債務救済措置（債務繰延方式及び債務支払猶予方式）に関する日本国政府とコートジボワール共和国政府との間の交換公文
（日本側書簡） （訳文）
(Japanese Note) Abidjan, March 16, 2010 Excellency,
書簡をもって啓上いたします。本使は、二千九年五月十五日にパリで開催されたコートジボワール共和国政府の代表者と関係債権諸国（以下「債権諸国」という。）政府の代表者との間の協議において到達した結論に基づき日本国政府の代表者とコートジボワール共和国政府の代表者との間で行われた最近の交渉に言及する光栄を有します。本使は、更に、当該交渉において到達した次の了解を確認する光栄を有します。
I have the honour to refer to the recent negotiations between the representatives of the Government of Japan and of the Government of the Republic of Cote d’Ivoire that were held on the basis of the conclusions reached during the consultations between the representatives of the Government of the Republic of Cote d’Ivoire and of the Governments of the creditor countries concerned (hereinafter referred to as “the Creditor Countries”) held in Paris on May 15, 2009. I have further the honour to confirm the following understanding reached in the course of the said negotiations:
１ 債務繰延方式及び債務支払猶予方式による債務救済措置が、独立行政法人国際協力機構（以下「ＪＩＣＡ」という。）により、日本国の関係法令に従ってとられることになる。
1. A debt relief measure in the form of rescheduling and deferral will be taken in accordance with the relevant laws and regulations of Japan by the Japan International Cooperation Agency (hereinafter referred to as “JICA”).
２(1) 繰り延べられる債務は、コートジボワール共和国政府がＪＩＣＡに対して負う次の債務から成る。
2. (1) The debts to be rescheduled consist of the following debts which the Government of the Republic of Cote d’Ivoire owes to JICA.
円借款の供与に関してコートジボワール共和国政府と海外経済協力基金（以下「基金」という。）との間で千九百八十三年七月一日より前に締結された借款契約に基づいて支払われるべき債務又は円借款の繰延べに関してコートジボワール共和国政府と基金又は国際協力銀行（以下「銀行」という。）との間で締結された債務繰延契約に基づいて支払われるべき債務（以下「繰延債務」という。）は、次のとおりである。
The debts payable under the loan agreements concluded before July 1, 1983 between the Government of the Republic of Cote d’Ivoire and the Overseas Economic Cooperation Fund (hereinafter referred to as “the Fund”) on the extension of yen loans or the rescheduling agreements concluded between the Government of the Republic of Cote d’Ivoire and the Fund or the Japan Bank for International Cooperation (hereinafter referred to as “the Bank”) on the rescheduling of yen loans (hereinafter referred to as “the Rescheduled Debts”) are as follows:
(a) 過去に繰り延べられなかった債務に関し、二千九年三月三十一日以前に弁済期限の到来した未払の元本及び契約上の利子（遅延利子を含む。）の百パーセント（それらの内訳は、この書簡の付表一に掲げられる。）
(a) for the debts not previously rescheduled, one hundred per cent (100%) of the principal and contractual interest (including late interest) having fallen due on or before March 31, 2009 and not paid, the breakdown of which is shown in the List 1 attached hereto; and
(b) 千九百九十年十月十九日、千九百九十二年十一月十三日、千九百九十五年三月二十七日、千九百九十九年六月十八日及び二千三年十二月八日に日本国政府とコートジボワール共和国政府との間で交換された書簡により行われた合意に従って過去に繰り延べられた債務に関し、
(b) for the debts previously rescheduled pursuant to the agreements made by the Notes exchanged between the Government of Japan and the Government of the Republic of Cote d’Ivoire on October 19, 1990, November 13, 1992, March 27, 1995, June 18, 1999 and December 8, 2003:
(i) 二千九年三月三十一日以前に弁済期限の到来した未払の元本及び繰延利子（遅延利子を含む。）の百パーセント（それらの内訳は、この書簡の付表二に掲げられる。）
(i) one hundred per cent (100%) of the principal and rescheduling interest (including late interest) having fallen due on or before March 31, 2009 and not paid, the breakdown of which is shown in the List 2 attached hereto;
(ii) 二千九年四月一日から二千十年三月三十一日までの間（両期日を含む。）に弁済期限の到来したか又は到来する未払の元本及び繰延利子（遅延利子を除く。）の百パーセント（それらの内訳は、この書簡の付表三に掲げられる。）
