円借款の供与に関する日本国政府とインドネシア共和国政府との間の交換公文

(Japanese Note)
（訳文） 書簡をもって啓上いたします。本大臣は、インドネシア共和国の経済の安定及び開発努力を促進するために供与される日本国の借款に関して日本国政府の代表者とインドネシア共和国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。
Bali, December 10, 2010 Excellency, I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Republic of Indonesia concerning a Japanese loan to be extended with a view to promoting the economic stabilization and development efforts of the Republic of Indonesia:
１ 八十三億九千百万円（八、三九一、〇〇〇、〇〇〇円）の額までの円貨による借款（以下「借款」という。）が、国際復興開発銀行による第七次開発政策借款及びアジア開発銀行による第六次開発政策支援計画の下での改革計画（以下「改革計画」という。）においてインドネシア共和国政府を支援することを目的として、独立行政法人国際協力機構（以下「ＪＩＣＡ」という。）により、日本国の関係法令に従って、インドネシア共和国政府に供与されることになる。
1. A loan in Japanese yen up to the amount of eight billion three hundred and ninety-one million yen (\8,391,000,000) (hereinafter referred to as “the Loan”) will be extended, in accordance with the relevant laws and regulations of Japan, to the Government of the Republic of Indonesia by the Japan International Cooperation Agency (hereinafter referred to as “JICA”) for the purpose of supporting the Government of the Republic of Indonesia in its reform program under the Seventh Development Policy Loan by the International Bank for Reconstruction and Development and the Sixth Development Policy Support Program by the Asian Development Bank (hereinafter referred to as “the Reform Program”).
２(1) 借款は、インドネシア共和国政府とＪＩＣＡとの間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、この了解の範囲内で、なかんずく次の原則を含むことになる前記の借款契約によって規律される。
2. (1) The Loan will be made available by a loan agreement to be concluded between the Government of the Republic of Indonesia and JICA. The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreement, within the scope of the present understanding, which will contain, inter alia, the following principles:
(a) 償還期間は、五年の据置期間の後十年とする。
(a) The repayment period will be ten (10) years after the grace period of five (5) years;
(b) 利子率は、年〇・八パーセントとする。
(b) The rate of interest will be nought point eight per cent (0.8%) per annum; and
(c) 支出期間は、前記の借款契約の発効の日の後三年とする。
(c) The disbursement period will be three (3) years after the date of coming into force of the said loan agreement.
(2) (1)(c)に規定する支出期間は、両政府の関係当局の同意を得て延長することができる。
(2) The disbursement period mentioned in sub-paragraph (1)(c) above may be extended with the consent of the authorities concerned of the two Governments.
３(1) 借款は、インドネシア共和国の権限のある当局が既に行ったか又は将来行う予算支出（両政府の関係当局間で合意する表に掲げる生産物のためのものを除く。）を対象として使用に供される。
3. (1) The Loan will be made available to cover budget expenditures already made and/or to be made by the competent authorities of the Republic of Indonesia except those for such products as will be enumerated in a list to be mutually agreed upon between the authorities concerned of the two Governments.
(2) (1)に規定する表は、両政府の関係当局間の合意によって修正することができる。
(2) The list mentioned in sub-paragraph (1) above may be modified by agreement between the authorities concerned of the two Governments.
４ インドネシア共和国政府は、インドネシア共和国政府の名義でインドネシア銀行に開設される国家予算勘定に借款の円貨による支出額に等しい額をインドネシアの通貨で振り替えるようにするための措置をとる。このようにして振り替えられた額は、インドネシア共和国政府の国家予算に編入され、インドネシア共和国の経済の安定及び開発努力を促進するために使用される。
4. The Government of the Republic of Indonesia shall take measures to have the equivalent in Indonesian currency of the amount of yen disbursements of the Loan transferred to the state budget account opened in the name of the Government of the Republic of Indonesia at Bank Indonesia. The amount thus transferred shall be included in the state budget of the Government of the Republic of Indonesia, and shall be used to promote the economic stabilization and development efforts of the Republic of Indonesia.
