債務救済措置（債務免除方式）に関する日本国政府と中央アフリカ共和国政府との間の交換公文
（日本側書簡）
(Japanese Note) Yaounde, March 5, 2010 Excellency,
（訳文） 書簡をもって啓上いたします。本使は、日本国の借款に関して千九百八十七年十二月十九日に日本国政府と中央アフリカ共和国政府との間で交換された書簡（以下「従前の書簡Ⅰ」という。）、債務救済措置に関して二千八年三月十日に日本国政府と中央アフリカ共和国政府との間で交換された書簡（以下「従前の書簡Ⅱ」という。）、債務免除方式による債務救済措置に関して二千七年三月一日に日本国政府と中央アフリカ共和国政府との間で交換された書簡（以下「従前の書簡Ⅲ」という。）、重債務貧困国の政府開発援助債務の完全な免除に関する日本国、カナダ、フランス共和国、ドイツ連邦共和国、イタリア共和国、グレートブリテン及び北アイルランド連合王国及びアメリカ合衆国の元首及び政府の長により千九百九十九年六月十八日にケルンで発出された声明並びに中央アフリカ共和国が拡大重債務貧困国イニシアティブの下で包括的な債務救済を受けるために必要な条件を満たしたことについて国際通貨基金及び国際開発協会によりそれぞれ二千九年六月二十九日及び三十日になされた承認に関し、次の了解を日本国政府に代わって提案する光栄を有します。
With reference to the Notes exchanged between the Government of Japan and the Government of the Central African Republic on December 19, 1987 concerning Japanese loan (hereinafter referred to as “the Previous Notes I”), to the Notes exchanged between the Government of Japan and the Government of the Central African Republic on March 10, 2008 concerning debt relief measures (hereinafter referred to as “the Previous Notes II”), to the Notes exchanged between the Government of Japan and the Government of the Central African Republic on March 1, 2007 concerning a debt relief measure in the form of cancellation (hereinafter referred to as “the Previous Notes III”), to the statement issued at Cologne on June 18, 1999 by the heads of State and Government of Japan, Canada, the French Republic, the Federal Republic of Germany, the Republic of Italy, the United Kingdom of Great Britain and Northern Ireland and the United States of America regarding the full cancellation of official development assistance debt of the Heavily Indebted Poor Countries and to the approval given by the International Monetary Fund and the International Development Association on June 29 and 30, 2009 respectively that the Central African Republic has met necessary conditions to receive comprehensive debt relief under the Enhanced Heavily Indebted Poor Countries Initiative, I have the honour to propose on behalf of the Government of Japan the following understanding:
１ 債務免除方式による債務救済措置が、独立行政法人国際協力機構（以下「ＪＩＣＡ」という。）により、日本国の関係法令に従ってとられることになる。
1. A debt relief measure in the form of cancellation will be taken in accordance with the relevant laws and regulations of Japan by the Japan International Cooperation Agency (hereinafter referred to as “JICA”).
２ 免除される債務は、従前の書簡Ⅰに従って締結された借款契約及び従前の書簡Ⅱに従って締結された債務繰延契約に基づく次の債務（以下「債務」という。）から成る。
2. (1) The debts to be cancelled consist of the following debts under the loan agreement concluded in accordance with the Previous Notes I and the rescheduling agreement concluded in accordance with the Previous Notes II (hereinafter referred to as “the Debts”):
(a) 二千九年六月一日現在で償還されていないすべての元本
(a) all the principal outstanding as of June 1, 2009; and
(b) 二千九年五月三十一日以前に生じた未払のすべての利子（遅延利子を含む。）
(b) all the interest (including late interest) having accrued on or before May 31, 2009 and not paid.
(2) 債務の総額は、五億三千八百九十万七千百四十二円（五三八、九〇七、一四二円）になる。
(2) The total amount of the Debts will be five hundred and thirty-eight million nine hundred and seven thousand one hundred and forty-two yen (\538,907,142).