(ii) one hundred per cent (100%) of the principal and rescheduling interest (excluding late interest) having fallen or falling due between April 1, 2009 and March 31, 2010, both dates inclusive, and not paid, the breakdown of which is shown in the List 3 attached hereto;
(iii) 二千十年四月一日から二千十一年三月三十一日までの間（両期日を含む。）に弁済期限の到来する元本及び繰延利子（遅延利子を除く。）の百パーセント（それらの内訳は、この書簡の付表四に掲げられる。）。ただし、(A)から(C)までに定める条件が満たされている場合に限る。
(iii) one hundred per cent (100%) of the principal and rescheduling interest (excluding late interest) falling due between April 1, 2010 and March 31, 2011, both dates inclusive, the breakdown of which is shown in the List 4 attached hereto, provided that the conditions set out in (A),(B)and (C)bellow are fulfilled:
(A) 国際通貨基金（以下「ＩＭＦ」という。）の理事会が、二千十年四月一日から二千十年九月三十日までにコートジボワール共和国政府のための貧困削減・成長措置（以下「ＰＲＧＦ」という。）に基づく取極の審査を終了すること。
(A) the Executive Board of the International Monetary Fund (hereinafter referred to as “the IMF”) has completed after April 1, 2010 before September 30, 2010 a review of the arrangement under the Poverty Reduction and Growth Facility (hereinafter referred to as “the PRGF”) for the Government of the Republic of Cote d’Ivoire;
(B) コートジボワール共和国政府が、二千九年五月十五日にパリにおいてコートジボワール共和国政府の代表者及び債権諸国政府の代表者によって署名された合意議事録（以下「合意議事録」という。）に参加していない者であって対外債権を有するもの又はその集団の各々との交渉における進捗の(ちよく)報告を、パリ・クラブに対し合意議事録の署名の後三年の間六箇月ごとに送付すること。
(B) the Government of the Republic of Cote d’Ivoire has sent a report on the progress accomplished in the negotiations with each of its external creditor or category of external creditors that are not participating in the Agreed Minutes signed by the representatives of the Government of the Republic of Cote d’Ivoire and of the Governments of the Creditor Countries in Paris on May 15, 2009 (hereinafter referred to as “the Agreed Minutes”)to the Paris Club every six month during the three years following the signing of the Agreed Minutes; and
(C) コートジボワール共和国政府が、合意議事録に参加している債権諸国に対する支払を弁済期日に行うこと。
(C) the Government of the Republic of Cote d’Ivoire has made on due dates the payments to the Creditor Countries participating in the Agreed Minutes; and
(iv) 二千十一年四月一日から二千十二年三月三十一日までの間（両期日を含む。）に弁済期限の到来する元本及び繰延利子（遅延利子を除く。）の百パーセント（それらの内訳は、この書簡の付表五に掲げられる。）。ただし、(A)から(C)までに定める条件が満たされている場合に限る。
(iv) one hundred per cent (100%) of the principal and rescheduling interest (excluding late interest) falling due between April 1, 2011 and March 31, 2012, both dates inclusive, the breakdown of which is shown in the List 5 attached hereto, provided that the conditions set out in (A), (B) and (C)bellow are fulfilled:
(A) ＩＭＦの理事会が、二千十一年四月一日から二千十一年九月三十日までにコートジボワール共和国政府のためのＰＲＧＦに基づく取極の審査を終了すること。
(A) the Executive Board of the IMF has completed after April 1, 2011 before September 30, 2011 a review of the arrangement under the PRGF for the Government of the Republic of Cote d’Ivoire;
(B) コートジボワール共和国政府が、合意議事録に参加していない者であって対外債権を有するもの又はその集団の各々との交渉における進捗の(ちよく)報告を、パリ・クラブに対し合意議事録の署名の後三年の間六箇月ごとに送付すること。
(B) the Government of the Republic of Cote d’Ivoire has sent a report on the progress accomplished in the negotiations with each of its external creditor or category of external creditors that are not participating in the Agreed Minutes to the Paris Club every six month during the three years following the signing of the Agreed Minutes; and
(C) コートジボワール共和国政府が、合意議事録に参加している債権諸国に対する支払を弁済期日に行うこと。
(C) the Government of the Republic of Cote d’Ivoire has made on due dates the payments to the Creditor Countries participating in the Agreed Minutes.
