    書簡をもって啓上いたします。本使は、日本国とハンガリー共和国との間の文化交流を促進するため日本文化ボランティア・プログラム（以下「プログラム」という。）に基づきボランティアをハンガリー共和国に派遣することに関し、日本国政府の代表者とハンガリー共和国政府の代表者との間でブダペストにおいて行われた最近の討議に言及するとともに、これらの代表者の間で到達した次の了解を日本国政府に代わって確認する光栄を有します。

Excellency,

	I have the honour to refer to the recent discussions held in Budapest between the representatives of the Government of Japan and the Government of the Republic of Hungary concerning the dispatch of volunteers to the Republic of Hungary under the Japan Culture Volunteers Program (hereinafter referred to as “the Program”) with a view to promoting cultural exchange between the two countries, and to confirm on behalf of the Government of Japan the following understanding reached between them:



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  １　日本国政府は、日本国の現行法令に従い、ハンガリー共和国における日本語及び日本国の文化の普及に寄与するため、両政府の関係当局間で個別に合意される計画に従いボランティアをハンガリー共和国に派遣するために必要な措置をとる。日本国政府は、また、日本国の現行法令に従い、ハンガリー共和国におけるボランティアの活動に関連する任務を遂行するプログラムのための調整員を在ハンガリー日本国大使館の事務及び技術職員としてハンガリー共和国に派遣するために必要な措置をとる。


							

						

						

							

								
1.	The Government of Japan will, in accordance with the laws and regulations in force in Japan, take necessary measures to dispatch the volunteers to the Republic of Hungary for the purpose of contributing to the diffusion of Japanese language and Japanese culture in the Republic of Hungary, according to the schedules to be separately agreed upon between the authorities concerned of the two Governments.  The Government of Japan will, in accordance with the laws and regulations in force in Japan, also take necessary measures to dispatch the coordinator(s) for the Program to the Republic of Hungary as members of the administrative and technical staff of the Embassy of Japan in the Republic of Hungary, who will discharge the functions related to the activities of the volunteers in the Republic of Hungary.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ２　日本国政府は、予算措置がとられることを条件として、ボランティアの日本国とハンガリー共和国との間の渡航費及びハンガリー共和国における生活手当を負担し、また、ボランティアの任務の遂行に必要な装備、機器及び資材を供与するために必要な措置をとる。


							

						

						

							

								
2.	The Government of Japan will, subject to budgetary appropriations, take necessary measures to bear the cost of international travel between Japan and the Republic of Hungary and living allowances in the Republic of Hungary for the volunteers, and to make available such equipment, machinery and materials as may be necessary for the performance of their functions.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ３　ハンガリー共和国政府は、ボランティアに対し、その任期中、ハンガリー共和国に入国し、同国から出国し、及び同国に滞在することを許可し、並びに外国人登録要件に係る手続に関し便宜を与える。


							

						

						

							

								
3.	The Government of the Republic of Hungary shall permit the volunteers to enter, leave and sojourn in the Republic of Hungary for the duration of their assignment therein and offer them the convenience for procedures of alien registration requirement.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ４　ハンガリー共和国政府は、ボランティアに対し、次の特権、免除及び便宜を与える。
    (i)　千九百八十三年三月二十八日付けの閣僚理事会規則（ＥＥＣ）九一八・八三（関税の免除に関する共同体制度を定めるもの）及び千九百九十三年七月二日付けの委員会規則（ＥＥＣ）二四五四・九三（共同体関税法典を制定する閣僚理事会規則二九一三・九二の実施のための規定を定めるもの）に従い、２に規定する装備、機器及び資材並びに個人的な使用のための医薬品の一時的な輸入に関して、関税、租税その他の課徴金を免除すること。
    (ii)　千九百八十三年三月二十八日付けの閣僚理事会規則（ＥＥＣ）九一八・八三（関税の免除に関する共同体制度を定めるもの）及び千九百九十三年七月二日付けの委員会規則（ＥＥＣ）二四五四・九三（共同体関税法典を制定する閣僚理事会規則二九一三・九二の実施のための規定を定めるもの）に従い、身回品及び家財の輸入に関して、関税、租税その他の課徴金（保管、運搬及び類似の役務に関するものを除く。）を免除すること。
    (iii)　千九百八十年二月十三日にブダペストにおいて署名された所得に対する租税に関する二重課税の回避のための日本国とハンガリー人民共和国との間の条約第十九条１(a)の規定に従い、２に規定する生活手当等のボランティアに対して日本国から送付される手当に関して、所得税その他の課徴金を免除すること。
    (iv)　ボランティアの任務の遂行を容易にするためボランティアに対しハンガリー共和国政府による身分証明書を交付すること。


