  　書簡をもって啓上いたします。本使は、日本国の借款に関してこの書簡の付表に掲げる日に日本国政府とスーダン共和国政府との間で交換された書簡（以下「従前の書簡」という。）並びに開発途上国の債務及び開発の問題について千九百七十八年三月十一日に国際連合貿易開発会議第九回特別貿易開発理事会第三会期において採択された決議第百六十五号に関し、次の了解を日本国政府に代わって提案する光栄を有します。


							

						

						

							

								
	With reference to the Notes exchanged between the Government of Japan and the Government of the Republic of the Sudan on the dates enumerated in the List attached hereto concerning Japanese loans (hereinafter referred to as “the Previous Notes”) and to the resolution 165 adopted at the Third Part of the Ninth Special Session of the Trade and Development Board of the United Nations Conference on Trade and Development on March 11, 1978 regarding debt and development problems of developing countries, I have the honour to propose on behalf of the Government of Japan the following understanding:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  １　債務免除方式による債務救済措置が、独立行政法人国際協力機構（以下「ＪＩＣＡ」という。）により、日本国の関係法令に従ってとられることになる。


							

						

						

							

								
1.	A debt relief measure in the form of cancellation will be taken in accordance with the relevant laws and regulations of Japan by the Japan International Cooperation Agency (hereinafter referred to as “JICA”).

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ２ (1)　免除される債務は、従前の書簡に従って締結された借款契約に基づく次の債務（以下「対象債務」という。）から成る。


							

						

						

							

								
2.	(1)	The debts to be cancelled consist of the following debts under the loan agreements concluded in accordance with the Previous Notes (hereinafter referred to as “the Debts”):

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      　従前の書簡に従って締結された借款契約に基づいて支払われるべき二千三年四月一日以後に弁済期限の到来したか又は到来する元本及び利子


							

						

						

							

								
	the principal and interest having fallen or falling due on or after April 1, 2003 which are payable under the loan agreements concluded in accordance with the Previous Notes. 

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
   (2) 　二千九年三月三十一日時点における対象債務の総額の見積りは、三十一億六千五百七十三万五千九百九十五円（三、一六五、七三五、九九五円）である。


							

						

						

							

								
	(2)	The estimate, as of March 31, 2009, of the total amount of the Debts is three billion one hundred and sixty-five million seven hundred and thirty-five thousand nine hundred and ninety-five yen (\ 3,165,735,995).

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
 (3)   　(2)に規定する総額は、スーダン共和国政府及びＪＩＣＡが行う最終的照合の後に、日本国政府及びスーダン共和国政府の権限のある当局間の相互の同意により修正されることがある。


							

						

						

							

								
	(3)	Modifications may be made to the total amount referred to in sub-paragraph (2) above by mutual consent between the competent authorities of the Government of Japan and of the Government of the Republic of the Sudan, after the final verification to be made by the Government of the Republic of the Sudan and JICA.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
   (4) 　ＪＩＣＡの各事業年度における免除の日程は、に規定する各々の元本又は利子の弁済期限の到来のたびにスーダン共和国政府は当該元本又は利子の支払を免除されるという原則に基づき、同政府とＪＩＣＡとの間で決定される。その日程は、日本国政府及びスーダン共和国政府の権限のある当局間で確認される。


							

						

						

							

								
 
	(4)	The schedule of the cancellation for each JICA’s fiscal year will be determined between the Government of the Republic of the Sudan and JICA on the basis of the principle that the Government of the Republic of the Sudan will be exempted from the payment of each principal or interest referred to in sub-paragraph (1) above as they fall due.  The schedule shall be confirmed by the competent authorities of the Government of Japan and of the Government of the Republic of the Sudan.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
 (5)   　(3)及び(4)に規定する日本国政府の権限のある当局は、外務省及び財務省であり、(3)及び(4)に規定するスーダン共和国政府の権限のある当局は、財務・国家経済省である。


							

						

						

							

								
	(5)	The competent authorities of the Government of Japan referred to in sub-paragraphs (3) and (4) above will be the Ministry of Foreign Affairs and the Ministry of Finance, and the competent authority of the Government of the Republic of the Sudan referred to in sub-paragraphs (3) and (4) above will be the Ministry of Finance and National Economy.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ３　対象債務は、スーダン共和国政府に対してＪＩＣＡが行う免除の通告により免除されることになる。


							

						

						

							

								
3.	The Debts will be cancelled by notification to that effect to be made by JICA to the Government of the Republic of the Sudan.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ４　スーダン共和国政府は、対象債務が免除される事実を考慮し、政府間協議の結果に従って、スーダン共和国の貧困を削減し並びに社会的及び経済的開発を促進するために必要な措置をとる。


							

						

						

							

								
4.	The Government of the Republic of the Sudan shall, in accordance with the result of the consultations between the two Governments, take necessary measures to reduce poverty and promote social and economic development of the Republic of the Sudan, taking into account the fact that the Debts will be cancelled.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ５　両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。


							

						

						

							

								
5.	The two Governments shall consult with each other in respect of any matter that may arise from or in connection with the present understanding.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  　本使は、更に、この書簡及び前記の了解をスーダン共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
