(Japanese Note) Ramallah, June 30, 2011 Excellency,
書簡をもって啓上いたします。本官は、千九百九十五年九月二十八日にワシントンで署名された西岸及びガザ地域に関するイスラエルとパレスチナとの間の暫定合意（以下「暫定合意」という。）に言及するとともに、日本国政府の代表者と暫定合意に基づいて設立されたパレスチナ暫定自治政府（以下「パレスチナ自治政府」という。）のために暫定合意に従って行動するパレスチナ解放機構（以下「ＰＬＯ」という。）の代表者との間で、日本人とパレスチナ人との間の友好協力関係を強化することを目的として行われる日本国の経済協力に関して最近行われた討議に言及する光栄を有します。本官は、更に、前記の討議の結果として次の了解を日本国政府に代わって提案する光栄を有します。
I have the honour to refer to the Israeli-Palestinian Interim Agreement on the West Bank and the Gaza Strip signed in Washington on September 28, 1995 (hereinafter referred to as “the Interim Agreement”), and also refer to the recent discussions held between the representatives of the Government of Japan and of the Palestine Liberation Organization (hereinafter referred to as “the PLO”), the latter acting pursuant to the Interim Agreement for the benefit of the Palestinian Interim Self-Government Authority (hereinafter referred to as “the Palestinian Authority”) established in accordance with the Interim Agreement, concerning Japanese economic cooperation to be extended with a view to strengthening friendly and cooperative relations between the Japanese people and the Palestinian people, and have further the honour to propose on behalf of the Government of Japan the following understanding as a result of the discussions above:
１ ＰＬＯは、パレスチナ自治政府を通じて、パレスチナ自治政府行政機関がこの了解の規定に従うことを確保する。
1. The PLO shall ensure through the Palestinian Authority that the Executive Authority of the Palestinian Authority acts in compliance with the terms of the present understanding.
２ 日本国政府は、パレスチナ自治政府による経済社会開発努力の推進に寄与することを目的として、日本国の関係法令に従い、パレスチナ自治政府行政機関に対し、十億円（一、〇〇〇、〇〇〇、〇〇〇円）の贈与（以下「贈与」という。）を行う。
2. For the purpose of contributing to promotion of the economic and social development efforts by the Palestinian Authority, the Government of Japan shall extend to the Executive Authority of the Palestinian Authority, in accordance with the relevant laws and regulations of Japan, a grant of one billion Japanese yen (\1,000,000,000) (hereinafter referred to as “the Grant”).
３(1) 贈与及びその利子は、パレスチナ自治政府行政機関により、適正にかつ専ら日本国政府及びＰＬＯの関係当局間で合意する表に掲げる生産物並びにそれに付随する役務を購入するために使用される。ただし、当該生産物は、調達適格国において生産されるものとする。
3. (1) The Grant and its accrued interest shall be used by the Executive Authority of the Palestinian Authority properly and exclusively for the purchase of products enumerated in a list to be mutually agreed upon between the authorities concerned of the Government of Japan and the PLO and services incidental to such products, provided that those products are produced in eligible source countries.
(2) (1)に規定する表は、日本国政府及びＰＬＯの関係当局間の合意により修正されることがある。
(2) The list mentioned in sub-paragraph (1) above will be subject to modifications which may be agreed upon between the authorities concerned of the Government of Japan and the PLO.
(3) (1)に規定する調達適格国の範囲は、日本国政府及びＰＬＯの関係当局間で合意される。
(3) The scope of the eligible source countries mentioned in sub-paragraph (1) above shall be agreed upon between the authorities concerned of the Government of Japan and the PLO.
４(1) パレスチナ自治政府行政機関は、この了解の効力の生ずる日の後十四日以内に日本国にある銀行にパレスチナ自治政府行政機関の名義で円普通預金勘定（以下「勘定」という。）を開設し、かつ、勘定を開設した日の後七日以内に日本国政府に対し勘定を開設するための手続を完了した旨を書面により通告する。
4. (1) The Executive Authority of the Palestinian Authority shall open a yen ordinary deposit account at a bank in Japan in the name of the Executive Authority of the Palestinian Authority (hereinafter referred to as “the Account”) within fourteen days after the date of entry into force of the present understanding and shall notify in writing the Government of Japan of the completion of the procedure for opening the Account within seven days after the date of the opening of the Account.
