    書簡をもって啓上いたします。本使は、日本国とポーランド共和国との間の文化交流を促進するため日本文化ボランティア・プログラム（以下「プログラム」という。）に基づきボランティアをポーランド共和国に派遣することに関し、日本国政府の代表者とポーランド共和国政府の代表者との間でワルシャワにおいて行われた最近の討議に言及するとともに、これらの代表者の間で到達した次の了解を日本国政府に代わって確認する光栄を有します。

Excellency,

	I have the honour to refer to the recent discussions held in Warsaw between the representatives of the Government of Japan and the Government of the Republic of Poland concerning the dispatch of volunteers to the Republic of Poland under the Japan Culture Volunteers Program (hereinafter referred to as “the Program”) with a view to promoting cultural exchange between the two countries, and to confirm on behalf of the Government of Japan the following understanding reached between them:


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  １　日本国政府は、日本国の法令に従い、ポーランド共和国における日本語及び日本国の文化の普及に寄与するため、両政府の関係当局間で個別に合意される計画に従いボランティアをポーランド共和国に派遣するために必要な措置をとる。日本国政府は、また、日本国の法令に従い、ポーランド共和国におけるボランティアの活動に関連する任務を遂行するプログラムのための調整員を在ポーランド日本国大使館の事務
    及び技術職員としてポーランド共和国に派遣するために必要な措置をとる。


							

						

						

							

								
1.	The Government of Japan will, in accordance with the laws and regulations of Japan, take necessary measures to dispatch the volunteers to the Republic of Poland for the purpose of contributing to the diffusion of Japanese language and Japanese culture in the Republic of Poland, according to the schedules to be separately agreed upon between the authorities concerned of the two Governments.  The Government of Japan will, in accordance with the laws and regulations of Japan, also take necessary measures to dispatch the coordinators for the Program to the Republic of Poland as members of the administrative and technical staff of the Embassy of Japan in the Republic of Poland, who will discharge the functions related to the activities of the volunteers in the Republic of Poland.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ２　日本国政府は、予算措置がとられることを条件として、ボランティア及び調整員の日本国とポーランド共和国との間の渡航費及びポーランド共和国における生活手当を負担し、また、ボランティア及び調整員の任務の遂行に必要な装備、機器及び資材を供与するために必要な措置をとる。


							

						

						

							

								
2.	The Government of Japan will, subject to budgetary appropriations, take necessary measures to bear the cost of international travel between Japan and the Republic of Poland and living allowances in the Republic of Poland for the volunteers and the coordinators, and to make available such equipment, machinery and materials as may be necessary for the performance of their functions.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ３　ポーランド共和国政府は、千九百九十四年十二月七日付けの外交及び公用旅券所持者に対する査証の免除に関する在本邦ポーランド共和国大使館の口上書（第一八－一三一－九四号）及びポーランド共和国の
    法令に従い、ボランティア及び調整員に対し、その任期中、ポーランド共和国に入国し、同国から出国し、及び同国に滞在することを許可する。


							

						

						

							

								
3.	The Government of the Republic of Poland shall permit the volunteers and the coordinators, to enter, leave and sojourn in the Republic of Poland for the duration of their assignment therein, in accordance with the Note Verbale of the Embassy of the Republic of Poland in Tokyo (No. 18-131-94) dated on December 7, 1994, concerning the waiver of visa requirement for the holders of diplomatic or official passports and in accordance with the laws and regulations of the Republic of Poland.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ４　ポーランド共和国政府は、千九百九十二年十月十二日付けの閣僚理事会規則（ＥＥＣ）二九一三・九二（共同体関税法典を制定するもの）、千九百八十三年三月二十八日付けの閣僚理事会規則（ＥＥＣ）九一八・八三（関税の免除に関する共同体制度を定めるもの）及び千九百九十三年七月二日付けの委員会規則（ＥＥＣ）二四五四・九三（共同体関税法典を制定する閣僚理事会規則（ＥＥＣ）二九一三・九二の実施のための規定を定めるもの）に従い、ボランティアに対し、次の免除を与える。
    (i)　ボランティアの任務の遂行に必要な装備、機器及び資材並びに身回品の輸入に関し、ボランティアがその任務を完了してポーランド共和国を出国する際にこれらの装備、機器及び資材並びに身回品を持ち帰ることを条件として、関税を免除すること。
    (ii)　ボランティアの個人的な使用のための医薬品の輸入に関し、このような医薬品がボランティアの手荷物に入れて持ち込まれることを条件として、関税を免除すること。
    (iii)　ボランティアの個人的財産及び家財の輸入に関し、このような財産及び家財が通関の日付の日から十二箇月以内に再販売されないことを条件として、関税を免除すること。


