  　書簡をもって啓上いたします。本大臣は、ベトナム社会主義共和国の経済の安定及び開発努力を促進するために供与される日本国の借款に関して日本国政府の代表者とベトナム社会主義共和国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。


							

						

						

							

								
	I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Socialist Republic of Viet Nam concerning a Japanese loan to be extended with a view to promoting the economic stabilization and development efforts of the Socialist Republic of Viet Nam:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  １　七十億円（七、〇〇○、〇〇〇、〇〇〇円）（景気刺激支援に係る部分を除く。）、景気刺激支援に係る部分については四百七十九億円（四七、九〇〇、〇〇〇、〇〇〇円）の額までの円貨による借款（以下「借款」という。）が、第八次貧困削減支援貸付（景気刺激支援を含む。）として、国際開発協会による第八次貧困削減支援貸付の下での改革計画（以下「改革計画」という。）においてベトナム社会主義共和国政府を支援することを目的として、独立行政法人国際協力機構（以下「ＪＩＣＡ」という。）により、日本国の関係法令に従って、ベトナム社会主義共和国政府に供与されることになる。


							

						

						

							

								
1.	A loan in Japanese yen up to the amounts of seven billion yen (\7,000,000,000) (except for economic stimulus support portion), and forty-seven billion nine hundred million yen (\47,900,000,000) with regard to economic stimulus support portion (hereinafter referred to as “the Loan”) will be extended, as the Eighth Poverty Reduction Support Credit with Economic Stimulus Support, in accordance with the relevant laws and regulations of Japan, to the Government of the Socialist Republic of Viet Nam by the Japan International Cooperation Agency (hereinafter referred to as “JICA”) for the purpose of supporting the Government of the Socialist Republic of Viet Nam in its reform program under the Eighth Poverty Reduction Support Credit by the International Development Association (hereinafter referred to as “the Reform Program”).

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ２(1)　借款は、ベトナム社会主義共和国政府とＪＩＣＡとの間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、この了解の範囲内で、なかんずく次の原則を含むことになる前記の借款契約によって規律される。


							

						

						

							

								
2.	(1)	The Loan will be made available by loan agreements to be concluded between the Government of the Socialist Republic of Viet Nam and JICA.  The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreements, within the scope of the present understanding, which will contain, inter alia, the following principles:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (a)　償還期間は、十年の据置期間の後二十年（景気刺激支援に係る部分を除く。）、景気刺激支援に係る部分については三年の据置期間の後十二年とする。


							

						

						

							

								
	(a)	The repayment period will be twenty (20) years after the grace period of ten (10) years (except for economic stimulus support portion), and twelve (12) years after the grace period of three (3) years with regard to economic stimulus support portion;

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (b)　利子率は、年一・二パーセント（景気刺激支援に係る部分を除く。）、景気刺激支援に係る部分については六箇月の貸出しに適用される適用可能なロンドン銀行間取引金利とする。


							

						

						

							

								
 
(b)	The rate of interest will be one point two per cent (1.2%) per annum (except for economic stimulus support portion), and the applicable London inter-bank offered rate applied for six months lending in Japanese yen with regard to economic stimulus support portion; and


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (c)　支出期間は、前記の借款契約の発効の日の後二年とする。

    (2)　(1)(c)に規定する支出期間は、両政府の関係当局の同意を得て延長することができる。


							

						

						

							

								
	(2)	The disbursement period mentioned in sub-paragraph (1)(c) above may be extended with the consent of the authorities concerned of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ３(1)　借款は、ベトナム社会主義共和国内の輸入者が調達適格国の供給者に対して既に行ったか又は将来行う支払で、生産物（両政府の関係当局間で合意する表に掲げる生産物を除く。）の購入又は当該生産物の購入に付随する役務の購入のために両者の間で締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物又はそれらの国から供給される役務について行われる。


							

						

						

							

								
3.	(1)	The Loan will be made available to cover payments already made and/or to be made by importers in the Socialist Republic of Viet Nam to suppliers of eligible source countries under such contracts as have been and/or may be entered into between them for purchases of products, except such products as will be enumerated in a list to be mutually agreed upon between the authorities concerned of the two Governments, and/or for purchases of services incidental to the purchase of those products, provided that such purchases are made in such eligible source countries for products produced in and/or services supplied from those countries.

  ４　ベトナム社会主義共和国政府は、ベトナム社会主義共和国政府の名義で開設される国家予算勘定に借款の円貨による支出額に等しい額をベトナムの通貨で振り替えるようにするための措置をとる。このようにして振り替えられた額は、ベトナム社会主義共和国政府の国家予算に編入され、二千六年六月に承認されたベトナムの社会経済開発五箇年計画（二千六年－二千十年）の政策目標を達成するために改革計画の実施を支援するために使用される。


							

						

						

							

								
4.	The Government of the Socialist Republic of Viet Nam shall take measures to have the equivalent in Vietnamese currency of the amount of yen disbursements of the Loan transferred to the state budget account opened in the name of the Government of the Socialist Republic of Viet Nam.  The amount thus transferred shall be included in the state budget of the Government of the Socialist Republic of Viet Nam, and shall be used to support the implementation of the Reform Program to achieve policy goals stated in Viet Nam’s Five-year Socio-Economic Development Plan 2006-2010 approved in June 2006.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ５　ベトナム社会主義共和国政府は、３(1)に規定する生産物又は役務がＪＩＣＡの調達のためのガイドライン（国際競争入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際競争入札の手続をなかんずく定める。）に従って調達されることを確保する。


							

						

						

							

								
 
5.	The Government of the Socialist Republic of Viet Nam shall ensure that the products and/or services mentioned in sub-paragraph (1) of paragraph 3. are procured in accordance with the guidelines for procurement of JICA, which set forth, inter alia, the procedures of international competitive bidding to be followed except where such procedures are inapplicable or inappropriate.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ６　ベトナム社会主義共和国政府は、借款に基づいて購入される生産物の海上輸送及び海上保険に関し、海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限を課することも差し控える。


							

						

						

							

								
6.	With regard to the shipping and marine insurance of the products purchased under the Loan, the Government of the Socialist Republic of Viet Nam shall refrain from imposing any restrictions that may hinder fair and free competition among the shipping and marine insurance companies.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ７　ベトナム社会主義共和国政府は、ＪＩＣＡについて、借款及びそれから生ずる利子に対して又はそれらに関連してベトナム社会主義共和国において課されるすべての財政課徴金及び租税を免除する。


							

						

						

							

								
6.	With regard to the shipping and marine insurance of the products 7.	The Government of the Socialist Republic of Viet Nam shall exempt JICA from all fiscal levies and taxes imposed in the Socialist Republic of Viet Nam on and/or in connection with the Loan as well as interest accruing therefrom.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ８　ベトナム社会主義共和国政府は、借款が適正にかつ専ら３(1)に規定する生産物又は役務の購入のために使用されることを確保するために必要な措置をとる。


							

						

						

							

								
8.	The Government of the Socialist Republic of Viet Nam shall take necessary measures to ensure that the Loan be used properly and exclusively for purchases of products and/or services mentioned in sub-paragraph (1) of paragraph 3.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ９　情報源及び資料の出所を公正に取り扱うことを確保しつつ、ベトナム社会主義共和国政府は、要請に応じ、日本国政府及びＪＩＣＡに対し、次のものを提供する。


							

						

						

							

								
9.   10　両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。


							

						

						

							

								
10.	The two Governments shall consult with each other with respect to any matter that may arise from or in connection with the present understanding.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  　本大臣は、更に、この書簡及び前記の了解をベトナム社会主義共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