(2) 繰延債務の総額は、四十八億千六百十五万五千三百七十四円（四、八一六、一五五、三七四円）になる。
(2) The total amount of the Rescheduled Debts will be four billion eight hundred and sixteen million one hundred and fifty-five thousand three hundred and seventy-four yen (\4,816,155,374).
(3) (2)に規定する総額並びにこの書簡の付表一から五までに係る修正は、コートジボワール共和国政府の関係当局及びＪＩＣＡが行う最終的照合の後に、日本国政府及びコートジボワール共和国政府の関係当局間の合意により行うことができる。
(3) Modifications may be made to the total amount referred to in sub-paragraph (2) above and to the Lists 1, 2, 3, 4 and 5 attached hereto by agreement between the authorities concerned of the Government of Japan and of the Government of the Republic of Cote d’Ivoire, after the final verification to be made by the authorities concerned of the Government of the Republic of Cote d’Ivoire and JICA.
３ 債務繰延べの条件は、コートジボワール共和国政府とＪＩＣＡとの間で締結される債務繰延契約であって、なかんずく次の原則を含むものにおいて規定される。
3. The terms and conditions of the rescheduling will be stipulated in a rescheduling agreement to be concluded between the Government of the Republic of Cote d’Ivoire and JICA, which will contain, inter alia, the following principles:
(1) 繰延債務の各々は、この書簡の附属書Ⅰに掲げる支払計画に従って二千二十七年四月一日に始まる四十八回の半年賦払によって支払われる。
(1) Each of the Rescheduled Debts will be paid in forty-eight (48) semi-annual installments beginning on April 1, 2027 in accordance with the payment schedule shown in the Annex I attached hereto; and
(2) 繰延債務に対する利子率は年〇・〇一パーセントとし、二千九年四月一日又は繰延債務の各々の弁済期日のいずれか遅い時点から適用される。
(2) The rate of interest on the Rescheduled Debts will be nought point nought one per cent (0.01%) per annum and it will be applied from April 1, 2009 or due date of each of the Rescheduled Debts, whichever is the later.
４ ３にいう債務繰延契約には、５に規定する支払の条件を含む。
4. The rescheduling agreement referred to in paragraph 3 above will also stipulate the terms and conditions of the payments provided for in paragraph 5 below.
５(1) 支払猶予される債務は、コートジボワール共和国政府がＪＩＣＡに対して負う次の(a)及び(b)にいう債務から成る。
5. (1) The debts to be deferred consist of the following debts referred to in (a) and (b) below, which the Government of the Republic of Cote d’Ivoire owes to JICA.
(a) 繰延債務に対して二千九年四月一日から二千十二年三月三十一日までの間（両期日を含む。）に課される利子の百パーセント
(a) one hundred per cent (100%) of the interest on the Rescheduled Debts to be charged for the period between April 1, 2009 and March 31, 2012, both dates inclusive; and
(b) コートジボワール共和国政府と基金又は銀行との間で千九百八十三年七月一日以後に締結された借款契約及び債務繰延契約に従って支払われるべき次の債務
(b) the following debts payable under the loan agreements and rescheduling agreements concluded on or after July 1, 1983 between the Government of the Republic of Cote d’Ivoire and the Fund or the Bank:
(i) 過去に繰り延べられなかった債務であって二千九年三月三十一日以前に弁済期限の到来した未払の元本及び契約上の利子（遅延利子を含む。）の百パーセント（それらの内訳は、この書簡の付表六に掲げられる。）
(i) one hundred per cent (100%) of the principal and contractual interest (including late interest) on the debts not previously rescheduled having fallen due on or before March 31, 2009 and not paid, the breakdown of which is shown in the List 6 attached hereto;
(ii) 過去に繰り延べられた債務であって二千九年三月三十一日以前に弁済期限の到来した未払の元本及び繰延利子（遅延利子を含む。）の百パーセント（それらの内訳は、この書簡の付表七に掲げられる。）