(2) 勘定の目的は、５に規定する日本国政府が払い込む日本円を受領すること、３(1)に規定する生産物及び役務の購入に必要な支払を行うこと並びに日本国政府及びＰＬＯの関係当局間で合意されることがあるその他の支払を行うことに限られる。
(2) The sole purpose of the Account is to receive the payment in Japanese yen by the Government of Japan referred to in paragraph 5 as well as to make payments necessary for the purchase of the products and services referred to in sub-paragraph (1) of paragraph 3, and such other payment as may be agreed upon between the authorities concerned of the Government of Japan and the PLO.
５ 日本国政府は、４(1)に規定する書面による通告の受領の日から二千十二年三月三十一日までの期間に、２に規定する金額を勘定に日本円で払い込むことにより贈与を実施する。期間は、日本国政府及びＰＬＯの関係当局間の合意により延長することができる。
5. The Government of Japan shall execute the Grant by making payment in Japanese yen of the amount referred to in paragraph 2 to the Account during the period between the date of receipt of the written notification referred to in sub-paragraph (1) of paragraph 4 and March 31, 2012. The period may be extended by mutual consent between the authorities concerned of the Government of Japan and the PLO.
６(1) パレスチナ自治政府行政機関は、次のことのために必要な措置をとる。
6. (1) The Executive Authority of the Palestinian Authority shall take necessary measures:
(a) 贈与及びその利子が、日本国政府及びＰＬＯの関係当局間の合意により延長されない限り、贈与が実施された日から十二箇月以内に生産物及び役務の調達に使用するために勘定から完全に払い出されることを確保すること並びにそれ以降の勘定内の残余金を日本国政府に返済すること。
(a) to ensure that the Grant and its accrued interest be completely disbursed from the Account to be ready for the procurement of goods and/or services within a period of twelve months after the date of the execution of the Grant unless the period is extended by mutual consent between the authorities concerned of the Government of Japan and the PLO and to refund the amount remaining in the Account after the period to the Government of Japan;
(b) ３(1)に規定する生産物及び役務の購入に関連してパレスチナ自治区において課されることがある関税、域内税及びその他の財政課徴金が贈与によって負担されないことを確保すること。
(b) to ensure that customs duties, internal taxes and other fiscal levies which may be imposed in the Palestinian territories with respect to the purchase of the products and services referred to in sub-paragraph (1) of paragraph 3 shall not be borne by the Grant;
(c) 贈与及びその利子がパレスチナ自治政府による経済社会開発努力の推進のために適正にかつ効果的に使用されることを確保すること。
(c) to ensure that the Grant and its accrued interest be used properly and effectively for promotion of the economic and social development efforts by the Palestinian Authority;
(d) 贈与及びその利子が４(2)の規定に従って完全に払い出された場合、使用期間が(a)の規定に従って満了した場合又は日本国政府から要請があった場合には、日本国政府に対し、勘定に関する取引についての契約書、証書類その他の文書の写しを添付の上、その取引について、日本国政府が受け入れることができる形式の書面による報告を遅滞なく行うこと。
(d) to present to the Government of Japan a report prepared in a written form acceptable to the Government of Japan on the transactions on the Account together with copies of contracts, vouchers and other documents concerning the relevant transactions without delay when the Grant and its accrued interest are completely drawn in accordance with the provisions of sub-paragraph (2) of paragraph 4, or when the period for the use of the Grant and its accrued interest expires in accordance with the provisions of (a) above, or upon request by the Government of Japan; and
(e) 贈与の使用に当たり、環境及び社会に妥当な考慮を払うこと。
(e) to give due environmental and social consideration in the uses of the Grant.
