書簡をもって啓上いたします。本使は、日本国とルーマニアとの間の文化交流を促進するため日本文化ボランティア・プログラム（以下「プログラム」という。）に基づきボランティアをルーマニアに派遣することに関し、日本国政府の代表者とルーマニア政府の代表者との間でブカレストにおいて行われた最近の討議に言及するとともに、これらの代表者の間で到達した次の了解を日本国政府に代わって確認する光栄を有します。
(Japanese Note) Bucharest, January 22, 2009 Excellency, I have the honour to refer to the recent discussions held in Bucharest between the representatives of the Government of Japan and the Government of Romania concerning the dispatch of volunteers to Romania under the Japan Culture Volunteers Program (hereinafter referred to as “the Program”) with a view to promoting cultural exchange between the two countries, and to confirm on behalf of the Government of Japan the following understanding reached between them:
１ 日本国政府は、日本国の現行法令に従い、ルーマニアにおける日本語及び日本国の文化の普及に寄与するため、両政府の関係当局間で個別に合意される計画に従いボランティアをルーマニアに派遣するために必要な措置をとる。日本国政府は、また、日本国の現行法令に従い、ルーマニアにおけるボランティアの活動に関連する任務を遂行するプログラムのための調整員を在ルーマニア日本国大使館の事務及び技術職員としてルーマニアに派遣するために必要な措置をとる。
1. The Government of Japan will, in accordance with the laws and regulations in force in Japan, take necessary measures to dispatch the volunteers to Romania for the purpose of contributing to the diffusion of Japanese language and Japanese culture in Romania, according to the schedules to be separately agreed upon between the authorities concerned of the two Governments. The Government of Japan will, in accordance with the laws and regulations in force in Japan, also take necessary measures to dispatch the coordinators for the Program to Romania as members of the administrative and technical staff of the Embassy of Japan in Romania, who will discharge the functions related to the activities of the volunteers in Romania.
２ 日本国政府は、予算措置がとられることを条件として、ボランティアの日本国とルーマニアとの間の渡航費及びルーマニアにおける生活手当を負担し、また、ボランティアの任務の遂行に必要な装備、機器、資材及び医薬品を供与するために必要な措置をとる。
2. The Government of Japan will, subject to budgetary appropriations, take necessary measures to bear the cost of international travel between Japan and Romania and living allowances in Romania for the volunteers, and to make available such equipment, machinery, materials and medical supplies as may be necessary for the performance of their functions.
３ ルーマニア政府は、ルーマニアの現行法令に従い、ボランティアに対し、その任期中、ルーマニアに入国し、同国から出国し、及び同国に滞在することを許可し、並びに外国人登録要件に係る手続に関し便宜を与える。
3. The Government of Romania shall permit the volunteers to enter, leave and sojourn in Romania for the duration of their assignment therein in accordance with the laws and regulations in force in Romania and offer them the convenience for procedures of alien registration requirement.
４ ルーマニア政府は、ボランティアに対し、その任期中、内科的及び外科的な緊急事態並びに伝染性疾患の場合における無料診療を提供する。
4. The Government of Romania shall provide the volunteers with free medical care in case of medical and surgical emergencies and infectious transmissible diseases for the duration of their assignment in Romania.
５ ルーマニア政府は、ボランティアの任務の遂行を容易にするためボランティアに対し身分証明書の交付を確保するために必要な措置をとる。
5. The Government of Romania shall take necessary measures to ensure the issuance of identification cards to the volunteers to facilitate the performance of their functions.
６ 日本国政府からボランティアに対する支払に関しては、千九百七十六年二月十二日に東京において署名された所得に対する租税に関する二重課税の回避のための日本国とルーマニア社会主義共和国との間の条約の規定を適用する。
6. With respect to the payments from the Government of Japan to the volunteers, the provisions of the Convention between Japan and the Socialist Republic of Romania for the Avoidance of Double Taxation with respect to Taxes on Income, signed at Tokyo on February 12, 1976, shall apply.
７ ルーマニア政府は、調整員に対し、千九百六十一年四月十八日の外交関係に関するウィーン条約に基づいて事務及び技術職員が享受する特権及び免除を与える。
7. The Government of Romania shall accord the coordinators the privileges and immunities enjoyed by members of the administrative and technical staff pursuant to the Vienna Convention on Diplomatic Relations of 18 April 1961.
８ ルーマニア政府は、調整員に対し、その任務の遂行を容易にするため身分証明書を交付する。
8. The Government of Romania shall issue identification cards to the coordinators to facilitate the performance of their functions.
９ 両政府は、ルーマニアにおけるプログラムの実施を成功させるため、随時協議する。
9. The two Governments will hold consultations from time to time for the successful implementation of the Program in Romania.
10 この了解は、両政府間の書簡の交換によって修正することができ、かつ、いずれか一方の政府が他方の政府に対しこの了解を終了させる意思を六箇月前に書面によって通告することにより終了させることができる。
10. The understanding set out above may be amended by an exchange of notes between the two Governments and terminated by either Government by giving to the other six months’ written notice of its intention to terminate it.
本使は、更に、この書簡及び前記の了解をルーマニア政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency’s Note in reply confirming on behalf of the Government of Romania the foregoing understanding shall constitute an agreement between the two Governments, which will enter into force on the date of Your Excellency’s reply.