(ii) one hundred per cent (100%) of the principal and rescheduling interest (including late interest)on the debts previously rescheduled having fallen due on or before March 31, 2009 and not paid, the breakdown of which is shown in the List 7 attached hereto;
(iii) 二千九年四月一日から二千十年三月三十一日までの間（両期日を含む。）に弁済期限の到来したか又は到来する未払の元本及び契約上の利子（遅延利子を除く。）の百パーセント（それらの内訳は、この書簡の付表八に掲げられる。）
(iii) one hundred per cent (100%) of the principal and contractual interest (excluding late interest) having fallen or falling due between April 1, 2009 and March 31, 2010, both dates inclusive, and not paid, the breakdown of which is shown in the List 8 attached hereto;
(iv) 二千十年四月一日から二千十一年三月三十一日までの間（両期日を含む。）に弁済期限の到来する元本及び契約上の利子（遅延利子を除く。）の百パーセント（それらの内訳は、この書簡の付表九に掲げられる。）。ただし、(A)から(C)までに定める条件が満たされている場合に限る。
(iv) one hundred per cent (100%) of the principal and contractual interest (excluding late interest) falling due between April 1, 2010 and March 31, 2011, both dates inclusive, the breakdown of which is shown in the List 9 attached hereto, provided that the conditions set out in (A), (B)and (C)bellow are fulfilled:
(A) ＩＭＦの理事会が、二千十年四月一日から二千十年九月三十日までにコートジボワール共和国政府のためのＰＲＧＦに基づく取極の審査を終了すること。
(A) the Executive Board of the IMF has completed after April 1, 2010 before September 30, 2010 a review of the arrangement under the PRGF for the Government of the Republic of Cote d’Ivoire;

(v) one hundred per cent (100%) of the principal and contractual interest (excluding late interest) falling due between April 1, 2011 and March 31, 2012, both dates inclusive, the breakdown of which is shown in the List 10 attached hereto, provided that the conditions set out in (A),(B)and (C)bellow are fulfilled:
(A) ＩＭＦの理事会が、二千十一年四月一日から二千十一年九月三十日までにコートジボワール共和国政府のためのＰＲＧＦに基づく取極の審査を終了すること。

(C) コートジボワール共和国政府が、合意議事録に参加している債権諸国に対する支払を弁済期日に行うこと。
(C) the Government of the Republic of Cote d’Ivoire has made on due dates the payments to the Creditor Countries participating in the Agreed Minutes; and
(vi) (i)から(v)までに定める猶予される債務に対する利子であって二千九年四月一日から二千十二年三月三十一日までの間（両期日を含む。）に課されるものの百パーセント
(vi) one hundred percent (100%) of the interest on the debts to be deferred referred to in (i), (ii), (iii), (iv), and (v) above to be charged for the period between April 1,2009 and March 31, 2012, both dates inclusive.
(2)(a) (1)(a)にいう債務を以下「支払猶予債務Ⅰ」という。
(2) (a) The debts referred to in (a) of sub-paragraph(1) above are hereinafter referred to as “the Deferred Debts I”.
(b) (1)(b)(i)及び(ii)にいう債務を以下「支払猶予債務Ⅱ」と総称する。
(b) The debts referred to in (b)(i) and (b)(ii) of sub-paragraph(1) above are hereinafter collectively referred to as “the Deferred Debts II”.
(c) (1)(b)(iii)から(v)までにいう債務を以下「支払猶予債務Ⅲ」と総称する。
(c) The debts referred to in (b)(iii), (b)(iv) and (b)(v)of sub-paragraph(1) above are hereinafter collectively referred to as “the Deferred Debts III”.
(d) (1)(b)(vi)にいう債務を以下「支払猶予債務Ⅳ」という。
(d) The debts referred to in (b)(vi) of sub-paragraph (1) above are hereinafter referred to as “the Deferred Debts IV”.
(3)(a) 支払猶予債務Ⅰの総額は、百三十万七千百四十四円（一、三〇七、一四四円）と見積もられる。
(3) (a) The total amount of the Deferred Debts I is estimated at one million three hundred and seven thousand one hundred and forty-four yen (\1,307,144).