							

						

						

							

								
4.	The Government of the Republic of Poland shall grant the volunteers the following exemptions, in accordance with the Council Regulation (EEC) No 2913/92 of 12 October 1992 establishing the Community Customs Code, the Council Regulation (EEC) No 918/83 of 28 March 1983 setting up a Community system of reliefs from customs duty and the Commission Regulation (EEC) No 2454/93 of 2 July 1993 laying down provisions for the implementation of the Council Regulation (EEC) No 2913/92 establishing the Community Customs Code:

		(i)	Exemption from customs duties in respect of the importation of such equipment, machinery and materials as may be necessary for the performance of their functions and of their personal effects, provided that such equipment, machinery, materials and personal effects will be brought back with the volunteers when they leave the Republic of Poland on the completion of their functions;

		(ii)	Exemption from customs duties in respect of the importation of medical supplies for private use of the volunteers, provided that such medical supplies were brought in their personal baggage; and

		(iii)	Exemption from customs duties in respect of the importation of their personal property and household effects, provided that such property and effects will not be resold within 12 months from the date of customs clearance.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ５　日本国政府からボランティアに対する支払に関しては、千九百八十年二月二十日に東京において署名された所得に対する租税に関する二重課税の回避のための日本国とポーランド人民共和国との間の条約を適用する。


							

						

						

							

								
5.	With respect to the payments from the Government of Japan to the volunteers, the Convention between Japan and the Polish People’s Republic for the Avoidance of Double Taxation with respect to Taxes on Income, signed at Tokyo on February 20, 1980, shall apply.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ６　ボランティアが与えられる任務を遂行する場所における無料の基本家具付住居施設については、ポーランド共和国の受入機関が可能な限り、ボランティアに提供するものとする。


							

						

						

							

								
6.	The volunteers will be offered free housing, with basic furnishings, at places where they are to perform the functions assigned to them to the fullest extent possible by the recipient Polish institutions.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ７　ポーランド共和国の関係当局は、ボランティアに対し、ポーランド共和国の法令に従い、その任期を含む一定の期間の居住許可を与える。


							

						

						

							

								
7.	The appropriate Polish authorities will issue to the volunteers the residence permit for a fixed period of time that covers the duration of their assignment, in accordance with the laws and regulations of the Republic of Poland.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ８　ポーランド共和国政府は、調整員に対し、千九百六十一年四月十八日の外交関係に関するウィーン条約に基づいて事務及び技術職員が享受する特権及び免除を与える。


							

						

						

							

								
8.	The Government of the Republic of Poland shall accord the coordinators the privileges and immunities enjoyed by members of the administrative and technical staff pursuant to the Vienna Convention on Diplomatic Relations of 18 April 1961.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ９　両政府は、いずれか一方の政府の要請により、ポーランド共和国におけるプログラムの実施を成功させるため、協議する。


							

						

						

							

								
9.	The two Governments will hold consultations at the request of either of them for the successful implementation of the Program in the Republic of Poland.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  10　この了解は、両政府間の書簡の交換によって修正することができ、かつ、いずれか一方の政府が他方の政府に対しこの了解を終了させる意思を六箇月前に書面によって通告することにより終了させることができる。


							

						

						

							

								
10.	The understanding set out above may be amended by an exchange of notes between the two Governments and terminated by either Government by giving to the other six months’ written notice of its intention to terminate it.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    本使は、更に、この書簡及び前記の了解をポーランド共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