(2) パレスチナ自治政府行政機関は、要請に応じ、日本国政府に対し、贈与に関する必要な情報を提供する。
(2) Upon request, the Executive Authority of the Palestinian Authority shall provide the Government of Japan with necessary information on the Grant.
(3) 贈与及びその利子に基づいて購入される生産物は、パレスチナ自治区から再輸出されてはならない。
(3) The products purchased under the Grant and its accrued interest shall not be re-exported from the Palestinian territories.
７(1) パレスチナ自治政府行政機関は、アラブ銀行又は日本国政府及びＰＬＯの関係当局間で合意される銀行にパレスチナ自治政府行政機関の名義で開設される勘定に、３(1)に規定する生産物の販売及び賃貸から得られる全ての収益をイスラエルの通貨で積み立てることを確保する。積み立てられる収益の金額は、日本国政府及びＰＬＯの関係当局間で別段の合意がない限り、３(1)に規定する生産物の購入に関連して行われる日本円による払込額の半額以上とする。積立ては、日本国政府及びＰＬＯの関係当局間で別段の合意がない限り、この了解が効力を生じた日から三年以内に行われる。
7. (1) The Executive Authority of the Palestinian Authority shall ensure that it will deposit in Israeli currency all the proceeds from the sales and lease of the products referred to in sub-paragraph (1) of paragraph 3 in an account to be opened in its name in Arab Bank or a bank to be agreed upon between the authorities concerned of the Government of Japan and the PLO. The amount of the proceeds to be deposited shall not be less than a half of the total yen disbursement paid with respect to the purchase of the products referred to in sub-paragraph (1) of paragraph 3, unless otherwise agreed between the authorities concerned of the Government of Japan and the PLO. The deposit shall be made within the period of three years from the date of entry into force of the present understanding, unless otherwise agreed between the authorities concerned of the Government of Japan and the PLO.
(2) このようにして積み立てられた資金は、パレスチナ自治区の経済社会開発目的のために利用される。
(2) The fund thus deposited shall be utilized for economic and social development purposes in the Palestinian territories.
(3) 日本国政府及びＰＬＯの関係当局は、積み立てられた資金の利用の詳細につきその利用に先立って相互に協議する。
(3) The authorities concerned of the Government of Japan and the PLO shall consult with each other about the detail of the utilization of the fund deposited prior to the utilization.
(4) パレスチナ自治政府行政機関は、積み立てられた資金が(2)及び(3)の規定に従って完全に使用された場合には、日本国政府に対し、その使途について、日本国政府が受け入れることができる形式の書面による報告を、遅滞なく行う。
(4) The Executive Authority of the Palestinian Authority shall present to the Government of Japan a report prepared in a written form acceptable to the Government of Japan on the utilization of the fund deposited without delay when the fund deposited is completely used in accordance with the provisions of sub-paragraphs (2) and (3) above.
８ この了解の実施に関する手続細目は、日本国政府及びＰＬＯの関係当局間の協議により合意される。
8. Further procedural details for the implementation of the present understanding shall be agreed upon through consultation between the authorities concerned of the Government of Japan and the PLO.
９ 日本国政府及びパレスチナ自治政府行政機関は、この了解から又はこれに関連して生ずることのあるいかなる事項についても相互に協議する。
9. The Government of Japan and the Executive Authority of the Palestinian Authority shall consult with each other in respect of any matter that may arise from or in connection with the present understanding.
10 この了解の実施は、パレスチナ自治政府行政機関が暫定合意に従って行使する権限及び遂行する責任の範囲内で、暫定合意に従って行われるものとする。
10. The implementation of the present understanding shall be accomplished consistent with the Interim Agreement to the full extent of the powers and responsibilities which the Executive Authority of the Palestinian Authority exercises pursuant to the Interim Agreement.
本官は、更に、この書簡及び前記の了解をＰＬＯに代わって確認される閣下の返簡が日本国政府とＰＬＯとの間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency’s Note in reply confirming on behalf of the PLO the foregoing understanding shall constitute an agreement between the Government of Japan and the PLO, which shall enter into force on the date of Your Excellency’s Note in reply.
