  　書簡をもって啓上いたします。本官は、日本国の借款に関してこの書簡の付表に掲げる日に日本国政府とコンゴ民主共和国政府との間で交換された書簡（以下「従前の書簡Ⅰ」という。）、債務救済措置に関して二千四年四月十五日に日本国政府とコンゴ民主共和国政府との間で交換された書簡（以下「従前の書簡Ⅱ」という。）、重債務貧困国の政府開発援助債務の完全な免除に関する日本国、カナダ、フランス共和国、ドイツ連邦共和国、イタリア共和国、グレートブリテン及び北アイルランド連合王国及びアメリカ合衆国の元首及び政府の長により千九百九十九年六月十八日にケルンで発出された声明並びにコンゴ民主共和国が拡大重債務貧困国イニシアティブの下で包括的な債務救済を受けるために必要な条件を満たしたことについて国際通貨基金及び国際開発協会によりそれぞれ二千十年六月三十日及び七月一日になされた承認に関し、次の了解を日本国政府に代わって提案する光栄を有します。

	With reference to the Notes exchanged between the Government of Japan and the Government of the Democratic Republic of the Congo on the dates enumerated in the List attached hereto concerning Japanese loans (hereinafter referred to as “the Previous Notes I”), to the Notes exchanged between the Government of Japan and the Government of the Democratic Republic of the Congo on April 15, 2004 concerning a debt relief measure (hereinafter referred to as “the Previous Notes II”), to the statement issued at Cologne on June 18, 1999 by the heads of State and Government of Japan,  Canada, the French Republic, the Federal Republic of Germany, the Republic of Italy, the United Kingdom of Great Britain and Northern Ireland and the United States of America regarding the full cancellation of official development assistance debt of the Heavily Indebted Poor Countries and to the approval given by the International Monetary Fund and the International Development Association respectively on June 30 and July 1, 2010 that the Democratic Republic of the Congo has met necessary conditions to receive comprehensive debt relief under the Enhanced Heavily Indebted Poor Countries Initiative, I have the honour to propose on behalf of the Government of Japan the following understanding:


  １　債務免除方式による債務救済措置が、独立行政法人国際協力機構（以下「ＪＩＣＡ」という。）により、日本国の関係法令に従ってとられることになる。

1.	A debt relief measure in the form of cancellation will be taken in accordance with the relevant laws and regulations of Japan by the Japan International Cooperation Agency (hereinafter referred to as “JICA”).


  ２　免除される債務は、従前の書簡Ⅰに従って締結された借款契約及び従前の書簡Ⅱに従って締結された債務繰延契約に基づく次の債務（以下「債務」という。）から成る。

2.	(1)	The debts to be cancelled consist of the following debts under the loan agreements concluded in accordance with the Previous Notes I and the rescheduling agreement concluded in accordance with the Previous Notes II (hereinafter referred to as “the Debts”):

(a)      　二千十年七月一日現在で償還されていない全ての元本

	(a)	all the principal outstanding as of July 1, 2010; and

(b)      　二千十年六月三十日以前に生じた未払の全ての利子（遅延利子を含む。）

	(b)	all the interest (including late interest) having accrued on or before June 30, 2010 and not paid.

    (2)　債務の総額は、八百六十億三千五百五十八万千四百八十七円（八六、〇三五、五八一、四八七円）になる。

	(2)	The total amount of the Debts will be eighty-six billion thirty-five million five hundred and eighty-one thousand four hundred and eighty-seven yen (\86,035,581,487). 

    (3)　(2)に規定する総額は、日本国政府及びコンゴ民主共和国政府の権限のある当局間の同意により修正することができる。日本国政府の権限のある当局は、外務省及び財務省であり、コンゴ民主共和国政府の権限のある当局は、財務省である。

	(3)	Modifications may be made to the total amount referred to in sub-paragraph (2) above by mutual consent between the competent authorities of the Government of Japan and of the Government of the Democratic Republic of the Congo.  The competent authorities of the Government of Japan will be the Ministry of Foreign Affairs and the Ministry of Finance, and the competent authorities of the Government of the Democratic Republic of the Congo will be the Ministry of Finance.

  ３　債務は、コンゴ民主共和国政府に対してＪＩＣＡが行う免除の通告により免除されることになる。二千十年七月一日から当該通告の日までの間（両期日を含む。）における債務に対する利子は、課されない。

3.	The Debts will be cancelled by notification to that effect to be made by JICA to the Government of the Democratic Republic of the Congo.  No interest will be charged on the Debts between July 1, 2010 and the date of such notification, both dates inclusive.

