  　書簡をもって啓上いたします。本大臣は、ラオス人民民主共和国の経済の安定及び開発努力を促進するために供与される日本国の借款に関して日本国政府の代表者とラオス人民民主共和国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。


							

						

						

							

								
	I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Lao People’s Democratic Republic concerning a Japanese loan to be extended with a view to promoting the economic stabilization and development efforts of the Lao People’s Democratic Republic:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  １　十五億円（一、五〇○、〇〇〇、〇〇〇円）の額までの円貨による借款（以下「借款」という。）が、財政強化支援借款として、国際開発協会による第五次貧困削減支援オペレーションの下での改革計画（以下「改革計画」という。）においてラオス人民民主共和国政府を支援することを目的として、独立行政法人国際協力機構（以下「ＪＩＣＡ」という。）により、日本国の関係法令に従って、ラオス人民民主共和国政府に供与されることになる。


							

						

						

							

								
1.	A loan in Japanese yen up to the amount of one billion five hundred million yen (\1,500,000,000) (hereinafter referred to as “the Loan”) will be extended, as the Budget Strengthening Support Loan, in accordance with the relevant laws and regulations of Japan, to the Government of the Lao People’s Democratic Republic by the Japan International Cooperation Agency (hereinafter referred to as “JICA”) for the purpose of supporting the Government of the Lao People’s Democratic Republic in its reform program under the fifth Poverty Reduction Support Operation by the International Development Association (hereinafter referred to as “the Reform Program”).

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ２(1)　借款は、ラオス人民民主共和国政府とＪＩＣＡとの間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、この了解の範囲内で、なかんずく次の原則を含むことになる前記の借款契約によって規律される。


							

						

						

							

								
2.	(1)	The Loan will be made available by a loan agreement to be concluded between the Government of the Lao People’s Democratic Republic and JICA.  The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreement, within the scope of the present understanding, which will contain, inter alia, the following principles:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (a)　償還期間は、十年の据置期間の後三十年とする。


							

						

						

							

								
	(a)	The repayment period will be thirty (30) years after the grace period of ten (10) years;

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (b)　利子率は、年〇・〇一パーセントとする。


							

						

						

							

								
	(b)	The rate of interest will be nought point nought one per cent (0.01%) per annum; and

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (c)　支出期間は、前記の借款契約の発効の日の後二年とする。


							

						

						

							

								
	(c)	The disbursement period will be two (2) years after the date of coming into force of the said loan agreement.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　(1)(c)に規定する支出期間は、両政府の関係当局の同意を得て延長することができる。


							

						

						

							

								
 
	(2)	The disbursement period mentioned in sub-paragraph (1)(c) above may be extended with the consent of the authorities concerned of the two Governments.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ３(1)　借款は、ラオス人民民主共和国内の輸入者が調達適格国の供給者に対して既に行ったか又は行う支払で、生産物（両政府の関係当局間で合意する表に掲げる生産物を除く。）の購入又は当該生産物の購入に付随する役務の購入のために両者の間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物又はそれらの国から供給される役務について行われる。


							

						

						

							

								
3.	(1)	The Loan will be made available to cover payments already made and/or to be made by importers in the Lao People’s Democratic Republic to suppliers of eligible source countries under such contracts as have been and/or may be entered into between them for purchases of products, except such products as will be enumerated in a list to be mutually agreed upon between the authorities concerned of the two Governments, and/or for purchases of services incidental to the purchase of those products, provided that such purchases are made in such eligible source countries for products produced in and/or services supplied from those countries.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　(1)に規定する表は、両政府の関係当局間の合意によって修正することができる。


							

						

						

							

								
	(2)	The list mentioned in sub-paragraph (1) above may be modified by agreement between the authorities concerned of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (3)　(1)に規定する調達適格国の範囲は、両政府の関係当局間で合意される。


							

						

						

							

								
	(3)	The scope of eligible source countries mentioned in sub-paragraph (1) above shall be agreed upon between the authorities concerned of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ４　ラオス人民民主共和国政府は、ラオス人民民主共和国政府の名義で開設される国家予算勘定に借款の円貨による支出額に等しい額を振り替えるようにするための措置をとる。このようにして振り替えられた額は、ラオス人民民主共和国政府の国家予算に編入され、二千六年七月に承認されたラオス人民民主共和国政府の社会経済開発計画（二千六年－二千十年）の政策目標を達成するために改革計画の実施を支援するために使用される。


							

						

						

							

								
4.	The Government of the Lao People’s Democratic Republic shall take measures to have the equivalent amount of yen disbursements of the Loan transferred to the state budget account opened in the name of the Government of the Lao People’s Democratic Republic.  The amount thus transferred shall be included in the state budget of the Government of the Lao People’s Democratic Republic, and shall be used to support the implementation of the Reform Program to achieve policy goals stated in the National Socio-Economic Development Plan (2006-2010) of the Government of the Lao People’s Democratic Republic approved in July 2006.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ５　ラオス人民民主共和国政府は、３(1)に規定する生産物又は役務がＪＩＣＡの調達のためのガイドライン（国際競争入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際競争入札の手続をなかんずく定める。）に従って調達されることを確保する。


							

						

						

							

								
5.	The Government of the Lao People’s Democratic Republic shall ensure that the products and/or services mentioned in sub-paragraph (1) of paragraph 3. are procured in accordance with the guidelines for procurement of JICA, which set forth, inter alia, the procedures of international competitive bidding to be followed except where such procedures are inapplicable or inappropriate.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ６　ラオス人民民主共和国政府は、借款に基づいて購入される生産物の海上輸送及び海上保険に関し、海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限を課することも差し控える。


							

						

						

							

								
6.	With regard to the shipping and marine insurance of the products purchased under the Loan, the Government of the Lao People’s Democratic Republic shall refrain from imposing any restrictions that may hinder fair and free competition among the shipping and marine insurance companies.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ７　ラオス人民民主共和国政府は、ＪＩＣＡについて、借款及びそれから生ずる利子に対して又はそれらに関連してラオス人民民主共和国において課されるすべての財政課徴金及び租税を免除する。


							

						

						

							

								
 
7.	The Government of the Lao People’s Democratic Republic shall exempt JICA from all fiscal levies and taxes imposed in the Lao People’s Democratic Republic on and/or in connection with the Loan as well as interest accruing therefrom.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ８　ラオス人民民主共和国政府は、借款が適正にかつ専ら３(1)に規定する生産物又は役務の購入のために使用されることを確保するために必要な措置をとる。


							

						

						

							

								
8.	The Government of the Lao People’s Democratic Republic shall take necessary measures to ensure that the Loan be used properly and exclusively for purchases of products and/or services mentioned in sub-paragraph (1) of paragraph 3.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ９　ラオス人民民主共和国政府は、要請に応じ、日本国政府及びＪＩＣＡに対し、次のものを提供する。

  10　両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。

  　本大臣は、更に、この書簡及び前記の了解をラオス人民民主共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