							

						

						

							

								
4.	The Government of the Republic of Hungary shall grant the volunteers the following privileges, exemptions and benefits:

 
(i)	Exemption from customs duties, taxes and charges of any kind in respect of the temporary importation of the equipment, machinery and materials mentioned in paragraph 2 above as well as medical supplies for private use, in accordance with the Council Regulation (EEC) No 918/83 of 28 March 1983 setting up a Community system of reliefs from customs duty and the Commission Regulation (EEC) No 2454/93 of 2 July 1993 laying down provisions for the implementation of Council Regulation 2913/92 establishing the Community Customs Code;

(ii)	Exemption from customs duties, taxes and charges of any kind other than those for storage, cartage and similar services in respect of the importation of their personal and household effects, in accordance with the Council Regulation (EEC) No 918/83 of 28 March 1983 setting up a Community system of reliefs from customs duty and the Commission Regulation (EEC) No 2454/93 of 2 July 1993 laying down provisions for the implementation of Council Regulation 2913/92 establishing the Community Customs Code;

(iii)	Exemption, in accordance with paragraph 1(a) of Article 19 of the Convention between Japan and the Hungarian People’s Republic for the Avoidance of Double Taxation with respect to Taxes on Income, signed at Budapest on February 13, 1980, from income taxes and charges of any kind on any allowances to be remitted to them from Japan such as the living allowances mentioned in paragraph 2 above; and

(iv)	Issuance of identification cards from the Government of the Republic of Hungary to the volunteers to facilitate the performance of their functions.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ５　ハンガリー共和国政府は、ボランティアが与えられる任務を遂行する場所における基本家具付住居施設を、当該ボランティアが可能な限り無料で取得できるよう便宜を与える。


							

						

						

							

								
5.	The Government of the Republic of Hungary shall facilitate the acquisition by the volunteers of housing with basic furnishings, at no cost to the fullest extent possible, at places where they are to perform their functions to be assigned to them.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ６　ハンガリー共和国政府は、調整員に対し、千九百六十一年四月十八日の外交関係に関するウィーン条約に基づいて事務及び技術職員が享受する特権及び免除を与える。


							

						

						

							

								
6.	The Government of the Republic of Hungary shall accord the coordinator(s) the privileges and immunities enjoyed by members of the administrative and technical staff pursuant to the Vienna Convention on Diplomatic Relations of 18 April 1961.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ７　ハンガリー共和国政府は、調整員に対し、その任務の遂行を容易にするため身分証明書を交付する。


							

						

						

							

								
7.	The Government of the Republic of Hungary shall issue identification cards to the coordinator(s) to facilitate the performance of their functions.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ８　ハンガリー共和国政府は、ハンガリー共和国におけるボランティアの公務に起因し、その遂行中に発生し、又はその遂行中における作為若しくは不作為に関連する請求が生じた場合には、その請求に関する責任を負う。ただし、これらの請求がボランティアの重大な過失又は故意から生じたときは、この限りでない。


							

						

						

							

								
8.	The Government of the Republic of Hungary shall bear claims, if any arises, resulting from, occurring in the course of, or otherwise connected with any action performed or omission made in the course of the official functions by the volunteers in the Republic of Hungary, except when such claims arise from gross negligence or willful misconduct on the part of the volunteers.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ９　両政府は、ハンガリー共和国におけるプログラムの実施を成功させるため、随時協議する。


							

						

						

							

								
9.	The two Governments will hold consultations from time to time, for the successful implementation of the Program in the Republic of Hungary.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  10　この了解は、両政府間の書簡の交換によって修正することができ、かつ、いずれか一方の政府が他方の政府に対しこの了解を終了させる意思を六箇月前に書面によって通告することにより終了させることができる。


							

						

						

							

								
10.	The understanding set out above may be amended by an exchange of notes between the two Governments and terminated by either Government by giving to the other six months’ written notice of its intention to terminate it.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    本使は、更に、この書簡及び前記の了解をハンガリー共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意がその効力発生のために必要な国内手続を完了した旨のハンガリー共和国政府からの書面による通告を日本国政府が受領した日に効力を生ずるものとすることを提案する光栄を有します。


							

						

						

							

								
	I have further the honour to propose that this Note and Your Excellency’s Note in reply confirming on behalf of the Government of the Republic of Hungary the foregoing understanding shall constitute an agreement between the two Governments, which shall become effective on the date of receipt by the Government of Japan of the written notification from the Government of the Republic of Hungary of the completion of necessary domestic procedures for the entry into force of such agreement.