  ４　コンゴ民主共和国政府は、債務が免除される事実を考慮し、政府間協議の結果に従って、コンゴ民主共和国の貧困を削減し並びに社会的及び経済的開発を促進するために必要な措置をとる。

4.	The Government of the Democratic Republic of the Congo shall, in accordance with the result of the consultations between the two Governments, take necessary measures to reduce poverty and promote social and economic development of the Democratic Republic of the Congo, taking into account the fact that the Debts will be cancelled.

  ５　両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。            

5.	The two Governments shall consult with each other in respect of any matter that may arise from or in connection with the present understanding.

    　  本官は、更に、この書簡及び前記の了解をコンゴ民主共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。

	I have further the honour to propose that this Note and Your Excellency’s Note in reply confirming on behalf of the Government of the Democratic Republic of the Congo the foregoing understanding shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply.

  　書簡をもって啓上いたします。本官は、債務救済措置に関して二千四年四月十五日に日本国政府とコンゴ民主共和国政府との間で交換された書簡（以下「従前の書簡」という。）、重債務貧困国の適格な商業債務の百パーセント免除に関する日本国、カナダ、フランス共和国、ドイツ連邦共和国、イタリア共和国、グレートブリテン及び北アイルランド連合王国及びアメリカ合衆国の元首及び政府の長により二千年七月二十一日に沖縄で発出された声明、コンゴ民主共和国が拡大重債務貧困国イニシアティブの下で包括的な債務救済を受けるために必要な条件を満たしたことについて国際通貨基金及び国際開発協会によりそれぞれ二千十年六月三十日及び七月一日になされた承認並びに二千十年十一月十七日にパリで開催されたコンゴ民主共和国政府の代表者と関係債権諸国政府の代表者との間の協議において到達した結論に基づき日本国政府の代表者とコンゴ民主共和国政府の代表者との間で行われた最近の交渉に関し、次の了解を日本国政府に代わって提案する光栄を有します。


							

						

						

							

								
	With reference to the Notes exchanged between the Government of Japan and the Government of the Democratic Republic of the Congo on April 15, 2004 concerning a debt relief measure (hereinafter referred to as “the Previous Notes”), to the statement issued at Okinawa on July 21, 2000 by the heads of State and Government of Japan, Canada, the French Republic, the Federal Republic of Germany, the Republic of Italy, the United Kingdom of Great Britain and Northern Ireland and the United States of America regarding one hundred per cent cancellation of eligible commercial debts of the Heavily Indebted Poor Countries, to the approval given by the International Monetary Fund and the International Development Association respectively on June 30 and July 1, 2010 that the Democratic Republic of the Congo has met necessary conditions to receive comprehensive debt relief under the Enhanced Heavily Indebted Poor Countries Initiative and to the recent negotiations between the representatives of the Government of Japan and of the Government of the Democratic Republic of the Congo that were held on the basis of the conclusions reached during the consultations between the representatives of the Government of the Democratic Republic of the Congo and of the Governments of the creditor countries concerned held in Paris on November 17, 2010, I have the honour to propose on behalf of the Government of Japan the following understanding:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  １　(1)この了解に定める条件は、一方においてコンゴ民主共和国政府、その公の機関又はコンゴ民主共和国の居住者である関係債務者と他方において日本国の居住者である関係債権者との間で千九百八十三年六月三十日より前に締結された契約に基づきコンゴ民主共和国政府が保証していた次の商業上の債務の元本、繰延利子及び遅延利子であって、弁済期間が一年を超え、かつ、日本国政府が保険を引き受けたもの（以下「債務」という。）の総額に適用される。    


							

						

						

							

								
1.	(1)	The terms and conditions prescribed in the present understanding will apply to the total amount of 
the following principal, rescheduling interest and late interest of the commercial debts with a repayment period 
of more than one year insured by the Government of Japan, which were contracted before June 30, 1983 between the Government of the Democratic Republic of the Congo, its public sectors or other debtors concerned resident in the Democratic Republic of the Congo on the one hand and the creditors concerned resident in Japan on the other, and which were covered by the guarantee of the Government of the Democratic Republic of the Congo (hereinafter referred to as “the Debts”):