５ 借款の元本の償還並びに利子及びその他いかなる課徴金の支払の責任も、インドネシア共和国政府が負う。
5. The Government of the Republic of Indonesia shall bear the responsibility for the repayment of principal of the Loan, as well as the payment of interest and any other charges thereon.
６ インドネシア共和国政府は、借款に基づく生産物又は役務の調達がＪＩＣＡの調達のためのガイドライン（国際競争入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際競争入札の手続をなかんずく定める。）に従って実施されることを確保する。
6. The Government of the Republic of Indonesia shall ensure that the procurement of products and/or services under the Loan be carried out in accordance with the guidelines for procurement of JICA, which set forth, inter alia, the procedures of international competitive bidding to be followed except where such procedures are inapplicable or inappropriate.
７ インドネシア共和国政府は、借款に基づいて購入される生産物の海上輸送及び海上保険に関し、海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限を課することも差し控える。
7. With regard to the shipping and marine insurance of the products purchased under the Loan, the Government of the Republic of Indonesia shall refrain from imposing any restrictions that may hinder fair and free competition among the shipping and marine insurance companies.
８ インドネシア共和国政府は、ＪＩＣＡについて、借款及びそれから生ずる利子に対して又はそれらに関連して課されるインドネシアの財政課徴金及び租税を免除する。
8. The Government of the Republic of Indonesia shall exempt JICA from Indonesian fiscal levies and taxes on and/or in connection with the Loan as well as interest accruing therefrom.
９(1) インドネシア共和国政府は、借款が適正にかつ専ら３(1)に規定する予算支出のために使用されることを確保するために必要な措置をとる。
9. (1) The Government of the Republic of Indonesia shall take necessary measures to ensure that the Loan be used properly and exclusively for the budget expenditures mentioned in sub-paragraph (1) of paragraph 3.
(2) インドネシア共和国政府は、この了解に基づく両政府の権利及び義務に影響を及ぼすことなく、インドネシア共和国の関係法令に従って借款を使用する。
(2) Without prejudice to the rights and obligations of the two Governments under the present understanding, the Government of Republic of Indonesia shall utilize the Loan in accordance with the relevant laws and regulations of the Republic of Indonesia.
10(1) インドネシア共和国政府は、要請に応じ、日本国政府及びＪＩＣＡに対し、次のものを提供する。
10. (1) The Government of the Republic of Indonesia shall, upon request, furnish the Government of Japan and JICA with:
(a) 借款の使途及び改革計画の実施の進捗状(ちよく)況についての情報及び資料
(a) information and data concerning the use of the Loan and the progress of the implementation of the Reform Program; and
(b) 借款及び改革計画に関連するその他の情報
(b) any other information related to the Loan and the Reform Program.
(2) 両政府は、(1)に規定する情報及び資料に基づいて、共同して借款の使用及び改革計画の実施の進捗状(ちよく)況を随時検討し、必要に応じ、改革計画の効果的かつ円滑な実施及び借款の適正な使用を確保するために適当な措置をとる。ＪＩＣＡは、その検討に参加するよう招かれる。
(2) The two Governments shall jointly review from time to time, on the basis of the information and data mentioned in sub-paragraph (1) above, the use of the Loan and the progress of the implementation of the Reform Program and take, if necessary, appropriate measures to secure the effective and smooth implementation of the Reform Program as well as the proper use of the Loan. JICA will be invited to participate in such review.
11 両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
11. The two Governments shall consult with each other in respect of any matter that may arise from or in connection with the present understanding.
本大臣は、更に、この書簡及び前記の了解をインドネシア共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency’s Note in reply confirming on behalf of the Government of the Republic of Indonesia the foregoing understanding shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply.

本大臣は、更に、前記の了解をインドネシア共和国政府に代わって確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成し、その合意がこの返簡の日付の日に効力を生ずるものとすることに同意する光栄を有します。
I have further the honour to confirm on behalf of the Government of the Republic of Indonesia the foregoing understanding and to agree that Your Excellency’s Note and this Note in reply shall constitute an agreement between the two Governments, which shall enter into force on the date of this Note in reply.