(3) (2)に規定する総額は、日本国政府及び中央アフリカ共和国政府の権限のある当局間の同意により修正することができる。日本国政府の権限のある当局は、外務省及び財務省であり、中央アフリカ共和国政府の権限のある当局は、財務・予算省である。
(3) Modifications may be made to the total amount referred to in sub-paragraph (2) above by mutual consent between the competent authorities of the Government of Japan and of the Government of the Central African Republic. The competent authorities of the Government of Japan will be the Ministry of Foreign Affairs and the Ministry of Finance, and the competent authorities of the Government of the Central African Republic will be the Ministry of Finance and Budget.
３ 債務は、中央アフリカ共和国政府に対してＪＩＣＡが行う免除の通告により免除されることになる。二千九年六月一日から当該通告の日までの間（両期日を含む。）における債務に対する利子は、課されない。
3. The Debts will be cancelled by notification to that effect to be made by JICA to the Government of the Central African Republic. No interest will be charged on the Debts between June 1, 2009 and the date of such notification, both dates inclusive.
４ 中央アフリカ共和国政府は、債務が免除される事実を考慮し、政府間協議の結果に従って、中央アフリカ共和国の貧困を削減し並びに社会的及び経済的開発を促進するために必要な措置をとる。
4. The Government of the Central African Republic shall, in accordance with the result of the consultations between the two Governments, take necessary measures to reduce poverty and promote social and economic development of the Central African Republic, taking into account the fact that the Debts will be cancelled.
５ 両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
5. The two Governments shall consult with each other in respect of any matter that may arise from or in connection with the present understanding.
６ 従前の書簡Ⅲに述べられた了解は、この書簡が交換された日からこの了解によって代替され、無効となる。
6. The understanding contained in the Previous Notes III is superseded by the present understanding and shall be null and void from the date of exchange of the present Notes.
(1) 従前の書簡Ⅲに述べられた了解に基づき、一定の債務が、二千三年四月一日から二千四年三月三十一日までの二千三年度、二千四年四月一日から二千五年三月三十一日までの二千四年度、二千五年四月一日から二千六年三月三十一日までの二千五年度、二千六年四月一日から二千七年三月三十一日までの二千六年度、二千七年四月一日から二千八年三月三十一日までの二千七年度及び二千八年四月一日から二千九年三月三十一日までの二千八年度の各事業年度における免除の日程に従って既に免除された。
(1) The certain debts have been cancelled, pursuant to the understanding contained in the Previous Notes III, according to the schedule of cancellation for the fiscal years 2003, 2004, 2005, 2006, 2007 and 2008 which is respectively from April 1, 2003 to March 31, 2004, from April 1, 2004 to March 31, 2005, from April 1, 2005 to March 31, 2006, from April 1, 2006 to March 31, 2007, from April 1, 2007 to March 31, 2008 and from April 1, 2008 to March 31, 2009.
(2) (1)に規定する免除された債務の総額は、二億三百六十一万九千七十三円（二〇三、六一九、〇七三円）であった。
(2) The total amount of the debts cancelled referred to in sub-paragraph (1) above was two hundred and three million six hundred and nineteen thousand seventy-three yen (\203,619,073).
本使は、更に、この書簡及び前記の了解を中央アフリカ共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency’s Note in reply confirming on behalf of the Government of the Central African Republic the foregoing understanding shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply.

I have the honour to acknowledge the receipt of Your Excellency’s Note of today’s date, which reads as follows:

“(Japanese Note)” I have further the honour to confirm on behalf of the Government of the Central African Republic the foregoing understanding and to agree that Your Excellency’s Note and this Note in reply shall constitute an agreement between the two Governments, which shall enter into force on the date of this Note in reply.
本大臣は、更に、前記の了解を中央アフリカ共和国政府に代わって確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成し、その合意がこの返簡の日付の日に効力を生ずるものとすることに同意する光栄を有します。 本大臣は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。
