第十二条
Article XII
両締約国政府は、この協定から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
The Parties shall consult with each other in respect of any matter that may arise from or in connection with this Agreement.
第十三条
Article XIII
１ この協定の規定は、この協定が効力を生じた後、この協定が効力を生ずる前に開始した個別の技術協力計画及び青年海外協力隊の事業における個別の計画にも適用され、また、それらの計画に関連する南アフリカ共和国に滞在中の専門家、シニア海外ボランティア、調査団の構成員、青年海外協力隊員、駐在員、職員及びそれらの家族並びにそれらの計画に関連する設備、機械及び資材にも適用される。
1. The provisions of this Agreement shall also apply, after the entry into force of this Agreement, to the specific technical cooperation programs and specific programs of the Japan Overseas Cooperation Volunteers Program which have commenced prior to the entry into force of this Agreement, and to the Experts, the Senior Volunteers, members of the Missions, the Japan Overseas Cooperation Volunteers, the Representative, the Staff and members of their families staying in the Republic of South Africa as well as to the equipment, machinery and materials related to the said programs.
２ この協定の終了は、両締約国政府間の相互の同意により別段の決定が行われる場合を除くほか、実施中の個別の技術協力計画及び青年海外協力隊の事業における個別の計画が完了する日までの間それらの計画に影響を与えるものではなく、また、それらの計画に関連する公務を遂行するために南アフリカ共和国に滞在中の専門家、シニア海外ボランティア、調査団の構成員、青年海外協力隊員、駐在員及び職員並びにそれらの家族に対して与えられる特権、免除及び便宜に影響を与えるものではない。
2. The termination of this Agreement shall neither affect the specific technical cooperation programs nor specific programs of the Japan Overseas Cooperation Volunteers Program being carried out until the date of the completion of the said programs, unless otherwise decided upon by mutual consent between the Parties, nor affect the privileges, exemptions and benefits accorded to the Experts, the Senior Volunteers, members of the Missions, the Japan Overseas Cooperation Volunteers, the Representative, the Staff staying in the Republic of South Africa for the exercise of their official functions in connection with the said programs and to members of their families.
第十四条
Article XIV
１ この協定は、署名の日に効力を生ずる。
1. This Agreement shall enter into force on the date of the signature thereof.
２ この協定は、一年間効力を有するものとし、いずれか一方の締約国政府が他方の締約国政府に対し少なくとも六箇月の予告をもってこの協定を終了させる意思を書面により通告しない限り、毎年自動的に一年ずつ更新される。
2. This Agreement shall remain in force for a period of one year, and shall be automatically renewed every year for another period of one year each, unless either of the Parties has given to the other at least six months’ written advance notice of its intention to terminate this Agreement.
３ この協定は、両締約国政府の書面による合意により改正することができる。
3. This Agreement may be amended by agreement in writing between the Parties.
４ 青年海外協力隊員を南アフリカ共和国に派遣することに関する二千一年一月九日付けの両締約国政府間の交換公文は、この協定が効力を生ずる時に効力を失う。
4. The Exchange of Notes between the Parties concerning the dispatch of the Japan Overseas Cooperation Volunteers to the Republic of South Africa dated January 9, 2001 shall cease to be in force upon the entry into force of this Agreement.
以上の証拠として、下名は、各自の政府により正当に委任を受けてこの協定に署名した。 二千十一年六月二日に東京で、ひとしく正文である日本語及び英語により本書二通を作成した。