(b) 支払猶予債務Ⅱの総額は、五十三億四千五百九十三万二千百十円（五、三四五、九三二、一一〇円）と見積もられる。
(b) The total amount of the Deferred Debts II is estimated at five billion three hundred and forty-five million nine hundred and thirty-two thousand one hundred and ten yen (\5,345,932,110).
(c) 支払猶予債務Ⅲの総額は、十三億三千百三十万七千七百三円（一、三三一、三〇七、七〇三円）と見積もられる。
(c) The total amount of the Deferred Debts III is estimated at one billion three hundred and thirty-one million three hundred and seven thousand seven hundred and three yen (\1,331,307,703).
(d) 支払猶予債務Ⅳの総額は、百六十九万千百五十二円（一、六九一、一五二円）と見積もられる。
(d) The total amount of the Deferred Debts IV is estimated at one million six hundred and ninety-one thousand one hundred and fifty-two yen (\1,691,152).
(4) (3)に規定する総額並びにこの書簡の付表六から十までに係る修正は、コートジボワール共和国政府の関係当局及びＪＩＣＡが行う最終的照合の後に、日本国政府及びコートジボワール共和国政府の関係当局間の合意により行うことができる。
(4) Modifications may be made to the total amount referred to in sub-paragraph (3) above and to the Lists 6, 7, 8, 9, and 10 attached hereto by agreement between the authorities concerned of the Government of Japan and of the Government of the Republic of Cote d’Ivoire, after the final verification to be made by the authorities concerned of the Government of the Republic of Cote d’Ivoire and JICA.
(5)(a) 支払猶予債務Ⅰ、Ⅲ及びⅣの各々は、この書簡の付属書Ⅱに掲げる支払計画に従って、二千十二年九月三十日に始まる七回の年賦払によって支払われる。
(5) (a) Each of the Deferred Debts I, III and IV will be paid in seven (7)annual installments beginning on September 30, 2012 in accordance with the payment schedule shown in the Annex II attached hereto.
(b) 支払猶予債務Ⅱの各々は、この書簡の付属書Ⅲに掲げる支払計画に従って、二千十年三月三十一日に始まる十五回の半年賦払によって支払われる。
(b) Each of the Deferred Debts II will be paid in fifteen (15) semi-annual installments beginning on March 31, 2010 in accordance with the payment schedule shown in the Annex III attached hereto.
(6) 支払猶予債務ⅠからⅣまでに対する利子率は年〇・〇一パーセントとし、二千九年四月一日から適用される。
(6) The rate of interest on the Deferred Debts I, II, III and IV will be nought point nought one per cent (0.01%) per annum and it will be applied from April 1, 2009.
６ コートジボワール共和国の債務（この了解が対象とする債務を含む。）の再編に関連してコートジボワール共和国政府の代表者及び債権諸国政府の代表者が新たな結論に到達した場合には、日本国政府とコートジボワール共和国政府との間でこの了解の継続又は修正について討議するために協議が行われる。
6. If the representative of the Government of the Republic of Cote d’Ivoire and the representatives of the Governments of the Creditor Countries come to a new conclusion in connection with reorganization of the debts of the Republic of Cote d’Ivoire including the debts covered by the present understanding, the Government of Japan and the Government of the Republic of Cote d’Ivoire shall hold consultations in order to discuss the matter of continuation or modification of the present understanding.
本使は、更に、この書簡及び前記の了解をコートジボワール共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency’s Note in reply confirming on behalf of the Government of the Republic of Cote d’Ivoire the foregoing understanding shall constitute an agreement between the two Governments, which shall enter into force on the date of your Excellency’s Note in reply.

I have the honour to acknowledge the receipt of Your Excellency’s Note of today’s date, which reads as follows:

本大臣は、更に、前記の了解をコートジボワール共和国政府に代わって確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成し、その合意がこの返簡の日付の日に効力を生ずるものとすることに同意する光栄を有します。
I have further the honour to confirm on behalf of the Government of the Republic of Cote d’Ivoire the foregoing understanding and to agree that Your Excellency’s Note and this Note in reply shall constitute an agreement between the two Governments, which shall enter into force on the date of this Note in reply.
